I A RESOLUTION OF THE COMM:ISSION OF THE CITY OF BOZEMAlf, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT DISTRICT NO. 271 OF SAID CITY, FOR THE PUR- POSE OF GRADING AND PAVING WITH WARRENITE-BITULITHIC PAVEMENT ON EAST OLIVE STREET BETWEEN THE EAST LINE OF TRACY AVENUE AND THE WEST LINE OF BOZEMAN AVENUE, WITHIN SAID CITY, AND TO SPE- CIALLY ASSESS THE ENTIRE COST AND EXPENSE OF N~ING SAID IMPROVE- MENTS AGAINST THE LAND WITHIN SAID DISTRICT AS CREATED. BE IT RESOLVED BY THE COM1~ISSION OF THE CITY OF BOZE~~N: Section 1. That it is hereby declared to be the intention of the Commission of the ~ity of Bozeman, State of Montana, to create a Special Im- provement District to be known and designated as ~peci~l Improvement vistrict ~o. 271 of said ~ity for the purpose of making the improvements within said Spe- cial Improvement ~istrict hereinafter described. Section 2. That the boundaries of said Special Improvement District ~o. 271 to be created, are as follows: Beginning at a point in the east line of S Tracy Avenue, said point being 148.5 feet north of the north line of E Olive Street; thence south along the said east line of S Tracy Avenue to a point 148.5 feet south of the south line of said ~ Olive Street; thence east parallel with and 148.5 feet S. of said south line of E Olive Itreet to the west I line of S Bozeman Avenue; thence north along said west line of S. Bozeman Avenue to a point 148.5 feet north of the north line of said ~. Olive Street; thence west parallel with and 148.5 feet north of said north line of ~ Olive Street, to the point of beginning. ~he assessments against all corner lots, viz; the south 30 feet of Blocks A & B and the north 30 feet of Blooks ~ & D of Blaok's Addition to Bozeman, to be double that of inside lots. Seotion 3. That it is hereby declared to be the opinion of said Commission of the City of Bozeman, State of Montana, that all of the land with- in said proposed Speoial Improvement Distriet as defined in Section 2 of this resolution, whether abutting on said improvement or not, will be specially benefitted by the grading, paving, and all of said improvements and should bear the cost of said improvements in accordance with the laws of the State of Montana in such case made and provided. Section 4. That the character of the improvement to be made within said Special lmprovement Vistrict ~o. 271 is the grading and paving with Warrenite-Bitullthic Pavement, on East Olive Street between the ~ast line of Traoy Avenue South and the West ~ine of Bozeman Avenue South in said ~ity of I Bozeman, Montana. Section 5. That the area of all corner lots within said proposed distriot is 35515.8 s~uare feet and the area of all inside lots within said proposed distriot is 136215.64 square feet, making the total area of the land I in said proposed distriot to be taxed for the cost of said improvements lexclu- wive of streets, avenues, alleys and public places)171731.44 s~uare feet and an approximate estimate of the cost of said improvement, to be especially taxed and assessed against the land therein, is $0.095756 per s~uare foot for corner lots and $0.047878 per s~uare foot for inside lots. Section 7. That the entire cost and expense of making the special improvements herein set forth in said Special Improvement lJistrict No. 271 shall be paid by Special Improvement District ~oupon Bonds, as authorized by the laws of the state of Montana, which bonds shall be in the denomination of One hundred Dollar 8 l$lOO.OO) each, or fractions thereof where necessary, to be issued and chargeable against a fund to be known as I1Special Improvement District No. 271 Fund 11 , said bonds to be redeemable at the option of the ~i ty of Bozeman, Montana, whenever funds are availab Ie for that purpose from said Special Improvement District ~o. 271 b~d. Said bonds shall draw simple interest at the rate of six per cent per annum, which interest shall be chargeable as a part of the cost of said improvement, and shall run from the date of the registration of said I bonds until said bonds are paid.. Section S. To pay said bonds, and interest thereon, representing the cost of said improvement, a special assessment shall be levied against all of the lands within said proposed Special Improvement ~istrict No. 271 as herein- before defined, each lot or parcel of land within said District to be assessed for that portion of the whole cost in the proportion that the a.rea of said lot, or parcel of land, bears to the area of the entire district, exclusive of streets, avenues, alleys or public places, provided, that each 8~uare foot of the land within said district embraced within any corner lot or tract land for the purpose of assessment in this district a corner lot is defined as being any tract of land, excepting street, avenues or alleys, located within a distance of 30 feet of either side line of E. Olive street within the district} shall be so assessed that each square foot of the land embraced wi thin any such corner lot, or tract, shall bear double the amount of the cost of such improvement that a square foot of any inside lot, or tract, shall bear. Section 9. Said assessment and taxes shall be payable in twenty- I one annual installments, with six per cent annual interest on deferred payments, commencing with the year 1928, but this provision shall not be construed to prevent full payment at any time. ..... -----..---..-.. -.- - _._~. ..- - 247 n. That the regular session of the Commission of the City of Bo zeman, State of Montana, to be held in said Commission's room in the City Hall I of said City of Bozeman, on Friday, the 8th day of June, 1928,at four o'clock P M of said day, are the time and place designated when and where the ~ommission will hear and pass upon all protests duly and regularly made and filed against the proposed improvement and the creation of said Special Improvement District, and the extent and character thereof, or of either thereof. Section 11. That the Clerk of said Commission of the City of Bozeman, State of Montana, be, and he is hereby directed to give notice as required by law, of the adoption of this Resolution. Passed by the Commission of the City of Bozeman, Montana, and approved by the Mayor of said City this 18th day of May, A. NOT ICE . ------ NOTICE IS HEREBY GIVEN That at a regular meeting of the Commission of the City of Bozeman, State of Montana, held on Friday, the 18th day of May, 1928, a Resolution was duly passed by said (Jommission declaring its intention to create a Special Improvement District to be known and designated as Special Improvement District No. 271 of said City, for the purpose of grading and paving with Warrenite-Bitulithic pavement on East Olive street between Tracy and Bozeman Avenues and declaring it to be the intention of said Commission to speoially assess the entire cost and expense of making suoh improvements against the en- tire district, each lot or paroel of land within such district to be assessed for I that part of the whole cost whioh its area bears to the area of the enti~e dis- trict, exclusive of streets, avenues, alleys and public places, provided that eac~Bquare foot of the land in said district emgraced within any corner lot shall bear double the amount of the cost of such improvement that a square foot of any inside lot shall bear, a corner lot to be considered as 30 feet in width. -....--.--- .- 248 That the estimate of the total cost and expense of making such improvements is $ 9,922.50, that the total area of property in the district to be assessed for the proposed improvement exclusive of streets, avenues, alleys and I public places is 171731.44 square feet, that the estimated cost for each corner lot in said district is $0.095756 per square foot and the estimated cost for each inside lot in said district is $ 0.047878 per square foot, and that Friday, the 8th day of June, 1928, at 4 o'clock P M and the Commission Chamber of the said City of Bozeman, has been designated as the time when, and the place where, the said Commission will hear and pass upon all protests that may be made against the proposed work or against the extent or creation of the said district to be assessed or both. Such protests, if any, must be in writing, and must be de- livered to the Clerk of the Commission within fifteen days after the date of the first publication of this notice. For a description of the boundaries of said proposed Special Improvement District No. 271 reference is hereby made to Commission Resolution No. 104 deolaring the intention of said Commission to oreate said special im- provement district, which is now on file in the office of the Clerk of the Commission of the City of Bozeman, Montana.
