A RESOLUTIOB OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
CREATING SPEOIAL IMPROVEMENT DISTRICf NO. 275 OF THE CITY
OF
BOZEMAN, S'lATE OF MONTANA, FOR THE PURPOSE OF GRADING; PAVING
I
WITH TWO COURSE CRUSHED GRAVEL MACADAM PAVEMENT AND CONSTRUC-
TING SUCH CULVERTS AS MAY BE NECESSARY ON WEST COLLEGE STREET
BETWEEN THE EAST LINE OF FOURTH AVENUE AND THE EAST LINE OF
EIGHTH AVENUE, WITHIN SAID CITY, AND TO SPECIALLY ASSESS THE
ENTIRE COST AND EXPENSE OF MAKING SAID IMPROVEMENTS AGAINST
THE PROPERTY WITHIN SAID DISTRICT UNDER AND BY VIRTUE OF THE
PROVISIONS OF SECTIONS 5225 TO 5277 INCLUSIVE, OF THE REVISED
CODES OF MONTANA, 1921, AND ANY AMENDMENTS THERETO.
WHEREAS, At a regular session of the Commission of the City
ot Bozeman,
State of Montana, held on the 13th day of July, A. D., 1928,
the said Commission
duly passed Commission Resolution No. 113, deolaring it to
be the intention of
said Commission to create a special improvement district to
be known and designated
as ~ecial Improvement District No. 275 of said City, for the
purpose of Grading;
Paving wi th Two Course Crushed Gravel Macadam Pavement; am
constructing such

Fourth Avenue and the east line of Eighth Avenue, within 8aid
City, and to speo-
ially assess the entire cost and expense of making said improvements
against the.
property within said district, under and by virtue of the
Provisions of Sections
5225 to 5277 inclusive. of the Revised Codes of Montana, 1921.
and any amendments
thereto, which said Commission Resolution No. 113 is hereby
referred to and made I
a part hereof for further particulars in re8pect to the boundaries
of said
district, the estimated cost of said improvement aDd the method
of assessing the
same against the property within said district.
AND WHEREAS, Notioe of the passage of Commission Resolution
No. 113
was duly published in the Bozeman Weekly Chronicle, a weekly
newspaper printed
and published in said Cit.y of Bozeman. to-wit:
In the issue of July 19. 1928 and
by sending a copy of such notice by registered mail. to each
person. firm or
corporation, or agent of such person. firm or corporation
having property within
the proposed district, at his last known address, upon the
same day such notice
was first published as aforesaid, and due proof having been
made of the publica-
tion of said notioe;
AND WHEREAS, Within the time provided by law and published
notice
there were- filed with the Clerk of the Commission no written
protests against
the proposed work and against the creation and extent of said
district to be
assessed; and the Commission was in regular session on the
3rd day of Agust,
1928 at 4 o'olock Pm M. of said day, at the Commission Chamber,
in the City I
Hall Building in the said City of Bozeman. the same being
the time and plaoe
designated for hearing and passing upon all protests. if any.
against the
proposed work or against the creation or extent of said district,
or both; and
it further appearing that all of the proceedings for the creation
of said
district have been complied with;
NOW, THEREFORE, BE IT RESOLYED BY THE COWISSION OF THE CITY
OF BOZEMAN.

STATE OF MONTAIU.:
Sec. ~. That said Special Improvement
District No. 275 of the City of
I
Bozeman, State of Montana,
be, and the same is hereby created for the purpose of
making the improvements therein as hereinafter described.
Sec. 2.
That said Speoial Improvements be, and the same are, hereby
ordered to be made in said
Special Improvement District no. 275 as follows:
The Grading, the paving with Two
Course Crushed Gravel Maoadam
Pavement, and the construction of such culverts as may be
necessary on West College Stree' between the east line of
Fourth Avenue and the east line of Eighth Avenue.
Sec. 3. That the entire cost and
expense of making the speoial improve-
ments herein set forth in said
Special Improvement District No. 275 shall be paid
by Speoial Improvement Distriot
Cou~on Bonda of the denomination of One Hundred
Dolla.rs,
(.lOO.OO) each, and in fractions thereof where necessary, to be issued
and ohargeable against a fund
to be known as Speoial Improvement Distriot No. 275
Fund; said bonds to be redeemable
at the option of the City of Bozeman, Montana,
whenever funds are available
for that purpose from said Special Improvement
District No. 275 Fund; said
bonds shall draw simple interest at the rate of six per
cent per annum, which shall
be ohargeable as a part of the cost of said special
improvement and shall run from
the date of the registra.tion of said bonds until
I
said bonds are paid; and such
interest, from the date of the registration at the
banda until the payment of the first instanment, w111 be colleoted by the
Direotor of Finance of said
City of Bozeman at the time at collecting suoh first
installment; that the entire
cost and expense of sald improvement within said
distriot shall be defr~.d by
a special assesament against the entire district,
eaoh lot or parcel of land
within said district wherein the improvements shall be
made, to be assessed for its
proportion of ~oh expense, eaoh square foot of the
area of such lots or paroels
of land within said Speoial lmprovement District
No. 275, exclusive of streets,
avenues, alleys and publio plaoes, to be assessed
for its proportionate share
of suoh entire cost; provided, that each square foot
of the land within said district
embraced within a~ corner lot, or tract (and
for the purpose of assessment
in this district a corner lot 1s defined as being
any tract of land, excepting
streets, avenues or alleys, located within a dis-
tanoe of 30 feet of either
side line of West College street within the district)
shall be so assessed that each
square foot of the land embraced within any such

corner lot, or tract, shall
bear double the amount of the cost of such improve-
ment that a square foot of any inside lot, or traot, shall bear.
That the amount
assessed against eaoh lot, or tract. shall bear.
That the amount assessed against
each lot or parcel of land
shall be paid in equal annual installments extending
over a period of six years.
Sec. 4. That the City Engineer
be, and he is hereby directed to prepare

plans and speoifications for the doing of said work and making
said improvements.
Seo. 5. That the Clerk of the
Commission be, and he 1s hereby directed

to publish a notioe inviting proposals for the furnishing
of materials, the
doing of the work and making of said improvements in said
Special Improvement
District No. 275, referring to plans and specifioations on
file, by J;>ubllshlng
same in two issues of the Bozeman Daily Chronicle, a daily
newspaper printed and
published in the said City of Bozeman, not less than ten days
before the time
such bids will be opened, which shall be at a meeting of the
Commission to be
held on Friday, the 17th day of August, 1928.
Passed and adopted by the Commission of the City of Bozeman at a
regular session thereof, held on the 3rd day of August, 1928.
Approved by the Mayor on the 3rd day of August, 1928.
