COMMISSION RESOLUTION NO. 114 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN. MONTANA, CREATING SPECIAL IMPROVEMENT DISTRICT NO. 273 OF THE CITY OF BOZEMAN, STATE OF MONTANA. FOR THE PURPOSE OF I GRADING: PAVING WITH TWO COURSE CRUSHED GRAVEL MACADAM PAVE- MENT AND CONSTRUCTING CONCRETE CURBS ON WEST CURTISS STREET BETWEEN THE WEST LINE OF SEVENTH AVENUE AND THE EAST LINE OF EIGHTH AVENUt WITHIN SAID CITY. AND TO SPECIALLY ASSESS THE DT mE COST AND EXPENSE OF MAKING SAID IMPROVEMENTS AGAINST THE PROPERTY WITHIN SAID DISTRICT UNDER AND BY VIRTUE OF THE PROVISIONS OF SEOTIONS 5225 TO 5277 INCLUSIVE, OF THE RE- VISED CODES OF MONTANA, 1921. AND .ANY AMENDMENTS THERETO. WHEREAS. at a regular session of the Co~ission of the City of Bozeman. State ot Montana, held on the 13th day of July. A. D. 1928. the said Commisaion duly passed Comuission Resolution No. 111. declaring it to be the intention of said Commission to create a speoial improvement district to be known and designated as Special Improvement Distriot No. 273 ot said City, for the purpose of Grading; Paving with Two Course CruShed Gravel Maoadam Pavement and Constructing Concrete Curbs on West Curtiss Street between the west line of Seventh Avenue and the east - line of Eighth Avenue. within said City. and. to specially assess the entire cost and expense of making said improvements against the'property within said distrist under and by virtue of the Provisions of Sections 5225 to 5277 inclusive, of the Revised Codes of Montana, 1921, and any amendments thereto. which said Commission Resolution No. III is hereby referred to and made a part hereof for further I particulars in respect to the boundaries of said district. the estimated cost of said improvement am the method of assessing the same against the property within said distriot. AND WEEDAS, Notice of the passage of Commission Resolution No. III was duly published in the Bozeman Weekly Chronicle. a weekly newspaper printed and published in said City of Bozeman, to-wit: In the issue of July 19th, 1928 and by sending a oOPY of such notice by registered mail to eaoh pe~son. firm or corporation. or agent of suoh person, firm or corporation having property within the propose( district at his last known address upon the same day such notice was first published as aforesaid. and due proof having been made of the publica- tion of said notice; AND WHEREAS, Within the time provided by law and published notice there -- were filed with the Clerk of the Commission no protests against the proposed work and against the creation and extent of said district to be assessed; and the Commission was in regular session on the 3rd day of August. 1928 at 4 o'clook P. M. of said day. at the Commission Chamber in the City Hall Building in the I said Oi ty of Bozeman. the same being the time and place designated for hearing and passing upon all protests, if any. against the proposed work or against the creation or extent of said district, or both; and if further appearing that all of the prooeedings for the oreation of said district have been oomplied with; .. ., ~" ":., 2r75 " NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN. STATE OF MONTANA; I Sec. 1. That said Special Improvement District No. 273 of the City of Bozeman. Stat. of Montana, be and the same is hereby created for the purpose- of making the improvements therein as hereinafter described. Seo. 2. That said Special Improvements be, and the same are. hereby ordered to be made in said Special Improvement District No. 273 as follows: The Grading; the paving with Two Course Crushed Gravel Macadam Pavement and the construction ot Concrete Curbs on West Curtiss stre.'\ between the West line of Seventh Avenue and the East line ot Eighth Avenue. Sec. 3. That the entire cost and expense of making the speoial improve. ments herein set forth in said Speoial Improvement District No. 273 shall be paid by Special Improvement District Coupon Bonds of the denomination of One Hundred Dollars ($100.00) each, and in tractions thereot where necessary to be issued and chargeable against a fund to be known as Special Improvement District No. 273 Fund; said bonds to be redeemable at the option of the City of Bozeman, Montana. whenever tunds are available for that purpose from said Speoial Improvement District No. 273 Fund; said bonds shall draw simple interest at the rate ot six I per cent per annum, which shall be ohargeable as a part ot the cost of said speoial improvement and shall run from the date of the registration of said bonds until said bonds are paid; and such interest, from the date of the reg1-atration of the bonds until the payment of the first instailment, will be colleoted by the Director of Finance of said City of Bozeman at the time of oollecting such first installment; that the entire co at and exp'ense of said improvement wi thin said district shall be de~rayed by a special assessment against the entire district, each lot or parcel ot land within said district wherein the improvements shall be made, to be assessed for its proportion ot such expense, eaoh square foot ot the area of suoh lots or parcels of land within said Special Improvement District NO. 273, exclusive of streets, avenues, alleys and public places, to be assessed for its proportionate share ot such entire cost; provided, that each square foot of the land within said district embraced within any corner lot, or tract (and for the purpose of assessment in this district a corner lot is defined as being any tract of land. excepting streets, avenues, or alleys, located within a distance of 30 feet of either side line of West Curtiss street within the district) shall be so I assessed that eaoh square foot of the land embraced within any such corner lot, or tract, shall bear double the amount of the cost of such improvement that a square foot of a~ inside lot, or tract, shall bea.r. That the amount assessed against each lot or parcel of land shall be paid in equal annual installments extijnding over a period of six years. Seo. 4. That the Clerk of the Commission be, and he is hereby directed to publish a notice invitiDg proposals for the furnishing of materials, the doing ot I the work and making of said improvementw in said Special Improvement District No. 273, reterring to plans and specifications on file, by publishing the same in two issues of the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, not less than ten days before the time suoh bids will be opened, whioh shall be at a meeting of the Commission to be held on Friday, the 17th day of AugU.st, 1928. Passed and adoz;ted by the Commission of the City of Bozeman at a regu.l.ar session thereof, held on the 3rd day of August, 1928.
