HomeMy WebLinkAboutResolution 113 Creating SID No. 275 'r I' ,.' -- 2'71 COMltISSIOIf RESOLUTIOlf NO. 113 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENT ION OF SAID C OBISSION TO CREATE A SPECIAL IMPROVEMENT DISTRIC!r TO BE KNOWN AND DESIGNATED AS I SPECIAL IMPROVEMENr DISTRICT NO. 275 OF SAID CITY, FOR THE PUR- POSE OF GRADING; PAVING WITH TWO COURSE CRUSHED GRAVEL MACADAM PAVEMENT; AND SUCH CULVERTS AS MAYBE NECESSARY ON WEST COLLEGE STREET BETWEEN THE EAST LINE OF FOURTH A VENUE AND THE EAST LINE OF EIGHTH AVENUE, WITHIN SAID CITY. AND TO SPECIALLY ASSESS THE ENTIRE COST AND EXPENSE OF MAKING SAID IMPROVEMENTS AGAINST THE LAND WITHIN SAID DISTRICT AS CREATED. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1. That it is hereby deolared to be the intention of the Com- mission of the City of Bozemn, State of Montana, to create a Special Improvement Dis~riot to be known and designated as Special Improvement Distriot to be known and designated as Special Improvement District No. 275 of said City for the pur- pose of making the i~rovements. within said Special Improvement Distriot herein- after described. Section 2. ~hat the boundaries of s.id Speoial Improvement Distriot No. 275, to be oreated, are as follows:- Beginning at a point in the east line of South ~ighth Avenue,' 'said point being 165 feet north of the north line of West College street; thence south along the said east line ot South Eighth Avenue to a point 165 feet south of the south I line of said West College street; thence east parallel with and 165 feet south of said south line of West ,College street to the east line of South Fourth Avenue; thence north along said east line of South Fourth Avenue to a point 165 teet north of the north line of said West College Stree~; thence west parallel with and 166 feet north of said north line of West College street, to the point of beginning. The asseS8- ~nt8 against all oorner lots, viz; the south 30 feet of the tracts south of Blocks 46 - 47 - 48 and 49 of Park Addition ani the north 30 feet of Blocks 2 - 3 - 4 and 5 of Capitol Hill Add~tion to Bozeman, to be double that of inside lots. Seotion 3. That it is hereby deolared to be the opinion of said Commis- sion of the City of Bozeman, state of MOntana, that all of the land within said proposed Special Improvement District as defined in Section 2 of this resolution, , whether abutting on said improvement or not, will be speoially benefitted by the grading, the paving, installation of culverts and all of said improvements and should bear the cost of said improveIOOnts in accordance with the Laws of the State of MontalB. in suoh case made and provided. Section 4. That the character of the improvement to be made within said Speoial Improvement District No. 275 is the grading; the paving with Two Course Crushed Gravel Macadam pavement; and the installing of such culverts as may be I neeessary op. West College Street between the East line of Fourth Avenue South and the East line of Eighth Avenue South in said City of Bozeman, Montana. Section 5. That an approximate estimate of the cost of doing all of the work of construoting all of said improvement, inoluding the grading, paving, culverts, engineering, inspeotion and all inoidental expenses is Three Thousand Bine Hundred Fifty Nine Dollars, ($3.959.00). ..... -.-. .. 2'72 -- -- Section 6. That the area of all corner lots within said proposed district is 67742 square feet and the area of all insid.e lots within said proposed I district is 302378 square feet making the total area of the land in said proposed district to be taxed for the cost of said improvements (exolusive of streets. avenues. alleys and public places ) . 370120 square feet and an approximate estimate of the cost of said improvement, to be speoial1y taxed and assessed against the land therein, is to.018084 per square foot for corner lots and $0.009042 per square foot for inside lots. Section 7. That the entire cost and expense of making the special improvements herein set forth i~ said Special Improvement District No. 275 shall be paid by Special ]mprovement District Coupon Bonds. as authorized by the Laws of the state of Montana. which bonds shall be in the denomination of One Hundred Dollars, ($100.00), each or fractions thereof where neoessary. to be issued and chargeable against a fund to be known as "Special Improvement District No. 275 FUnd". said bonds to be redeemable at the option of the City of Bozeman. Montana. whenever funds are available for that purpose from said Special Improve- ment District No. 275 Fund. Said bonds shall draw simple interet at the rate of six per cent per ann~, which interest shall be chargeable as a part of the I cost of said improvement. and shall run from the date of the registration of said bonds until said bonds are paid. Section 8. To 'pay said bonds, and interest thereon, representing the cost of said improvemellt, a special assessment shall be levied against all of the lands within said proposed Speoial Improvement Distriot Bo. 275 as herein- before defined. each lot or parcel of land within said Distriot to be assessed . for that portion of the whole oost in the proportion that the area of said lot. or parcel of land. bears to the area of the entire District. exclusive of streets, avenues. alleys and public places. provided, that each square foot of land within said district embraced within any corner lot. or tract (and for the purpose ot assessment in this district a oorner lot is defined as being any tract of land. excepting streets avenues or alleys. located within a distance of 30 feet ot either side line of West College Street within the district) shall be so assessed that each Bfluare foot of the land embraced within any such corner lot, or traot. shall bear double the amount of the co at of such improvement that a square foot of any inside lot, or tract. shall bear. I Section 9. Said ass.ssmen t and taxes shall be payable in six annual installments, with six per cent annual interet on deferred payments. commencing with the year 1928, but this provision shall not be construed to prevent full paymen tat any time. Seotion 10. State of Montana, to be held in said Commission's room in the City Hall of said City of Bozeman. on Friday, the 3rd day of August, 1928 at Four o'clook I P. M.. of said day, are the time and place designated when and where the Commission will hear and pass upon all protests duly and regularly made and tiled against the proposed improvement and the creation of said Special Improvement District, and the extent and character thereot, or of either thereat. Section 11. That the Clerk of said Commission of the City of Bozeman, State of Montana, be and he is hereby directed to give notice as required by law, of the adoption of this Resolution. That the estimate of the total cost and expense of making such improve- ments is $3959.00, that the total area at property in the district to be assessed for the proposed improvement exclusive of streets, avenues, alleys and public places is 370.120 s~uare teet, *hat the estimated cost for each corner lot in said distriot is $0.018084 per square foot and the estimated cost for each inside lot in said district is $0.009042 per square foot, and that Friday, the 3rd day ot August. 1928 at 4 o'clock P. M., and the Commission Chamber of the said City of Bozeman. has been designated as the time when, and the place where, the said Commission will hear and pass upon all protests that may be made against the proposed work or against the extent or creation of the said district to be assessed or both. Such protests, if any, must be in writing, and must be delivered to the Clerk of the Commission within fifteen days after the date qf the first publioa- tion of this notiae. For a description of the boundaries of said proposed Special Improvement District No. 275 reterence is hereby made to Commission Resolution No. 113 declar- ing the intention at said Qommission to create said Special Improvement District, which is now on file in the office of the Clerk of the Commission of the City ot Bozeman.
