DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS SPECIAL IM1~ROVEMENT DISTRICT NO. 274 OF SAID CITY. FOR ,THE I PURPOSE OF GRADING, PAVING WITH WARRENITE-BITULITHIC PAVEMENT; CONSTRUCTING CONCRETE CURBS AND WALKS AND INSTALLING STORM SEWERS ON WILLSON AVENUE NORTH BETWEEN THE NORTH LINE OF WEST KAIBSTREET A1ID THE SOUTH CURB LINE OF WEST MENDENHALL STREET WITHIN SAID CITY AND TO SPECIALLY ASSESS THE ENTIRE COST AND EXPENSE OF ~INGSAID IMPROVEMENTS AGAINST THE LAND WITHIN SAID DISTRICT AS CREATED. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1. That it is hereby declared to be the intention of the Com- Mis sion of the City of Bozeman. state of Montana, to create a S:pecial Improve- ment District to be known and designated as Special Improvement District No. 274 of said City for the purpose of making the im:provements within said Special Improvement District hereinafter described. Seotion 2. That the boundari es of said Special Improvement District No. 274, to be created, are as follows;- Beginning at a point in the north line of West Main Street, said point being 140 feet east of the east line of Willson Avenue North; thence west along the said north line of West Main Street to a ~oint 140 feet west of the west line of said Willson Avenue North; ~hence north parallel with and 140 feet west of said west line of Willson Avenue North to the center line of West Mendenhall Street; Thence east along said center line of West Mendenhall street to a pGint 140 I feet east of the east line of said Willson Avenue North; Thence south parallel with and 140 feet east of said east line of West Mendenhall street to the point of beginning. The assessments against all corner lots, vi.z; Lots 13 and 14 of Block A and Lots 1 and 20 of Block B of Tracy's Addition to Bozeman, to be double that of inside lots. Section 3. That it is hereby declared to be the opinion of said Commission of the City of Bozeman, State of Montana, that all of the land within said proposed Special Improvement District as defined in Section 2 of this Resolu- tion, whether abutting on said improvement or not, will be speoially benefitted by the grading, ~aving, installation of curbs, walks and storm sewer, and all of said improvements and should bear the cost of said improvements in accordance with the laws of the state of Montana in such case ma4e and provided. Section 4. ~hat the charaoter ot the improvement to be made wi thin said Special Improvement District No. 274 is the grading; the paving with Warrenite- Bituli thic Pavement; and the constructing of concrete curbs and walks and install- ing storm sewers on Willson Avenue North between the North line of West Main Street and the south curb line of West Mendenhall Street in said City of Bozeman, Montana. I Section 5. That an approximate estimate of the cost of doing all of the work of oonstructing all of said improvements, including the grading, paving, ourbs. walks, storm sewer, inspection and all incidental expenses, is Eighth Thousand Two Hundred Thirty Two Dollars ($8232.00). .-".- 269 Sect ion 6. That the area of all. corner lots within said proposed district is 15680 square fee~ and the area of all inside lots within said proposed district I is 62720.00 square teet making the total area ot the land in said proposed district to be taxed for the oost of said improvements (exolusive of streets, avenues, alleys and public places) 78400.00 square teet and an approximate estimate ot the cost ot said improvement. to be speoially taxed and assessed against the land therein. is 00.176 per square toot for corner lots and $0.0870 per square foot for inside lots. Section 7. That the entire cost and expense ot making the speoial improvements herein set forth in said Special Improvement Distriot No. 274 shall be paid by Speoial ImprOYement Distriot Coupon Bonds. as authorized by the LaWs of the Stat. of Montana, whioh bonds shall be in the denomination of One Hundred Dollars (tlOO.OO) each. or tractions thereof where necessary, to be issued and chargeable against a fund to be known as "special Improvement District No. 274 Fund", said bonds to be redeemable at the option of the City of Bozeman, Montana, whenever funds are available for that purpose from said Special Improvement Distriot No. 274 Fund. Said bonds shall draw si~l. interest at the rate of six per cent per annum. which interest shall be chargeable as a part ot the oost of I said improvement, and shall run from the date of the registration of. said bonds - until said bonds are paid. Section 8. To pay said bonds, and interest theron, representing the cost of said improvement, special assessment shall be levied against all of the lands within said proposed Speoial Improvement District No. 274 as hereinbefore de- fined, eaoh lot or parcel of land within said District to be assessed for that portion of the whole cost in the proportion that the area of said lot, or paroel of land bears to the area of the entire District. exclusive of streets, avenues. alleys or publio places, provided, that each square foot of the la~d within said district embraced within any oorner lot, or tract (anCl for thepurpose at assess- ment in this district a corner lot is defined as 'being any_tract of land, excepting streets, avenues, or alleys located within a distance of 28 feet of either side line -of Willson Avenue North with the district) shall be so a.ssessed that eaoh square foot ot the land embraoed within any such corner lot, or tract, shall bear double the am.ount of the cost of such improvement that a sqa.ure foot of any inside lot or tract, shall bear. Said assessment and taxes shall be payable in twenty-one annual installments. with six per oent annual interest on deferred payments. com- menoing with the year 1928. but this provision shall not be construed to prevent full payme nt a t any time. ~ 2(70 Section 10. That the regular session of the Commission of the City of Bozeman, Montana, to be held in said Commission's rooa in the City Hall of said 01 ty of Bozeman. on Friday, the 3rd day of August, 1928 at Fo1U' 0 'oloak P. M. ot I said day, are the time and plaoe designated when and where the Commission will hear and pass UpOll all protests duly and regularly made and filed against the proposed improvement and the creation of said Special Improvement District, and the extent and oharaoter thereof, or of either thereof. Seotion 11. That the Clerk of said Commission of the City of Bozeman, State of Montana, be and he is hereby direoted to give notice as required by law, of the adoption of this Resolution. I a Resolution was dul~ passed by said Commission declaring its intention to oreate a Special Improvement District to be known am designated as Speoial Improvement District No. 274 of said City, tor the pUlpose to grading and paving with Warren- 1te-Bitulithic pavement and oonstructing concrete curbs and walks and installing storm sewers on Willson Avenue North between Main and Mendenhall Streets and deolaring it to be the intention of said Commission to speoially assess the entire cost and expense of making suoh improvements against the entire distriot, eaoh lot or parcel of land within such district to be assessed for that part of'the whol.cost which ita area bears to the area of the entire distriot, exclusive of streets, avenues, alleys and public places, provided that eaoh square foot of the land in said district embraced within any corner lot shall bear double the amount of the cost of' such improvement that a square toot ot any inside lot shall bear, a corner lot to be oonsidered as 28 feet in width. That the estimate ot the total cost and expense of making such improve- ments is #8232.00; that the total area of property in the district to be assessed for the proposed improvement exolusive of streets, avenues, alleys and public :plaoes is 78400 square teet, that the estimated cost for eaoh oorner lot in said district is to.175 per square foot and the estimated cost for eaoh inside lot in said district is $0.0875 per 'square foot, and that Friday, the 3rd day o~ August, 1928 at 4 o'olock P. M., and the Commission Chamber of the City of Bozeman, has been designated as the time when, and the plaoe where, the said Commission will hear and pass upon all protests that may be made against the proposed work or against the extent or oreation of the said district to be assess- ed or both. Suoh protests, if any, must be in writing, and must be delivered to the Clerk of the Commission within fifteen days atter the date of the tirwt publication of this notice. For a description of the boundaries of said proposed Special Improvement Distriot No. 274 referenoe is hereby made to Commission Resolution No. 112 declaring :the intention of said Commission to orea te said special improvement distriot, whioh is now on file in the office of the Clerk of the Commission of I the Ca ty of Bozemn, Montana.
