, At a regu-'-.ar session of' the commission of the City of Bozeman,
State of Lontana, held on the lOth day of May,
A. D. 1929, the
said Commission duly
passed Commission IZesolution No. 140
declarinc it to be theentention of said
Commission to create a special improvement district to be known and designated as
Special Imp::"ovement District No. 276 of said City,
for the purpose of paving with
two course crus1.eci gravel macadam pavement,
and installing concrete curbs on south
Seventh Avenue between the south line of :"/est Main street and. the North line of West
Babcock street, all within said city,
and to specially assess the entire cost and
expense of makint,: said improvements against the property wi thin said district under
and by virtue of th'c; provlsionc of Sections 5225 to 5277 inclusive, which said
Commission Resolution No. 140 is hereby referred to and made a part hereof
for
f'urther particulars in respect to tIle boundaries of said distDict,
the est~mated

cost of said improvement and the method of assessing the
sarle against the property
within said district.

duly published in the Bozeman Weekly Chronicle, a weekly newspaper printed and pub-
lished in said City of Bozeman, tQ-wit:

1929, and by

were filed with the Clerk of the Commission no protests against the proposed work
and against the creation and extent of said district to be assessed;
and the said
Commission was in recula::- session on the olst day of May,

at the Corrunission Chamber in the City Hall Building in the said
aity of Bozeman, the same being the time and place designated for hearing and

passing upon all protests, if any,
against the proposed work or acainst the
creation or
extent of said district, or both;
and it further appearing

the proceed.ings for creation of said district have 'been complied with;

Section 1.
That said Special Improvement District No.
276 of the City of
Bozeman, State of l,~ontana, be and the same is hereby created for the purpose of
making the improvements therein as hereinafter described.

Section 2. That
said Special improvements be, and the same are,

ordered to be made in said Special Improvement District ho.

The paving with two course crushed gravel macadam
:pavement and the installation of concrete curbs

on South Seventh Avenue between the SQu'uh line of
West Lain street and the north line of ",'est
:3abcock street, all within said City.
Section 3. That
the entire cost and expense of making the sDecial
improvements herein set forth in said Special Improvement District =~o.
276 shall
be paid by Special Improvement
District Bonds of tlle cLenomina tion of One Fundx'ed
Dollars each,
and in i'rac tions '.7here nece ssary, to be
iss\leci and ctargeable against
a fund to
oe known as Special Improvement District No. 276 Ii'und;
said bonds to be
redeemable at the option of the City of Bozeman, l..ontana,
whenever funds are
available for that purpose from said Special Improvement Distric t lro.
276 Fund;
said bonds shall draw sim;:le interest at the rate of six pel' cent per anmm, 'i'.'hich
shall be chargeable as a part of the cost of said
special improvement anCl stall
run from the date of the regi stra tion of said bonds un til said bond.;,> a1"e paid
and such interest from the date of the refistration of the bonds until the payment
of the first installment, will be collected b;: the Director of }1'inance of said
City of Bozeman at the time of collecting such first installment;
that the entire
cost and expense or said improvement wi thin said dis trict shall be ciefrayed by a

special assessment against the entire district,
eacL lot or parcel of land within
said district wherein the irnprover:lent shaLL be made,

each lineal foot of the Seventh Avenue frontage of such

share of such entire cost;

five years.

That the City Engineer, be, and he is hereby directed to prepare
plans and specifica tions for the d.o ing of said work and making said imp.i:'ovements.
Section 5. That
the Clerk of the Commission be, and he
is hereby directed
to pUblish u. notice inviting proposals for the furnishing of materials,
the do in{"
of the work and making of said improvements in said Special Improvement District
No.
276, referring to plans and specifications on file,
by publishing the same in
two
issues of the Bozeman Daily Chrollicle, a daily newspaper printed and published
in the said City of
Bozeman, not less than ten days before the time
such bids

will be opened,
whicL shall be at a IiH:eting of the Commission to be held on Friday,
the 14th day of June,
1929.
Passed and adopted by the Commission of the City of Bozeman at a regular
session thereof,
held on the 31st day of May, 1929.
Approved by the Mayor on the 31st day of J:~'lay,
1929.
