ASS1!rSSMENT OF TAXES UPON ALL THE PROPERT![ SPECIAL IMPROVEMENT DISTRICT I NO. 275 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE OOST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 275. WHEREAS, The Commission of the City of Bozeman, did on the 13th day of July, A. D., 1928, duly and regularly pass Commission-Resolution No. 113 entitled: "A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZENlAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID C01IMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVE1~NT DISTRICT NO. 275 OF SAID CITY, FOR THE PRUPOSE OF GRADING, PAVING WITH TWO COURSE CRUSH- ED GRAVEL MACADAM PAVE~$NT, AND INSTALLING SUCH CULVERTS AS :MAY BE NECE- SSARY ON WEST COLLEGE ST~ ~E~ THE EAST LINE OF FOURTH A VENUE AND THE EAST LINE OF EIGHTH AVENUE, WITHIN SAID CITY, AND TO SPECIALLY ASSESS THE ENTIRE COST AND EXPENSE OF :M:AKING SAID IMJ?ROVEMENTS AGAINST THE LAND WITHIN SAID DISTRICT AS CREATEDtf. and thereafter, after due and legal proceedings had, the Commission of the City of Bozeman, did, on the 3d day of August, 1928, duly pass Commission Resolution NO. 1.6 enti:bled: tfA RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING SPECIAL IMPROVE1~NT DISTRICT NO. 275 OF THE CITY OF BOZ~~ STATE OF MONTANA, FOR THE PRUPOSE OF GRADING, PAVING WITH TWO COURSE CRUSHED GRAVEL MACADAM PAVEMENT AND CONSTRUCTING SUCH CULVERTS AS MAY BE NECE- SSARY ON WEST COLLEGE STREE!f BETWEEN THE EAST LINE OF FOURTH A VENUE AND THE EAST LINE OF EIGHTH AVENUE-, WITHIN SAID CITY, AND TO SPECIALLY ASSESS THE ENTIRE COST AND EXPENSE OF MAKING SAID IMPROVEMENTS AGAINST THE PROPERTY WITHIN SAID DISTRICT, UNDER AND BY VIRTUE OF THE PROVISIONS OF I SECTIONS 5225 TO 5277 INCLUSIVE OF THE REVISED CODES OF MONTANA, 1921, .AND ANY AMENDMENTS THERETO" whioh Commission Resolutions Nos. 113 and 116, passed as aforesaid, are hereby reterred to and made a part of this Resolution for further particulars in respeot to the boundaries of said district, the oharaoter of the improvements to be oonstructed therein, the estimated cost of said improvements, and the method of assessing the cost against the property within said district; and WHEREAS, said improvements as contemplated in said Commission Resolutions Nos. 113 and 116 have been oonstructed and completed in acoordanoe with the terms and conditions of Commission Resolutions Nos. 113 and 116, and the total cost of said improvements so constructed is the sum of THREE THOUSAND FOUR HUNDRED SEVENTY FOUR DOLLARS AND THIRTY FIVE CENTS ($3,474.35); NOW THEREFORE, Pursuant to the provisions of Seotions 5225 to 5257 and 5485 R C M 1921, and amendments thereto, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMJJIISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Sec. 1. That to defray the cost and expense of constructing and making the I improvements in said Speoial Improvement District No. 275, there be, and there is hereby levied and assessed, a tax amounting to the sum of Three Thousand Four Hundred Seventy Four Dollars and Thirty Five Cents ($3,474.35) upon all the property in said Special Improvement District No. 275; that a particular description of each lot and parcel of land with the n~e of the owner and the sum assessed against him or it for such improvements and the amount of eaoh partial payment to be made and the day when the same shall be delinquent, is set forth in detail in the assessment list hereto attached, marked tfSohedule An and made apart hereof; that the several sums set ~58 opposite the names of the owners and the described lots and parcels of land be, and the same are hereby respectively levied and assessed upon and against said described lots and parcels of land to defray the cost and expense of constructing and making I said improvements within said District; that the several sums so as~es8ed be collect- ed from the respective owners of said lots and parcels of land described in said assessment list Schedule nAn, as required by law; that the payment of said sums shall be made in. six installments and the payment of said installments shall extend over a perioQ of six years; that the payment of the respective annual installments shall be made on or before the 30th day of November of each year until payment of all install- ments together with interest thereon shall be. made; that said sums shall be paid and the oollection thereon shall be made in the manner and in accordance w~th the law governi.ng the collection of special improyement taxes; that failure to pay such assessmen ts when the same become due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by law relative to delin- quent taxes; Sec. 2. That the regular session of the Commission of the City of Bozeman, to be held in the Commission Chamber in the City Hall of said City, on the 14th day of D~oember, 1928, at 4:00 o'clook P M be, and the same is hereby designated as I the time and place at which objections to the final adoption of this Resolution will be heard by the said Commission; Sec. 3. That the clerk of the Commission of the City of Bozeman, be, and he is hereby ordered and directed to publish in the Boarman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a Notice signed by the Clerk of the Commission, and stating that a Resolution levying a special assessment of taxes to defray the cost and expense of constructing and making the improvements in the said Special Improvement District No. 275, is on file in the office of the Clerk of the Commission, subjeot to inspection for a period of five (5) days; that said notice shall state the time and place at which objectionswill be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five (5) days before the day set by the Commission for the hearing of objec- tions and the final adoption of this Resolution. Culverts on West College Street between East Line of Fourth Avenue and East Line ~ighth Avenue, Improvement District No. 275. NOTICE IS HEREBY GIVEN, That at a regular session of the Commission of the City of Bozeman, held on Friday, the 7th day of December, 1928, Commission Resolu- tion No. 136 was duly passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon all the property in Special Improvement District No. 275 of said City, to defray the cost and expense of constructing and making the improvements within said District, to-wit: Grading, Paving with two course crushed gravel macadam pavement, and such culverts as may be necessary on West College street between east line of Fourth Avenue and east line of Eighth Avenue; That said Commission Resolution No. 136 is now on file in the office of the Clerk of the Commission, subject to inspection for a period of five (5) days by any persons interested. That Friday. the 14th day of December, 1928, at 4:00 o'clock P. M. of said day, at the regular session of the said Commission of the City of Bozeman, at the Commission Chamber in the City Hall Building of said City, I has been designated as the time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Resolution No. 136, and the levying of said assessment, and that said Resolution will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 113. declaring it to be the intention of the Commission to create Special Improvement District No. 275, and. Commission Resolution No. 116, creating Special Improvement District No. 275, forconstructing and making the improvements therein. Dated this 7th day of Deoember, A. D., 1928.
