COMMISSION RESOLUTION NO. 130 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 274 IN THE CITY OF BOZID.UN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE I COST OF CONSTR.UCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 274. WHEREAS, The Commission of the City of Bozeman, did, on the 13th day of July, A. D., 1928, duly and regularly pass Commission Resolution No. 112 entitled: "A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT DISTRICT NO. 274 OF SAID CITY, FOR THE PURPOSE OF GRADING, PAVING WITH WARRENITE-BITULITHIC PAVEMENT, CONSTRUCTING CONCIWrE CURBS AND WALKS AND INSTALLING STORM SEWERS ON WILLSON AVENUE NORTH BETWE~ THE NORTH LINE OF WEST MAIN STREE'l' AND THE SOUTH CURB LINE OF WEST MENDENHALL STREET WITHIN SAID CITY, AND TO SPECIALLY ASSESS THE ENTIRE COST AND EXPENSE OF MAKING SAID IMPROVEMENTS AGAINST TIlE LAND WITHIN SAID DISTRICT AS CREATED." and thereafter, after due and legal proceedings had, the Commission of the City of Bozeman, did, on the 3d day of August, 1928, duly pass Commission Resolution No. llf), entitled: "A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING SPECIAL IMPROVEMENT DISTRICT NO. 274 OF THE CITY OF BOZEMAN, STATE OF MONTANA, FOR THE PURPOSE OF GRADING, PAVING WITH WARRENITE-BITHULITHIC PAVEMENT, CONSTRUCTING CONCRETE CURBS AND WALKS AND INSTALLING STORM SEWERS ON WILLSON AVENUE . NORTH BETW~~ THE NORTH LINE OF WEST MAIN STREET AND THE SOUTH CURB LINE OF WEST MENDENHALL STREET WIT RIB SAID CITY, AND TO SPECIALLY ASSESS THE ENTIRE COST AND EXPENSE OF MAKING SAID I IMPROVEME1'TS AGAINST THE PROPERTY WITHIN SAID DISTRICT, UNDER AND BY VIRTUE OF THE ?ROVISIONS OF SECTIONS 5225 TO 5277 INCLU- SIVE, OF THE REVISED CODES OF MONTANA, 1921, AND ANY AMENDI.lIENTS THERETO tf whioh Commission Resolutions Nos. 112 and Ilf), passed as aforesaid, are hereby re- ferred to and made a part of this Resolution for further particulars in respect to the boundaries of said distriot, the oharacter of the improvements to be constrnc- ted therein the estimated cost of said improvements, and the method of assessing the cost against the property within said district; and WHEREAS said improvements as contemplated in said Commission Resolutions Nos. 112 and 110 have been constructed and completed in accordance with the terms and conditions of Commission Resolutions Nos. 112 and 115, and the total cost of said improvements so constructed is the sum of NINE THOUSAND TWO HUNDRED TWENTY SIX DOLLARS AND THREE CENTS ($9,226.03); NOW, THEREFORE, Pursuant to the provisions of Sections 5225 to 5257 and ". 5485 RCM 1921, and amendments thereto, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BO~Uili, STATE OF MONTANA: I Sec. 1. That to defray the cost and expense of constructing and making the improvementw in said Special Improvement District No. 274, there be, and there is hereby levied and assessed, a tax amounting to the sum of Nine Thousand Two Hundred Twenty Six Dollars and Three Cents ($9,226.03) upon all the property in said Special Improvement District No. 274; that a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such improvements and the amount of each partial payment to be made and the day when the ;354 -..-.---.."......-.... ...----.....- same shall be delinquent, is set forth in detail in the assessment list hereto attach- ed, marked Schedule "A" and made a part hereof; that the several sums set opposite the names of the owners and the described lots and parcels of land be, ~nd the same are I hereby respeotively levied and assessed upon and against said described lots and paraels of land to defray the cost and expense of construating and making said improvements within said Distriat; that the several sums so assessed be aoIleoted from the respeotive owners of said lots and parcels of land described in said assess- ment list Schedule "A", as required by law; that the payment of sai4 sums shall be made in twenty one installments and the payment of said installments shall extend over a period of twenty years; that the payment of the respective armual installments shall be made on or before the 30th daw of November of each year until payment of all installments together with interest thereon shall be made; that said sums shall be paid and the oo,llection thereon shall be made in the manner and in aocordance with the law governing the collection of special im;proTement taxes; that failure to pay such assessments when the same become due and payable shall make such perrons and siad lots and parcels of land liable to the penalties provided by law relative to delin- quent taxes; Sec. 2. That the regular session of the Commission of the City of Bozeman, to be held. in the Commission Chambers in the City Hall of said City, on the 14th I day of Deoember, 1928, at 4:00 o'clock P. M. be, and the same is hereby designated as the time and place at which obJecti.ons to the final adoption of this Resolution will be heard by the said Commission; Sec. 3. That the Clerk of the Commission of the City of Bozeman be, and he is hereby ordered and direoted to publish in the Bozeman Daily Chroni.cle, a daily newspaper printed and published in the said City of Bozeman, a. Notice signed by the Clerk of the CommisBL on, and ata ting that a Resolution levying a special assessment of taxes to defray the cost and expense of constructing and making the improvements in the said Special Improvement District No. 274, is on file in the ,office of the Clerk of the Commission, subject to inspection for a period of five (5) days; that said notice shall state the time and place at which.obj~ctions wi})l be heard by the Commission to the final adoption of this Resolution; that it Shall be published at least five (5) days before the day set by the Commission for the h~aring of objeo. tions and the final adoption of this Resolution. Passed and adopted by the Commission of the City of Bozeman at a regular session thereof, held on the 7th day of Deoember, 1928. NOTICE IS HEREBY GIVEN, That at a regular session of the Commission of the City of Bozeman, held on Friday, the 7th day of December, 1928, Commission Resolution No. 135 was duly passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon all the property in Special Improvement District No. 274 of said City, to defray the cost and expense of constructing and making the improvements within said District, to-wit: GraCi ng, paving wi th Warreni te- Bithulithic Pavement, Constructing Concrete Curbs and Walks and Installing Storm Sewers on Willson Avenue North between the North Line of West Main street and the South Curb Line of West Mendenhall Street; That said Commission Reso~ution Io. 135 is now on file in the offioe of the Clerk of the Commission, subject to inspection for a period of five (5) days by any persons interested. That Friday, the 14th day of December, 1928, at 4:00 O'Clock P. M., of said day, at the regular session of the said Commission of the City of Bozeman, at the Commission Chamber in the City Hall Building o' said City, has I been designated as the time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final passage and adop- tion of said Resolution No. 135, and the levying of said assessment, and that said Resolution will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 112, declaring, it to be the intention of the Commission to oreate Special Improvement District No. 274, and Commission Resolution No. 115, creating Special Improvement ~istriet No. 274 for construoting and making the improvements therein.
