'I' Ila t it is hereby declared to be the intention of tl"le Commission of the 8i ty of Bozeman, Sta~e of Montana, to create a Special Irrwrovement Distric~ to be knovm and designated as Special Improvement District ;<0. 280 of said City for the purpose of makint;; the improvements 'wi thin said Special Improvement District hereinafter described. Section 3. That it is hereby declared to be the opinion of said Commission of the City of Bozeman, state of Montana, that all of the land within said proposed SlJecial Improvement District as defined in Section 2 of this Hesolution, will be specially beneli~ted by the grading, jiaving, installa tion o~-' curbs and culverts and all of said improvements, and should bear the cost of said improvements in accordance with the laws of theState of Montana in such case made and provided. Section 4. That the character of the improvement to be made within said Special Improvement Distri8t No. 280 is the grading; the paving with Warrenite- Bituli~hic Pavement; and the installing of concrete curbs and such drainage culverts as may be considered necessary on West Babcock street between the west line 0::' }i~ight Avenue SOli th and the (Ve st City Limi ts in, said C1 t;l of Bozeman, Montana; Section j. That an approximate estimate of the cost of doing all of t.tle I work of constructinf all of said improvements, including the E,rading, paving, curb s, culverts, engineering, inspec tion and all inc idental expense s is Sixteen TllOusand Six Hundred Seventy Four Dollars (j~16674.00) . Section 6. That the entire cost and expense of making the special improve- ments herein set forth in said Special Improvement District No. 280 shall be paid by Special Improvement District Coupon Bonds, as authorized by the Lmvs of the State of l;;ontana, which bonds shall be in the denomination of One Hundred Dollars (~lOO.OO) each, or fractions thereof where necessary, to be issued and chargeable against a fund to be known as "Special Improvement District No. 280 :Fund", said bonds to be redeema;:>>le at the option of tIle City of Bozeman, Montana, whenever funds are available for that purpose frolil said Special Improvement Dis tric t ITa. 280 Fund. Said bonds shall draw simple interest at the rate of six per cent per annum, which interest shall be chargeable as a part of the co st of saiel improvement, and shall r1..m from the date of the registration of said bonds until said bonds are paid. Section 8. To pay said bonds, and interest thereon, repref)entin(~ the cost I of said improvement, a special assessment shall be levied against all of the . lands within said pro]osed Special Improvement District ITo. 280 as hereinbefore defined, each lot or parcel of land with:.ll said District to be assessed for that portion of the whole cost in the proportion that the west Babcock street frontage of said lot, or parcel of land bears to the West Babcock Street frontage of the entire distr:ict, exclusive of' streets, avenues, alleys or public places. I Section 9. Said assessment and tazes shall be payable in twenty-one annual installments, with six per cent annual interest on deferred payments, commencing with the year 1929, but this provision shall not be con strued to prevent full paYE1ent at any time.
