COMMISSION RESOLUTION NO. 166 A RESOLUTION OF .THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMl'ROVEMENT DISTRICT NO. 277 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY TEE COST OF CONSTRUCTING AND MAKING THE IMPHOVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 277. WHEREAS, The Commission of the City of Bozeman,did on the 21st da,y of June, , 1929, duly and regularly Pass Commission Resolution No. 143 entitled: "A RESOLUTION OF THE COMMISSION OF THE CITY 01<' BOZEMJUI, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID cO:W.nSSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT rOBE KNOWN AND DESIGNATED AS SPECIAL IMPROVEJdENT DISTRICT NO. 277 OF SAID CITY, ]!'OR THE PURPOSE OF GRADING; :PAVING WITH TWO COURSE CRUSHED GRAVEL MACADAM. PAVJ!':MI~NT; AND INSTALLING SUCH DRAINAGE STRUCTURES As ~/iAY BE NECESSARY ON 1!'IFTH AVENUE SOUTH BETWEEN THE SOUTH LINE OF WEST KOCH STREET AND THE SOUTH LINE OF WEST DICKERSOJII STREET, WITHIN SAID CITY. AND TO SPECIALLY ASSESS THE ENTIRE COST AND EXPENSE OF MAKING SAID HlJl'ROV1DMENTS AGAINST THE LAND WITHIN SAID DISTRICT AS CREATED," and thereafter, after due and legal proceedings had, the Commission of the City of Bozeman did, on the 12th day of JuJ,.y, 1929, duly pass Commission Resolution No. 147 enti tled: "A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING SPECIALIMl'IWVEMENT DISTIUCT NO. 277 OF THE CITY OF BOZEMAN, STATE OF" MONTANA ,FOR THE I)URPOSE OF. GRADING; PAVING WITH TWO COURSE CRUSHED GRAVEL MACADAM PAVEMENT AND INSTALLING SUCHDR/UNAGE STRUCTURES AS MAY BE NECESSARY ON FIFTH AVENUE SOUTH :aETWEEN THE SOUTH LINE OF WEST KOCH STREET AND THE SOUTH LINE OF WEST DICKERSON STREET, WITHIN SAID CITY, AND TO SPECIALLY ASSESS THE ENTIRE cos'r AND EXJ?ENSE OF MAKING SAID IMPROVEMENTS AGAINST THE PROPERTY WITHIN SAID DISTHICT UNDEH AND BY VIRTUE OF THE PROVISIONS OF SECTIONS 5225 TO 5277 INCLUSIVE, OF THE REVISED CODES OF MONTANA, 1921, AND ANY AMENDMENTS THERETO," which Commission Resolutions Nos. 143 and 147 passed as aforesaid are to and made a part of this Resolution for furtheJ;' particulars in respect to the boundaries of said district, the character of 'the improvements to be constructed therein, the estimated cost of said improv~ments, and the method of assessing the' cost against the property within said district; and WHEREAS, said improvements as contemplated In said Commission Hesolutions Nos. 143 and 147 have been constructed and completed in acco.rdance with the terms and conditions of Commission Resolutions Nos. 143 and 147, and the total cost of said improvements so constructed is the sum of Two Thousand Five Hundred Ninety Four Dollars and Forty Five Cents ($2594.45); NOW, THEREFORE ,p1.u,wuant to the provisions of Se,ctions. 5225 to 5277 and 5485 RCM, 1921, and amendments thereto, BE IT RESOLVED AND IT IS HEREBY ORDEHED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1- That, to defray the cost and expense of constructing and the Improvements in said Special Improvement District No. 277, there be, and there is hereby levied and assessed, a tax amounting to the sum of Two Thousand Five Hundred Ninety Four Dollal'S and Forth Five Cents ($2594.45) upon said Special Improvement District No. 277; that a pa1:'ticular description of eaoh lQt and paroel of land y.rith the name of the owner and the sum I' ,~~- or it for suoh improvements and the amount of each :partial payment to be made and th 'day when the same shall be delinquent is set forth in detail in the assessment list .. hereto attached, marked Schedule "A" and made a part hereof; that the several sums ] set opposite the names of the owners and the described lots and parcels of land be, and the same are hereby respectively levied and assessed upon and against said described lo,ts and parcels of land to defray the cost and expense of constructing and making said improvements within said District: that the several sums so assessed b~ collected from the respective owners of said lots and parcels of land described in said assess~ent list Schedule "An as required by law; that the payment of said sums shall be made in six installments and the payment of said installments shall extend over a period of six yearsj, that the payment of the respeotive annual installments shall be made on or before the :;SOth day of November of each year until payment of all the installments together with the interest thereof shall be madej that said sums shall be paid and the collection thereon shall be made in the manner and in accordance with the law governing the collection of special improvement taxesj that failure to pay such assessments when the same shall become due and ,payable. shall make such persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes j Section 2. That the regular session of the Commission of the City of Bozeman to be held. in the Commission Chamber in the City Hall of said City the 25th day of OctOber, 1929, at 4 ~'clock P. M., be, and. the same is hereby designated as the time and place at which objections to the final hdoption of this HesoluU.on will be heard by the saitl Commission; Section 3. That the Clerk of the Commission of the City of Bozeman be, and he is hereby orderetl and (lirected to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a' notice signed, by the Clerk of the Commission, and stating that a Resolution levying a special assessment of taxes to ,defray the cost and expen(3e of constructing and making improvements in sa,id Special Improvement District No. 277 is on file in the office of the Clerk of the Commission subject to inspection for a period of five (5) daysj that said notice shall state. the time and plact at whieh objections will be heard by the Commission to the final adoption of this Hesolu tionj that it shall be pub- lished at least five (5) days berore the day set by the Commission for the hearing of objections and the final adoption of this Resolution. l Passed and adopted by the Commission of the City of Bozeman at a regular J session thereof, held on the 11th day of October, A. NOTICE IS HEREBY GIVEN, that at !3. regular session of the City of Bozeman, held on Friday the-11th day of October, 1929, Commission Resolutidl No.l66 was,duly passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon all the property in Special Improvement District No. 277 in said City, to defray the cost and expense of construoting and makeing the improvements within said District, to.,.wit: The paving with two course crushed gravel macadam pavement .and -installing such draine.ge structures as may be necessary .;on FlftJ;lAvenueSouth between the South line of West Koch Street and the So~th line of West Dickerson Street; That, said COmmission Resolution No.. 166 fs now on file in the office of the Clerk Of the Commission, subject to inspection fOr a p~riod of five (5) days by any persons interested. That Friday, the 25th day of October, 1929, at 4 P. M., of said day at the regular session of the said Commission of the ~ity of Bozeman, at the Commission Chamber in the City Hall Building of said City, has been desig'na ted as the time and place when a.nd where the said Commission will hear and :pass upon any and all objections that may be made to the final passage and adoption of said Resolution No. 166 and the levying of said assessment, and that said Resolution will be finally passed a.nd adopted at said regular session. All persons interested are referred to Commission Resolution No. 143 declaring it to be the intention of the Commission to create Special Improvement :t;jistrict No. 277, and Commission Resolution No. 147, creating Special Improvement District No. 277 for constructing ano. making the improvements therein.
