WHEREAS, the City Commission of the City of B9zeman, did on the loth day of May, A. D., ~929, duly and regularly pass Commission Resolution No. 140 entitled: "A RESOLUTION OF THE ClCJ:MMISSION OF rrnE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID C0M11ISSION TO CREATE A SPECIAL IJIPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS SPECIAL .' IMPROVEMENT DISTRICT NO. 276 OF SAID CITY, FOR TI-IE PURPOSE OF GRADING, PAVING WITH TWO COURSE CRUSHED GRAVEL MACADAM PAVEMENT, AND INSTALLING CONCRETE CURBS ON SEVENTH AVENUE SOUTH BETWEEN THE SOUTH LINE OF WEST MAIN STREET AND THE NORTH LINE OF WEST BABCOCK STREE'J:, WITHIN SAID CITY, AND TO SPECIALLY ASSESS THE ENTIRE COST AND EXPENSE OF MAKING SAID IMPROVE]!1ENTS AGAHmT THE LAND WITHIN SAID DIST1UCT AS CREATED." and thereafter, after due and legal proceedings had, the Commission of the Bozeman did on the 31st day of May, 1929, duly pass Commission Resolution No. 142 enti tIed: "A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING SPECIAL IMPROVEMENT DISTRICT NO. 276 OF THE CITY OF BOZEMAN, STATE OF MONTANA, FOR THE PURPOSE OF PAVING WITH TWO COURSE CnUSHED GRAVEL M.ACADAM PAVEMENT AND INSTALLING CONCRETE CURBS ON SOUTH SEVENTH AVENUE BETWEEN THE SomH LINE OF WEST MAIN. STREET AND THE NORTH LINE OF WEST BABCOCK STREET, ALL WITHIN SAID CITY, AND TO SPECIAIJLY ASSESS THE ENTIRE COST AND EXPENSE OF MAKING SAID IMPROVEIVJ:ENTS AGAINST THE PROPER'EY WITHIN SAID DISTRICT UNDER AND BY VIRTUE OJ!~ TEE PROVISIONS OF SECTIONS 5225 TO 5277 INCLUSIVE, OF THE REVISED CODES OF MONTANA, 1921, AND ANY AMENDMEN'l'S THERETO," which Commission Resolutions Nos. 140 and 142 passed as aforesaid and hereby re- ferredto and made a part of this Resolution for further.particulars in respect to the boundaries of said district, the ch:uacter of the improvements therein, the estimated cost of said improvements and the method of assessing the cost against the property within said district; and WHEREAS, said improvements as contemplated in said Commission Resolutions Nos. 140 and 142 have been constructed and completed in accordance with the terms and conditions of Commission Resolutions Nos. 140 and 142, and. the total cost of se:id improvements so constructed is the sum of Cne Thousand Two Hundred Eighty Eight Dollars and Eighty Four Cents ($1288.84).; NOW THEREFORE, Pursuant to the provisions of Sections 5225 to 5277 and 5485 RCM, 1921 and amendments thereto, BE IT RESOLVED AND IT IS HEREBY ORm;RED BY THE COMMISSION OF TFm CITY OF 50lEMAN, STATE OF MONTANA: Section 1- That to defray the cost and expense of constructing and the improvements in said Special Improvement District No. 276 there be, and there is hereby levied and assessed a tax amounting to the S11m of One Thousand Two Hundred Eighty Eight Dollars and Eighty Four Cents in said Special Imprdlvement Distriot No. 276; that a particular description of lot and parcel of land wi th the name of the ovmer and the sum a.sse.ssed against him or it for suoh improvements and the amount of each partial payment ~ '.', -------- .,- - ----.- ----..-...-.. and the day when the same sha:J,.1 be delinquent is set forth in detail in the assess- attached, marked Schedule "A" and malie a part hereof: that the several sums set opposite the names of the owners and the described lots and parcel /1 of land be, and the same are hereby respectively levied and assessed upon and I l J against said described lots and parcels of land to defray the cost and expense of constructing and making improvements within said District; that the seITeral SUlI1S so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list, Sche~uilie "A", as requ~red by law; tha t the .pay.ment of said sums shall be made in six installments and the payment of said installments shall extend over a period of six years; that the payment of the respecti ve aJ:mual installments shall be made on or before the 30th day of November of each year until payment of all the installments together with the interest thereof shall be made: that said sums shall be paid and the collection thereon ehal be made in the manner and in accordance with the law governing the collection of special improvement taxes: that failure to pay such assessments when the same shall, becom,e due and payable shall make such persons and said lots and parcels of land liable to the penalties provided bylaw relative to delin9.uent taxes; Section 2. That the regular session of the Commission of the City of Bozeman to be hel~ in the Commission Chamber in the City Hall of said City on the 25th day of October, 1929, at 4 o'clock P. M., be, and. the same is hereby des- iganted as the time and place ~t which objections to the final adoption of this H~solution will be heard by the said Commission; Section 3. That 'the' Clerk of the Commission of the Ci ty of Bozeman be, and he is hereb;y ordered and directed to pUblish in the Bozeman Daily Chronicle, a daily newspaper printed'and p~blished in the sElid City of Eo zeman , a notice signed by the Clerk of the Commission and. 8M-ting that a Resolution levying and assessing a special assessment of. taxes to defray the cost and expense of constructing and' making the improvements in the said Special Imprlbvement District No. 276 is on file in the office of the Clerk of the Commission subject to inspection for a period Of five (5) days; that said notice shall state the time and place ,at which objections will be heard by the Commission to the final adoption of this Resolutio j that it shall be published at least five (Ii) days bef.ore the day set by the Commission for the hearing of objections and the final adoption of this Resolution. NOT I CE - - ....... -, - - HEARING, FINAL ADOPTION RESOLUTION NO. 165 LEVYING ASSESSMENT, GRAVEL PAVEMENT'AND CONCRETE CURBS ON SOUTH SEVENTH AVENUE BETWEEN MAIN AND BABCOCK STREET, IMPROVEMENT DISTRIC'r . NO. 276. NOTICE I::; HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman, held on Friday the 11th day of October, 1929, Commission Resolution No. 165 was duly passed and adopted; that said Commission Hesolution levies and a.ssesses a special assessment of taxes upon all the property in Special Improvemep.t District No. 276 in said City, to defray the cost and expense of constructing and making the improvements within said District, to-wit: The grading, paving with' two course crushed gravel macadam pavement and installing concrete curbs on South Seventh Avenue between the South line of west Main street and the North line of West Babcock Street; That, said Commission Resolution No. 156 is now on 1'ile in the office of Clerk of the Commission, sub'ject to inspection for a period of five (5) days by any p~rsons interested. That Friday the 25th day of October, 1929, at 4 o'clock P. M., of said day, at the regular session of the said Commission of the City of Bozeman at the Commission Chamber in the City Hall Building of said City, has been designated as the time and place when and where the said Commission will hear pass upon any a.nd allopjecti.ons that may be made to the final passage and adoption of said ReQolution No. 165 and the levying of said assessment, and that said Resol- ution will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 140, de- claring it to be the intention of the Commission to create Specia); Improvement District No. 276 and Commission Resolutlon No. 142 creating Special Improvement District No. 276 foroonstructing and making the improvements there'in.
