WHEREAS, the City Council of the City of Bozeman heretofore duly and r(!-

gularly passed Ordinance No. 502, entitled:
"AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW FROM THE SIDEWALKS
IN THE CITY OF BOZEMAN AND REPEALING ORDINANCE NO. 385, ENTITLED:
'AN ORDINANCE PHOVIDING FOR THE REMOVAL OF SNOW. AND ICE, DIRT,
FILTH AND OTHEH OBSTRUCTION FROM SIDEWALKS ON MAIN STREET BET'NEEN
WALLACE AVElI11JE AND FOURTH AVElmE IN THE CITY OF BOZEMAN '," AND
WHEREAS, Paragraph 7, Section 5039, RCM, 1921, provided:
"The city or town council has power to regulate the use of sidewalks,
and to require the owners o-f the premises ad,joining to keep same
free from snow ***; ***and to provide for levying the cost .of
removal as a special tax against the property ***", and
WHEREAS, owners of premises in said City have neglected to remove the snow
from the sidewalks adjoining thereto during the year 1928-29 arid the City of
Bozeman, pursuant to Paragraph 7, Section 5039 and Ordinance No. 502 have removed
the snow from the sidewalks adj.oining the premises of said owners and the total
cost of the removal thereof is chargeable to the property as hereinafter set
forth, pursuant to provisions of said Paragraph 7, Section 5039 Political Code,
RCM, 1921, and said Ordinance No. 502,
NOW, TlmnEFORE, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COlliUdISSION
OF THE CITY OF BOZEMAN j STATE OF 1nNTANA:
Section 1. 'l'hat during the ~ear 1828-29 the City of Bozeman ,has removed
the snow from sidewalks adjoining premises in the City of Bozeman and defrayed the
cost thereof as set forth in Schedule "4Jne" hereto attached and made a part bereof.
Section 2. That to defray the cost of removing said snow from sidewalks
adjoining said premises as set forth in said Schedule "One", hereto , attached and
made a part hereof, for the year 1928-29 there be, and there is hereby levied and
assessed a special tax against said property as set forth in said Schedule "One",
hereto attached and made a part hereof; that a particular description of each lot
and parcel of' land with the name of the owner and the sum assessed against him or
it is set forth in assessment list hereto attached mar-ked Schedule "One", and made
a part hereof; that the several sums set opposite the names of the owners and the
description of the lots and parcels of lands be, and the same are hereby,levied and
assessed upon and against said lots and parcels of land,; that the several sums be
collected from the respective owners of said lots and parcels of lands described
in said assessment list, Schedule "One'l, as required by law; that said. sums shall
be paid and the collection thereof shall be made in the manner and in accordance
with the law governing the collection of special improvement taxes; that failure

to pay suoh assessments when same shall be oome due and payable shall make such
person and suoh lots and paroels of land liable to the penalties provided by the
law relative to delinquent taxes.
Section 3. 'rhat the regular session of the Commission of the City
of Bozema
held on the 25th day of Ootober A. D.; 1929, at the Commission Chamber,
C1 ty Hall
Building, be, and the same is hereby designated as the time and plaoe at which
objeotions to the final adoption of this Resolution will be heard by the Commission.
Seotion 4. That the Clerk of the Commission, be, and he is
hereby ordered
and direated to publish in the Bozeman Daily- Chronicle, a daily newspaper, printed
and published in said City of Bozeman, a notice signed by the Clerk of the Commies!

and stating that a resolution levying a speoial assessment of taxes to defray the
cost of removal of snow from sidewalks ad,joining certain premises in the City of
Bozeman for the year 1928-29 is onifile in the offloeof the Clerk of the Commissio
subjeot to inspection for a period of five (5)
days; that said notice shall state
the time and place at whioh objections will be heard by the Commission to the final
adoption of this Resolution; that it shall be published at least
five days before
the date set by the Commission for hearing of objections, and the final adoption
of this Resolution.

held on the 11th day of October, A. D., 1929.

ASSESSMENT TO DEFRAY THE COST OF

REMOVAL OF SIIOW FROM THE SIDEWALKS
ADJOINING CERTAIN PREMISES IN THE
CITY OF BOZEMAN FOR THE YEAR 1928-29.
NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the
City of Bozeman held on the 11th day of October, A. D.,
1929, CQ~mission Resolution
No. 164 was duly passed and adopted; that said Commission Hesolution No. 164 levies
and assesses a special assessment of taxes upon certain properties in the City of
Bozeman +orthe year 1929 to defray the ,cost of removal of snow for the year 1928-29
That said Commission Resolution No. 164 is now on file in the office of the
Clerk of the Commission of said City of Bozeman subject to inspection of all persons
interested for a period of five (5) days,
by any person interested: that Friday,
the
25th da;y of October, 1929, at 4 o'clock
P. M., of said day at a regular session of
the Commission of the Oi t~r of Bozeman, Commi ssion Chamber,
city Hall Building,
has been designated as the time and place when and where said Commission will hear
and pass, upon any and all objections that may be made to the final passage and
adoption of said Commission Hesolution No. 1?4, and the levying of said assessment:
and t ha t , said Resolution will be finally passed and adopted at said
regular
session of said Commission, subject to such corrections and amendments as may be
made upon objections made and filed within the five days limit as provided by law.
