Final adoption of Ordinance No. 1759, Amendments to Ordinance No. 1726, providing for the amendment of Chapter 2.01 by amending the sections on Financial Disclosure, Post Employment
Prohibitions and Definitions.
MEETING DATE: May 11, 2009
RECOMMENDATION: Give approval to final adoption of Ordinance No. 1759, Amendment to Ordinance No. 1726, revising Chapter
2.01 of said code; providing for the amendment of Chapter 2.01 by amending the sections on Financial Disclosure, Post Employment Prohibitions and Definitions.
BACKGROUND: On April
20, 2009, the City Commission gave provisional approval to Ordinance 1759. On May 11, 2009, you are scheduled to give final approval to this ordinance. Please note several ministerial
changes have been made to the ordinance since provisional adoption. These include the following:
Chpt. 2.01.010 (Declaration of Policy):
Delete the reference to § 2-2-125, MCA as that
provision was repealed in 2001.
Add a reference to § 2-2-121, MCA. The provisions of § 2-2-125, MCA were added to § 2-2-121, MCA in 2001 in an effort to better organize the state ethics
code.
Add a phrase to the end of this Section that indicates if a conflict exists between a provision of the ordinance and state code, the more stringent provision or interpretation
shall apply.
Chpt. 2.01.100 (Financial Disclosure Statements):
(B): add the word “the” before “public servant” in line 2;
(B): change “entity” to “real property” in (5) (2nd to last
line); and
(D): change “should” to “shall.”
Chpt. 2.01.111:
Add caption: “Public Notice Required.”
Add the word “or” in line 5 after “negotiate.”
ALTERNATIVES: As suggested by the
City Commission.
UNRESOLVED ISSUES: None.
FISCAL EFFECTS: There are no direct fiscal impacts related to this ordinance.
