Vil1EREAS, The City Council of the City of Bozeman heretofore duly and
regularly passed Ordinance No. 428 entitled:

WHEREAS, Paragraph 83, Sect ion 5039, ROM,
1921, provides the City or Town
CouIwil has power to declare and determine what v8(;etation within the city or town
shall be noxious weeds, and to provide the manner in which they shall be exterminated,
and to require the owner or owners of any property, wi thin said city or town, to
exterminate or remove noxious weeds from their premises, and the one-half of any
road or street lying next to the lands or boulevard abutting thereon,
and to p rov-ide,
in the event the owner or owners of any of said premises nec;lect to exterminate or
remove the noxious weeds therefrom) for levying the cost of such extermination or
removal as a special assessment against the property, and
\flffiREAS, owners of premises in said City have neglected to exterminate and
remove noxious weeds therefrom during the year 1930 and the City of Bozeman,
pursuant I
to Section 5039 and Ordinance No. 428 have exterminated and reuoved noxious weeds
from premises of said owners and the total cost of the extermination and removal
thereof is chargeable to the ])roperty as hereinafter set forth, pursuant to pro-
visions of said paragraph 83 of Section 5039, Political Code, ROM,
1921, and said
Ordinance No. 428.
BE IT RFSOLVED AND IT IS HEREBY OlIDERED BY '111m COMMISSION OF THE
CITY OF BOZEll/LAN, STATE OF MONTANA:
Sec. 1. That during the year 1930 the City of Bozeman has exterminated
and removed noxious weeds from properties in the City of Bozeman and defrayed the
cost thereof as set forth in sched ule hereto attached and made a part hereof.
Sec. 2. That to defray the cost of extenainating and ren~ving said noxious
weeds from said premises as set forth in said schedule, hereto attached and
made a
part hereof, for the year 1930 there be,
and there is,ereby levied and assessed a
special tax against said property as set forth in said schedule, hereto
attached and
made a part hereof; that a particular description of each lot and parcel of land
with the murre of the owner and the sum assessed against him or it is set forth in

assessment list hereto attached marl\:ed flSchedule One", and made a part hereof; that
the several SUlTIB set opposite the names of the owners and the description of the

lots and parcels of lands be, and the same are lJ.ereby levied and assessed ul~on and II
said lots and parcels of land; that the several sUm.s be collected from the res-
pective owners of said lots and parcels of lands described in said assessment list,

thereof shall be made in the manner and in accordance with the law governing the
collection of special improvement taxes; that failure to pay such assessments when
I same shall become due and payable shall make such person and such lots and parcels
of land liable to the penalties provided by the law relative to delinquent taxes.
Sec. 3. That the regular sess ion of
the Commission of the City of
Bozeman held on the 22nd day of August, A. D.,
1920 , at the Commission Chamber,
City Hall Building, be, and the same is hereby designated
as the time and place at
which objections to the final adoption of this Resolution will be heard by the
Commiss ion.
Sec. 4. That the Clerk of the Commission,
be, and she is hereby ordered
and directed to pUblish in the Bozeman Daily Chronicle,
a daily newspaper printed
and published in the said City of BozaDmn, a notice signed by the Clerk of the
Commission, stating that a resolution levying a special assessment
of taxes to
defray the cost of exteTIninating and removing noxious weeds on certain properties
in the City of Bozer:lan 1'01' the year 1930, is on
file in the office of the Clerk
Of the Commission, subject to inspection for a period
of five days; that said
notice shall state the time and place at which objections
will be heard by the
Commission to the final adoption of this Resolution; that it shall be published
I at least five days before the date set by the Commission for hearing of objections,
and the final adoption of this Resolut ion.
Passed by the Commission of the City of Bozeman at a regular session
thereof held on the 15th day of August, A. D.,
1930 .

that at a regular session of the Conmlission of
the City of Bozeman held on the 15th day of August, A. D.,
1930, Commission Resolution
No. 192 was duly passed and adopted; that said Commission Resolut ion
No. 192 levies
and assesses a special assessment of taxes upon certain properties in the City of
Bozeman for the year 1930, to defray the cost of exterminating and removing noxious
weeds for the year 1930.
That, said
Commission Resolution No. 192 is now on file in the office of
the Clerk of the Commission of said City of Bozeman subject to inspection of all
persons interested for a period of five (5) days, by any person interested; that
Friday the 22nd day of August, 1930, a
t Four 0 'clock P. M., of said day at a
regular session of the Commission of the City of Bozeman, Commission
Chamber, City
Hall Buildin{!;, has been designated as the time and place when and where said
Commission will hear and pass upon any and all objections that may be made to the
final passage and adoption of said Commission Resolution No. 192 and the levying

of said assessment; and that, said Hesolution will be finally passed and. adopted
at
said regular session of said COmDlission, subject to such corrections
and amendments
as may be made upon objections made and filed within the five days limits as pro-
vided by law.
