RELEASE OF BUILDING PERMIT RESTRICTIONS
WHEREAS, the CITY OF BOZEMAN, a Municipal Corporation of the State of Montana, hereinafter
called the "City" entered into an Improvements Agreement for Loyal Garden Subdivision Phase 1B dated
August 14,2007; and
WHEREAS, the City filed a Notice of Building Permit Restrictions on said subdivision,with said document
being filed on October 15,2007,as Document No. 2281623;and
WHEREAS, COVENANT INVESTMENTS, INC., hereinafter called "Subdivider" has complied with
those terms and conditions of said Agreement which necessitated a restriction on building permits;
THEREFORE, the City hereby certifies that the required property pins, sidewalks by owner and curb bulb
aip nring have-been installed-and accepted by-the-City--in-accord with all terms and conditions of said
Improvements Agreement and those items necessitating the Notice of Building Permit Restrictions have
been fully satisfied; and as such Subdivider is hereby fully released from the terms and conditions of the
above-described Agreement which relate to the installation of property pins, sidewalks by owner and curb
bulb painting. The street lights, landscaping, park improvements and private sidewalks shall remain under
financial guarantee until such time the improvements have been installed and accepted by the City in accord
with all the terms and conditions of said Improvements Agreement. However, no occupancy shall be
permitted, of any new structure in Loyal Garden Subdivision Phase 1B, until such time the street lights are
installed and operational.
