RELEASE OF BUILDING PERMIT RESTRICTIONS
WHEREAS, the CITY OF BOZEMAN, a Municipal Corporation of the State of Montana, hereinafter
called the "City" entered into an Improvements Agreement for Loyal Garden Subdivision Phase lA dated
Tune 12. 2007;and
WHEREAS, the City filed a Notice of Building Permit Restrictions on said subdivision, with said document
being filed on Tune 14, 2007,as Document No. 2269348; and
WHEREAS, COVENANT INVESTMENTS, INC., hereinafter called "Subdivider" has complied with
those terms and conditions of said Agreement which necessitated a restriction on building permits;
THEREFORE, the City hereby certifies that the required detention ponds street signage and striping,
subdivider installed sidewalks, lift station, offsite water and sewer, Cottonwood Road improvements
including culverts,road excavation,pit run gravel, cushion ravel asphalt asphalt trail and Cottonwood and
Huffine signal improvements have been installed and accepted by the City in accord with all terms and
conditions of said Improvements Agreement and those items necessitating the Notice of Building Permit
Restrictions have been fully satisfied; and as such Subdivider is hereby fully released from the terms and
conditions of the above-described Agreement which relate to the installation of detention ponds, street
signage and striping, subdivider installed sidewalks, lift station offsite water and sewer, Cottonwood Road
improvements including culverts, road excavation, pit run gravel, cushion gravel asphalt, and Cottonwood
and Huffine signal improvements. The street lights, landscaping, park improvements and private sidewalks
shall remain under financial guarantee until such time the improvements have been installed and accepted by
the City in accord with all the terms and conditions of said Improvements Agreement. However, no
occupancy shall be permitted, of any new structure in Loyal Garden Subdivision Phase 1A, until such time
the street lights are installed and operational.
