A. The meeting was called to order by Chairperson, Bob Hawks, at 10:30 a.m.
B. Approval of Minutes of April 17, 2014 meeting—:42 - Committee member Dodge
motioned to approve the minutes as submitted. Committee member Beeman
seconded. Motion passed unanimously.
C. Approval of Minutes of May 15, 2014 meeting—:55—Committee member Beeman
motioned to approve the minutes as submitted. Committee member Dodge seconded.
Motion passed unanimously.
D. Changes to the Agenda—1:15—Director Overton requested to change a portion of the
TOP updates item H under discussion move to after item F because Mr. Saunders needs
to leave early for another meeting. This would accommodate Chris' update report.

E. Public Comment — 5:50 — Mike Etchingham, 1510 S. Rouse, lives next door to Rouse &
Lincoln, the location of the Bozeman Creek Stormwater project. Project would include
some sort of a pond. Pond becomes an issue in his estimation. Doesn't see a need for a
park in this area and there is no access to it other than driving to it. No trails hooked to
it. Speaking as a neighbor not in favor of this project.
F. Disclosures: 3:18 — Director Overton disclosed that he; Kelly Pohl and Gary Vodehnal
from GVLT; and Brian Heaston from City Engineering met with Bart Manion and his wife
on their property to look at the Lincoln Street right of way and the potential trail
connection from Christie Fields across Bozeman Creek to Burke Park. The Manions were
not in favor of the trail on that portion of their property, even though there is an
existing city right of way. They preferred the perpetual easement on the west edge of
their property. Mr. Manion would be willing to pursue the trail beneath the right of way
that exists for Northwest Energy that runs adjacent to the property. Currently the
Manions have a garage built within the Lincoln Street right of way.
G. Chris Saunders TOP Update — 8:13 — Flanders Mill project is headed to the City
Commission on July 7th. This project incorporates the area of the sports complex. The
project consists of 137 acres and they are purposing 294 home lots. There are two
dedicated parks. This development will have no impact on the sports complex water.
Parks meet 94% of parkland dedication and trail with workout sites will cover the 6% of
dedication. Far in excess of parkland dedication. The trail system hooks into existing
trails. Additional sidewalks will be installed along Durston. Recreation & Parks Advisory
Board is excited about this proposal. East and west connection will connect the
Regional Park to the Sports Park. Ferguson will be extended from Oak to the
roundabout at Baxter.
H. Next step for Bozeman Creek Storm Water Project—24:14— Director Overton informed
the committee about the progress of the Bozeman Creek Storm Water Project.
Application has been reviewed with legal and public works. Public works sees value as a
storm water project. This project is not scheduled and public works has no money
allocated for it. The application requests $107,513 from the storm water utility. No
timeline on when this project would be scheduled. Legal recommends a re-appraisal of
the property with the transfer of developmental rights on the property without the
perpetual easement on the trail. The property purchase in the application requested
$87,800 from the TOP funds for the land acquisition to develop this storm water project.
The appraisal was conducted in 2006 prior to the transfer of developmental rights on
the property. The appraisal is not applicable to the stance of the property now.
Committee member Starner agreed that a new appraisal is a good idea. Staff
recommendation for the TOP committee prior to proceeding with this application is to
recommend a new appraisal from the applicant. Property should be able to be
appraised with the restrictions that the transfer of development right imposes on the

property. Committee member Dodge stated that development of Lincoln Street to code
is a concern for him.
Public Comment: 34:05 — Mr. Etchingham stated that there is no access to this park
unless Lincoln Street happens. The neighbors to the north in Mr. Etchingham's
discussions with them are not likely to give access to their property. The land is locked
in.
35:45 - Committee member Dodge motioned to request a new appraisal on this
property before the TOP Committee proceeds with this proposal, which is consistent
with staff recommendation. Committee member Beeman seconded. Motion passed
unanimously.
I. Discussion
i. TOPs Projects Updates
41:50 - Director Overton gave project updates.
Bozeman Ponds Expansion has been through the master planning process, with
two public meetings with public comment and online comment. The process
utilized the Recreation & Parks Advisory Board Community Master Planning
Committee. The plan was approved by the Recreation & Parks Advisory Board at
their last meeting. Director Overton and Parks & Cemetery Superintendent
White will be meeting with planning to lay out the road map on getting this plan
to the Development Review Committee and then to the City Commission. There
were no major changes to the conceptual plan.
43:00-Trail to the M —Mr. Overton has a message into the Federal Lands Access
Program representative to see how the NEPA process is going.
43:29 - Sports Park— Director Overton is meeting with Bozeman School District
Facilities Superintendent, Todd Swineheart, to talk about connectivity to the
Athletic Complex. Soils analysis and environmental assessment both look good.
Soil analysis has been sent to Tim Stefan to see how the analysis would impact
the cost of the fields. The water rights are adequate until August. There will be

a need for additional water rights from mid-August to October. City Attorney,
Tim Cooper, is working with the seller to try and secure additional water rights or
shares. Work is being done on release of the tax lien and creation of the parcel
by the seller.
47:44—Bozeman Creek Enhancement Project is in a holding pattern. Gary
Weiner met with the one opposing property owner on site and Gary indicated
that the owner was somewhat encouraged but not willing to okay until his wife
has met with Mr. Weiner first. It is too late for construction for this year. If okay
is not given, the project design will be altered and construction would happen
next year. Grants that were applied for are being funded in a positive fashion.
The grantors are being notified that the project design may change.
50:09—Director Overton and two city attorneys met with Maddy Pope, TPL
Project Manager, and TPL's attorney yesterday to start working on the MOU and
to proceed with who does what on this project. The meeting was positive and
productive. Their team will do the first draft and then the city will review it. TPL
wants to do wetland improvements that are not a part of their match that call
for removal of some structures. Two of the structures are in the historic district,
one of which is considered a contributing structure. Regarding improvements to
the park (which is part of their match), is TPL required to follow city purchasing
and procurement policy? TOP's money is to be used for hard scape
improvements such as parking lots, rest rooms, etc.
ii. The next TOP meeting will be held on Wednesday, July 16th at 9:00 a.m.
iii. FYI
52:50- Director Overton briefed the committee on the YMCA and Aquatics
Facility. Mr. Overton and the Bozeman Schools Facilities Superintendent will be

visiting about the new high school and if they plan on having a pool at the new
school. Number one priority is to create an inter-local agreement with the
county permitting the city to build parking on their property to service the
aquatics center and park patrons. Meeting will be held with the Y next week.
The non-compete clause between The Ridge and YMCA limits the amount of
fitness space. There is a four year sunset clause from the date of the building
permit.
1:03:15—The posting for the Trails, Open Space and Parks Manager position
closes tomorrow. The class specification for this job has been changed slightly to
be more of a project, construction manager and have more of a connection with
the new parklands coming. Mr. Overton will be conducting telephone interviews
next week for the Aquatics Manager.
1:06:40—Director Overton met with Chris Naumann to discuss the work on the
Athletics Complex Foundation. Recommendation to Chris Naumann was to raise
$500,000 for the project. The foundation is looking to support athletics city-
wide. They are working on getting their 501 (c) 3 non-profit status.
