HomeMy WebLinkAbout90- Improvements S. 19th Ave. F!!H 122 PACEiGi9 WAIVER OF RIGHT TO PROTEST THE CREATION OF SPECIAL IMPROVEMENT DISTRICTS FOR IMPROVEMENTS EQUAL TO ONE-HALF OF A LOCAL STREET STANDARD, INCLUDING ASPHALT, CURB, GUTTER AND SIDEWALKS, TO SOUTH 19TH AVENUE WE , the undersigned , owners of the real property situated in the County of Gallatin , State of Montana, and more particularly described as follows : Lots 3A-1 and 3A-2 of Minor Subdivision No. 28B, City of Bozeman , Montana, and more commonly known as 1800 West Dickerson , Bozeman , Montana IN CONSIDERATION of receiving Final Site Plan approval for a Minor Site Plan to construct a 5 , 500 square foot office building from the City of Bozeman , along with accompanying rights and privileges and for other and valuable consideration , the receipt of which is hereby acknowledged , hereby agree to waive, for ourselves, our heirs , personal representatives , successors and assigns, the right to protest the creation of one ore more special improvement districts for the improvement of South 19th Avenue, equal to one-half of a local street standard, including asphalt, curb, gutter and sidewalks. The undersigned reserve the right to protest deficiencies in the technical requirements for the creation of special improvement districts contained in MCA Section 7-12- 4101 , et seq , including the manner in which the portion of the total cost of the improvements assessed to the above described property is determined. This waiver shall be a covenant running with the land and shall automatically expire upon either the creation of the special improvement district, or districts , mentioned above, or upon the expiration of seven ( 7 ) years from the date of the execution of this Waiver, whichever occurs first. f l!M 122 PACE1620 2/2 . . .
