HomeMy WebLinkAbout91- Creates SID for the Alley in Block F of Story's Addition WAIVER OF RIGHT TO PROTEST CREATION OF SPECIAL IMPROVEMENT DISTRICTS FOR THE ALLEY IN BLOCK F OF STORY' S ADDITION I , the owner of the real property situated in the County of Gallatin , State of Montana, and described as follows : Lots 6 , 7 , and 8 of Block F , Story ' s Addition in the City of Bozeman , Montana, and more commonly known as 720 West Main Street. IN CONSIDERATION of receiving conditional approval of a Minor Site Plan Application to construct a 3, 690 square foot addition to accomodate the retail sale of flowers, along with the accompanying rights and privileges and for other and valuable consideration , the receipt of which is hereby acknowledged , and in recognition of the traffic impacts that will be generated by the development of the above described property, have waived and do hereby waive the right to protest the creation of one or more special improvement districts for alley improvements consisting of one-half ( 112 ) of a City Alley Standard including surfacing and drainage , to the pro- rated share of the alley located in Block F of Story ' s Addition , or to make any written protest against the proposed work or against the extent or creation of the district to be assessed in response to a duly passed resolution of intention to create one or more special improvement districts which would include the above described property . This waiver shall be a covenant running with the land and shall not expire. I warrant that I am the legal owner of the real property described above and have a lawful right to convey the property or any part of it. The terms , covenants , and provisions of this waiver shall extend to and be binding upon the heirs , executors , administrators, 1 personal representatives , successors and assigns of the parties hereto.
