HomeMy WebLinkAbout91- Creates SID for South Tracy Avenue am U ACE2044 WAIVER OF RIGHT TO PROTEST CREATION OF SPECIAL IMPROVEMENT DISTRICTS FOR SOUTH TRACY AVENUE I , Doug Hoxsey , the authorized representative for Marguerite Christensen , owner of the real property situated in Bozeman , County of Gallatin , State of Montana, and described as follows: Lot 2 of Block 1 , Thompson ' s 4th Addition . IN CONSIDERATION of receiving conditional approval of a Minor Site Plan Application to construct a 3 unit condominium structure, along with the accompanying rights and privileges and for other and valuable consideration , the receipt of which is hereby acknowledged , and in recognition of the traffic impacts that will be generated by the development of the above described property, have waived and do hereby waive the right to protest the creation of one or more special improvement districts for street improvements consisting of one-half ( 112 ) of a City Standard Street, including any curb, gutter, and storm drainage improvements , to the pro-rated share of South Tracy Avenue located adjacent to Lot 2 of Block 1 , Thompson ' s 4th Addition , or to make any written protest against the proposed work or against the extent or creation of the district to be assessed in response to a duly passed resolution of intention to create one or more special improvement districts which would include the above described property. This waiver shall be a covenant running with the land and shall not expire. I warrant that I lawfully represent the legal owner of the real property described above who has a lawful right to convey the property or any part of it, and that I am authorized to execute this waiver on her behalf. The terms , covenants, and provisions of this waiver shall FILM 122 FAU2045 extend to and be binding upon the heirs, executors , administrators , personal representatives , successors and assigns of the parties hereto.
