Action Items 1. 06:04:50 PM Resolution 4545, Submitting to the Electors of the City the questions of (I) issuing General Obligation Bonds in the amount of up to Twenty-Three Million, Eight Hundred Thousand Dollars ($23,800,000.00) for the purpose of Paying the Costs of Designing, Constructing, Equipping and Furnishing on Land at the corner of East Oak Street and North Rouse Avenue or other suitable location a New Facility to House the Bozeman Police Department, Municipal Courts and Other Criminal Justice Services and for paying costs related to associated Site Improvements and the Sale and Issuance of the Bonds; and (II) Permanently Increasing Mill Levies of the City to Pay the Costs of Operating, Maintaining and Repairing Such Facility (Rosenberry)  06:04:58 PM Staff Presentation Administrative Services Director Anna Rosenberry gave the staff presentation for Resolution 4545, Submitting to the Electors of the City the questions of (I) issuing General Obligation Bonds in the amount of up to Twenty-Three Million, Eight Hundred Thousand Dollars ($23,800,000.00) for the purpose of Paying the Costs of Designing, Constructing, Equipping and Furnishing on Land at the corner of East Oak Street and North Rouse Avenue or other suitable location a New Facility to House the Bozeman Police Department, Municipal Courts and Other Criminal Justice Services and for paying costs related to associated Site Improvements and the Sale and Issuance of the Bonds; and (II) Permanently Increasing Mill Levies of the City to Pay the Costs of Operating, Maintaining and Repairing Such Facility. 06:13:07 PM Commission Questions for Staff The Commission and staff discussed public education efforts, timing of mail out ballots, operation and maintenance, County efforts, the first group meeting that is planned, clarity of the mill levy, binding future commissions, bond council suggestions, taking out the word criminal and stating justice services instead in the language, creation of a special fund in the event that there is money left over and locations. 06:43:10 PM Public Comment Mayor Krauss opened public comment. Commissioner - I-Ho Pomeroy: Motion Deputy Mayor - Carson Taylor: 2nd 06:44:56 PM Friendly amendment Cr. Mehl posed a friendly amendment. Cr. Pomeroy and Deputy Mayor Taylor agreed to the amendment. to drop the word “Criminal” from the motion and also the word “Criminal” where is appears between the words “other” and “justice” in both the bond language and the mill levy language. 06:45:28 PM Commission Discussion on the Motion Deputy Mayor Taylor wondered if the Commission should change the suitable location language. The time has come for the City to create a new facility as the current Police Department is crowded. We have been talking about this for a long time. It makes sense to move the municipal court system as well. By adding the mill levy the way we have makes sense because it shows how we are going to pay for the building of it and maintenance. 06:48:52 PM Friendly amendment Cr. Mehl posed a friendly amendment. Cr. Pomeroy and Deputy Mayor Taylor agreed to the amendment. that any of the mills if approved by the public be segregated into a separate fund as discussed. (A sentence will be added to the resolution to clarify the intent within Section 1.06 Mill levy) 06:50:44 PM Amendment to the Main Motion to insert additional language into the language that exists now for the bond that describes the costs to the tax payer, $100,000 $200,000 and $275,000 representing the two required by state law and the current median housing price. Commissioner - Chris Mehl: Motion Deputy Mayor - Carson Taylor: 2nd 06:51:26 PM Cr. Mehl spoke regarding the need for full transparency. We are putting all of our cards on the table for the public. Commission Discussion on the Motion 7 Bozeman City Commission Minutes, July 28, 2014 Page 5 of 15 Deputy Mayor Taylor stated that we are trying to give people the worst scenario cost wise, showing that this is the most that will be paid. It is an important message to give to people so they know where they are at however emphasizing that costs may go down depending on growth. The simpler it is the better it is. Mayor Krauss feels that it grossly over estimates the cost over the bond. We are painting the diarist circumstance. To say that over the next 20 years you will pay x, will not be true. We are erroring on too conservative and too optimistic. He feels it is not our best knowledge to define. To the best of our knowledge we have a trend, concerns of flat lining. The current value is not going to be what it is in 20 years. Cr. Pomeroy stated that transparency is better. Keep it simpler. 07:24:13 PM Clarification of Amendment to the Main Motion that with Staff’s help we would add language at the end of the bond ballot language that would be similar to what is at the end of the Mill levy stating “if this bond is passed it is estimated that the initial cost for a median Bozeman household ($275,000) tax will increase by $72 per year (or whatever). Cottonwood will be a busy street. Will look artful and create a greenway. Commission Discussion on the Motion Cr. Andrus stated that she understands the issues and many busy roads in Bozeman do not have this. It does not comply with our design standards. She will not be supporting this motion. Cr. Mehl stated that there is not the same topography everywhere. He prefers to see grass and trees. He does not feel there is a public safety issue. Cr. Pomeroy stated that is a good idea to protect from the noise and privacy. Mayor Krauss stated that he does not think 19th should look like 19th to Durston as an example. It appears to isolate the street entirely. Commissioner - Cynthia Andrus: Motion Commissioner - Chris Mehl: 2nd 08:14:38 PMCr. Andrus stated that this looks like deferred maintenance. She will be supporting the motion. Commission discussion on the Motion Cr. Mehl stated that it is unfortunate to get to this point. Mayor Krauss stated that we intended to have sidewalks in these subdivisions. They want to route the gas line up north but there is not a mechanism in place. Northwestern Energy is compromising with the City on this issue. Commissioner - Chris Mehl: Motion Commissioner - I-Ho Pomeroy: 2nd 08:54:19 PM Cr. Mehl clarified that this motion is for option 2. He is satisfied that we have not fully resolved relocation. We are meant to take some of that on. Commission Discussion on the Motion Mayor Krauss spoke regarding expectations. Establishing expectations on both sides will be good. Deputy Mayor Taylor stated that he appreciates collaboration between staff and Northwestern energy. If this bond proposition is passed, it is estimated that, using current assessed value of taxable property in the City, for a 20-year bond issued in the full authorized principal amount, and bearing interest at an estimated average annual interest rate of 4.25%, property taxes on a home with a current assessed value of $275,000, the current median value in Bozeman, will increase by approximately $71.89 per year. Mehl stated that we need this facility. We moved into the Law and Justice center 20 years ago and the population was at 24,000 and now we are almost at 40,000. Calls for service are up, population is up and the court work is up. One of our core responsibilities is to buy a larger facility. This provides service to the public and those that work there. We have been considering this since the late1990s. Need and why have been established. A specific design is in place. It is a well designed building and great location. He spoke regarding the discussion about why not with the county. There is a need to be ready to explain this. The county is on a different timeline and need schedule than the city.
