HomeMy WebLinkAboutMDT Nelson Road Site Plan and CoA Exemption_91 REPORT TO: Honorable Mayor & City Commission FROM: Brian Krueger, Development Review Manager Wendy Thomas, Director of Community Development SUBJECT: MDT Nelson Road Site Plan and Certificate of Appropriateness Agency Exemption, Application P14038 MEETING DATE: August 11, 2014 AGENDA ITEM TYPE: Other Public Hearing RECOMMENDATION: The City Commission shall receive the site plan and conduct a public hearing on the exemptions claimed under M.C.A. Section 76-2-402. (Other than conducting a public hearing, no official motion is required by the City Commission). BACKGROUND: The Montana Department of Transportation (MDT) submitted a site plan and certificate of appropriateness application to the Department of Community Development to allow the construction of a new administration office, shop, and storage buildings with associated parking and related site improvements, on the northeast corner of Frontage Road and Nelson Road, and within the Frontage Road Class I, Entryway Corridor. Montana law (M.C.A. Section 76-2-402) addresses the relationship of municipal (City of Bozeman) zoning regulations to other government agencies’ use of land (State of Montana, Gallatin County, Bozeman School District, etc.). The law requires a public hearing whenever land is to be used contrary to the zoning regulations. The statute expressly provides that a municipality “shall have no power to deny the proposed use but shall act only to allow a public forum for comment on the proposed use.” In this instance, the Montana Department of Transportation’s use of the land will not be contrary to the existing PLI, Public Lands and Institutions zoning designation. However, the proposed development is asking for an exemption to the City’s zoning regulations. The applicant claims an exemption from the Bozeman Municipal Code, Landscaping; Section 38.26.050.C.2.e. to allow unbroken rows of parking to exceed a maximum of 100 feet without a landscaped area. The exemption has been noticed by posting on site and by first class mail to property owners within 200 feet of the subject site. UNRESOLVED ISSUES: None determined at this time. ALTERNATIVES: None. Commission Memorandum 180 2 FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues from new development, along with increased costs to deliver municipal services to the property. As discussed in the meeting last night, I am formally requesting the project receive a State exemption from Section 38.26.050.C.2.e BMC requirement for landscaping within parking lots. Please forward this through the review and hearing process. Please coordinate with Matt Faure an hearing times and locations. MCA 17-7 Part 2 requires the project be designed and constructed in conformance with Montana‘s High-performance Building Standards and A/E’s minimum Design Standards. They can be reviewed at http://architecture.mt.gov/HighPerformanceBuilding/default.mcpx At this time I do not see any conflict with Bozeman’s site requirements. Let me know if you have any concerns. Please coordinate with Kim Janzen, MDT regarding the MOU between Bozeman and MDT regarding the future pedestrian/bike path.
