MAINTENANCE COVENANT //
THIS COVENANT is made and entered into this Z6 day of
oC-ro P:R , 1990 , by Mike Hall , 2520 Spring Creek Drive,
Bozeman, Montana, hereinafter referred to as the "Developer" .
WHEREAS, the Developer has been granted conditional approval
of a Minor Site Plan and variances allowing the construction of a
6 , 837 square foot professional office building on property
identified as Lot 1 , Block 2 , University Square Subdivision , City
of Bozeman , and more commonly referred to as being the property on
the southwest corner of the intersection of South 20th Avenue and
West Dickerson Street, Bozeman , Montana; and
WHEREAS, that a condition of said approval is that the
Developer assure that the landscaped open space on the area of
property east of the stream on the above-described parcel be kept
free of weeds and maintained in a green and healthy manner.
NOW, THEREFORE , in consideration of the conditional aproval
of the above-described Minor Site Plan and Variance , the Developer
hereby covenants as follows :
That the Developer will cause to ensure that the
landscaped open space on the property east of the stream
be kept free of weeds and maintained in a green and
healthy manner, that the property is maintained with
regular weeding , mowing of grass , irrigating ,
fertilizing, pruning , and other maintenance of all
plantings as needed, and that any plant that dies shall
be replaced with another living plant that complies with
the approved landscape plan.
This shall be a covenant running with the land and shall be
binding upon all respective heirs , successors and assigns.

Public for the State of Montana, personally appeared Mike Hall ,
known to me to be the person who signed the foregoing Maintenance
Covenant and acknowledged to me that he executed the same.
