WAIVER OF RIGHT TO PROTEST THE CREATION OF
SPECIAL IMPROVEMENT DISTRICTS FOR SIGNALIZATION
AT THE INTERSECTION OF EAST MAIN STREET AND
HIGHLAND BOULEVARD, NOT TO EXCEED $3 , 000. 00
I , the undersigned , Harry C. Huntsinger, owner of the real
property situated in the County of Gallatin , State of Montana, and
more particularly described as follows :
Tract 5-A , C .O. S . No. C-23-R, City of Bozeman , Montana
more commonly known as "The Store" , 1210 East Main Street
IN CONSIDERATION of receiving Final Site Plan approval for a
Conditional Use Permit to allow the expansion of an existing food
convenience store and addition of two gas pumps on the property
described above from the City of Bozeman , along with accompanying
rights and privileges and for other and valuable consideration , the
receipt of which is hereby acknowledged , and in recognition of the
traffic that will be generated by the building expansion on the
above-described property , have waived and do hereby for myself , my
heirs, personal representatives, successors and assigns, the right
to protest the creation of one or more special improvement
districts for signal ization at the intersection of East Main Street
and Highland Boulevard or to make any written protest against the
proposed work or against the extent or creation of the district to
be assessed in response to a duly passed resolution of intention
to create one or more special improvement districts which would
include the above-described property.
If an SID is created , the property owner will only be assessed
his fair and proportional share of the cost of signalization , and
that his cost shall not exceed $3 , 000 . This base figure shall be
adjusted yearly according to the Consumer Price Index (CPI ) .
This waiver shall be in effect for a period of not more than
seven ( 7 ) years from the date of signing of this document, and
shall be a covenant running with the land for that period.
I warrant that I am lawfully seized and possessed of the real
property described above and that they have a lawful right to
convey the property or any part of it.
