HOLD HARMLESS AGREEMENT
THIS COVENANT is entered into on this day of
o(,-roar Z , 1990 by Mike Hall , 2520 Spring Creek Drive,
Bozeman , Montana, for the purpose of meeting conditions imposed for
the approval of a Minor Site Plan and variance applications granted
by the City of Bozeman allowing the construction of a 6 , 837 square
foot professional office building on Lot 1 , Block 2 , University
Square Subdivision , City of Bozeman , with said property being more
commonly identified as being the property on the southwest corner
of the intersection of South 20th Avenue and West Dickerson Street,
Bozeman , Montana.
Mr. Hall hereby covenants and agrees that in consideration of
receiving a three-foot encroachment into the City' s sanitary sewer
easement, he shall maintain the soil surface of said easement in
an undisturbed and unencumbered state to ensure year-round access
by the City to the manhole on the site, and shall hold the City
harmless for any damage which might be incurred in gaining access
to said manhole. Mr . Hall further agrees to maintain the easement,
free from weeds and in a green and healthy manner.
This shall be a covenant running with the land and shall be
binding upon all respective heirs, successors and assigns.
