SUBJECT: Approve request for Cash in Lieu of Parkland Dedication for the Dixson
Multi-household Conditional Use Permit, File Z13273.

RECOMMENDATION: The City Commission approves the request for cash donation in-lieu
of land dedication for the Dixson Multi-household Conditional Use Permit, Application Z13273.
SUGGESTED MOTION: Should the Commission remove this from the consent agenda we recommend the following motion: “Having considered information provided by staff, considered
public comment, and considered all of the information presented, I hereby adopt the findings
included in the staff memorandum for application Z13273 and accept the provision of
$10,430.40 cash in lieu as meeting the required parkland dedication.”
BACKGROUND: The property owner, Dixson Properties PO Box 6099, Bozeman, MT 59771 and representative Van Bryan Studio Architects 21 W. Babcock Street Bozeman, MT 59715 made application to allow two apartment buildings, five dwelling units each, to include
residential uses on the ground floor, which is a conditional use in the B-2, Community Business
zoning district on two lots located at the southeast corner of Equestrian Lane and Gallatin Green
Boulevard, Application Z13273
On March 17, 2014 the Commission approved the conditional use permit, unanimously. Code
Provision “D” cited Section 38.27.020, BMC, for parkland and open space requirements. This
code provision stated the application does require a contribution of park area (parkland) by any
combination of land dedication, cash donation in-lieu of land dedication, or an alternative
authorized by Section 38.27.100. This provision must be reviewed and approved and must be approved prior to final plan approval. Cash-in-lieu of land dedication is the preferred alternative
to meet this requirement. Use of cash-in-lieu requires further review and approval by the City
Commission.
The ten additional dwellings require parkland dedication, cash in-lieu of parkland dedication, or
a combination of cash in-lieu and park land dedication. It is the expressed preference of the developer to provide cash in-lieu of parkland dedication. Pursuant to Section 38.27.030.C,
BMC, the Applicant provided the necessary appraisal documentation to establish the fair market
value for the equivalent land dedication. Required parkland dedication is equal to .3 acres.

The Recreation and Parks Advisory Board Subdivision Committee reviewed the request on July
11, 2014 and recommended approval of the cash in lieu. Baxter Meadows City Parks and the
County Regional Park are in close proximity to the subject property.
UNRESOLVED ISSUE(S): None at this time. ALTERNATIVES: As suggested by the Commission.
FISCAL EFFECTS: Per the attached appraisal, the anticipated payment for cash in lieu of
parkland dedication for ten dwellings at 0.03 acres per dwelling requires 0.3 acres of total parkland. Therefore, the cash in-lieu for this project is $10,430.40.
