Minutes – July 14, 2014 Consider the motion: I move to approve the minutes of July 14, 2014 as submitted. E. Consent 1. Authorize Payment of Accounts Payable Claims (LaMeres) 2. Professional Services Agreement with Alsco Inc. for Entry Rugs for multiple City Buildings (Goehrung) 3. Professional Services Agreement with Montana Building Maintenance, Inc., for Janitorial cleaning of multiple City Buildings (Goehrung) 4. Professional Services Agreement with Dust Bunnies Inc. for Janitorial cleaning of multiple City Buildings (Goehrung) 5. Professional Services Agreement with High Tech Coatings, Inc. for Parking Lot Maintenance at multiple City Parking Lots (Goehrung) 6. Professional Services Term Contract with Bureau Veritas for Building Inspection Services (Thomas) 7. Emerson Arts and Cultural Center Letter of Support from the City to the Montana Cultural Trust Fund to continue the Schools in the Gallery program (Thomas) 10. Final Adoption of Ordinance 1894 authorizing the City Manager to execute the Land Exchange Conveyance Agreement, Granting of an 4 Bozeman City Commission Agenda, July 28, 2014 Page 2 of 4 Easement, and Leaseback between the Montana Department of Transportation (MDT) and the City of Bozeman for City Property located on Nelson and Frontage Roads and MDT property on Rouse Avenue (Winn) 11. Final Adoption of Ordinance 1895 approving the Cannery District Zone Map Amendment to rezone approximately 7.77-acres from PLI (Public Lands and Institutions District) and M-1 (Light Manufacturing District) to B-2 (Community Business District) located generally northwest of the intersection of East Oak Street and North Rouse Avenue, Application Z14072 (Krueger) Consider the motion: I move to approve Consent Items E. 1-11 as submitted. F. Public Comment - Please state your name and address in an audible tone of voice for the record. This is the time for individuals to comment on matters falling within the purview of the Bozeman City Commission. There will also be an opportunity in conjunction with each agenda item for comments pertaining to that item. Please limit your comments to three minutes. G. Action Items 1. Valley West Subdivision Planned Unit Development Conditional Use Permit to allow a relaxation to Section 38.28.050.L of the Bozeman Municipal Code to allow a greater landscaping slope for proposed berms 5 Bozeman City Commission Agenda, July 28, 2014 Page 3 of 4 to be constructed in open spaces east of Cottonwood Road between Bembrick Street and West Babcock Street, Application Z14111 (Quasi- Judicial) (Krueger) Consider the motion: Having reviewed and considered the application materials, public comment, and all information presented, I hereby adopt the findings presented in the staff report for application Z14111 and move to approve the conditional use permit with conditions and subject to all applicable code provisions. 3. Resolution 4540, Ordering installation of sidewalks along portions of streets in and along Baxter Meadows and Cattail Creek Subdivisions (Kerr) Consider the motion: Having conducted a public hearing I hereby move to approve Resolution 4540, ordering installation of sidewalks along portions of streets in and along Baxter Meadows and Cattail Creek Subdivisions. 4. Essential Services Bozeman Municipal Code Amendment to revise Essential Services Type 1 and II, to add a new definition for Essential Services Type III, to apply Essential Services in the authorized use tables of all zoning districts, to amend the code to allow some Essential Services Type II to be reviewed as sketch plans, to amend the code to allow Essential Services Type I and II to encroach within required yards when within a utility easement; and to create a new Section 38.22.230 Essential Services to establish special standards applicable to Essential Services Types I, II and III, Application Z14120 (Saunders) Consider the motion: Having reviewed and considered the application materials, public comment, recommendation of the Zoning Commission, and all the information presented, I hereby adopt the findings presented in the staff report for application Z-14120 and move to provisionally adopt Ordinance 1893 the Essential Services text amendment. 5. Discussion and Direction regarding Potential Changes to the Maximum Assessment Square Footage for Street and Tree Maintenance Amounts (Rosenberry) Consider the motion: I move to direct staff to advertise Street and Tree Maintenance Assessments to include the proposed changes to existing Maximum Assessment amounts. 6. Reappointment to the Board of Ethics (Brunckhorst) Consider the motion: I move to reappoint Chris Carraway to the Board of Ethics. 7. Reappointment to the South Bozeman Technology District Board (Brunckhorst) 6 Bozeman City Commission Agenda, July 28, 2014 Page 4 of 4 Consider the motion: I move to confirm the Mayoral reappointment of Steve Johnson to the South Bozeman Technology District Board.
