Proposals will be received for the Story Mill Ecological Restoration Project. Specifications and other Contract Documents were prepared by RESPEC, Inc., 3810 Valley Commons Drive, #4, Bozeman, MT 59718. Proposals shall be emailed and submitted on the “BID PROPOSAL FORMS” provided with the Contract Documents prior to the bid opening. Late bids will not be opened or acknowledged. Bids shall be emailed to mike.rotar@respec.com. No hardcopy, oral, or faxed bids will be accepted. Bids must be signed by an officer or a person duly authorized to sign bids. Bid security deposits should be submitted in hardcopy, but can be post marked by July 7, 2014. Include a scan of the bid security deposit in the electronic proposal submittal. Proposals will be received from Contractors for the work as defined in the Construction Documents (Construction Drawings and Project Manual). A pre-bid walkthrough of the project will be held at 10 a.m. on June 20, 2014 at the project site. All contractors and bidders are strongly encouraged to attend. Please meet at the driveway located on the south side of Griffin Drive, immediately west of the East Gallatin River bridge. Obtaining Contract Documents: Bid documents were provided individually to four contractors via email. Contact Mike Rotar if another electronic copy of the bid documents are needed. (mike.rotar@respec.com) Proposal Guarantee No Bidder may withdraw their bid for a period of thirty (30) consecutive days from the date of opening of the bids. Bids shall be accompanied by an acceptable form of Bid Security in the amount of 10% of the total Bid. END OF INVITATION TO BID The Trust for Public Land - Story Mill Ecological Restoration Project INSTRUCTIONS TO BIDDERS RESPEC, Inc. 1 INSTRUCTIONS TO BIDDERS 1 DESCRIPTION 1.1 The Contract Documents cover the debris removal, earthwork, channel stabilization, planting and seeding scope of work for the: Story Mill Ecological Restoration Project, Bozeman, Montana. The bids are to be broken down by North, South, and Triangle Parcels and by Phase. Phase 1 includes the South and Triangle Parcels and Phase 2 includes the North Parcel. Phase 1 will be constructed in late summer/fall 2014 with the collection and planting of willow cuttings occurring in April 2015. Phase 2 will be constructed no earlier than July 2015 with the planting of willow cuttings occurring in April 2016. 2 DEFINITIONS 2.1 Bidding Documents, which include the Invitation to Bid, Instructions to Bidders, the Bid Proposal Form, other sample bidding and contract forms, and proposed Contract Documents including any addenda issued prior to bid opening. 2.2 An Addendum is a written or graphic instrument issued by the Designer or Engineer prior to the execution of the Contract, which modify or interpret the Bidding Documents by addition, deletion, and clarification of correction. 2.3 A Bid is a complete and properly signed proposal to do the Work or designated portion thereof for the sum stipulated therein supported by data called for by the Bidding Documents 2.4 A Base Bid is the sum stated in the Bid for which the Bidder offers to perform the Work described 2.5 A Bidder is one who submits a Bid for a contract for the Work described in the Contract Documents. 2.6 The Owner is The Trust for Public Land. 2.7 The Designer is RESPEC, Inc. 3 BIDDERS REPRESENTATION 3.1 Each Bidder by making his/her bid represents that: a He/she has read and understands the Bidding Documents and his/her Bid is made in accordance therewith. His/her Bid is based upon the materials described in the Bidding Documents without exception. 4 BIDDING DOCUMENTS 4.1 This is a limited solicitation bid. Bid documents have been individually provided to 4 selected contractors. The Trust for Public Land - Story Mill Ecological Restoration Project INSTRUCTIONS TO BIDDERS RESPEC, Inc. 2 5 INTERPRETATION OR CORRECTION OF BIDDING DOCUMENTS 5.1 Bidders shall promptly notify the Designer of any ambiguity, inconsistency, or error that they may discover upon examination of the Bidding Documents or the site and local conditions. 5.2 Bidders requiring clarification or interpretation of the Bidding Documents shall make written request to the Designer, to reach him/her at least seven (7) days prior to bid opening date. 5.3 Any interpretation, correction or change of the Bidding Documents will be made by Addendum. Interpretations, corrections, or changes of the Bidding Documents made in any other manner will not be binding. 5.4 Addenda will be emailed to all who have been issued complete sets of Bidding Documents by the Designer. 5.5 Each Bidder shall ascertain prior to submitting his or her Bid that they have received all Addenda. The Bidder shall acknowledge this receipt on the Bid Proposal Form. 6 SUBSTITUTIONS 6.1 The materials, products and equipment described in the Bidding Documents establish a standard of required function, dimension, appearance and quality to be met by any proposed substitution. 6.2 No substitution will be considered prior to receipt of the Bids unless written request for approval has been received by the Designer via email no later than 4 p.m. local time, ten (10) days prior to bid. Each such request shall include the name of the material or equipment for which it is to be substituted and a complete description of the proposed substitute including drawings, cuts, performance and test data, and any other information necessary for an evaluation. The burden of proof of the merit of the proposed substitution is upon the Bidder. The Designer’s decision of approval or disapproval of a proposed substitution shall be final. 6.3 If the Designer approves any proposed substitution prior to receipt of the Bids, such approval will be set forth in an Addendum. Bidders shall not rely upon approvals in any other manner. 6.4 No substitutions will be considered after Contract award unless specifically provided in the Contract Documents. 7 BID FORM 7.1 Bids shall be submitted on the BID PROPOSAL FORM provided in the bid documents without additions not called for or unauthorized conditional or supplementary bids. a All blank spaces provided on the proposal form shall be filled in. In addition, the contractor should include the contractor registration number and acknowledge receipt of pertinent addendums by listing them sequentially. 8.3 Bid security deposits should be submitted in hardcopy, but can be post marked by July 7, 2014. Include a scan of the bid security deposit in the electronic proposal submittal. 9 WITHDRAWAL OF BIDS 9.1 Any Bidder may withdraw their Bid at any time prior to the scheduled closing time for receipt of Bids. 9.2 No Bids shall be withdrawn for a period of thirty (30) calendar days after scheduled closing time for receipt of Bids. 10 CONSIDERATION OF BIDS 10.1 Properly identified Bids received by the stated hour will be publicly opened and read aloud. 10.2 The Owner shall have the right to reject any and all Bids or by other data required by the Bidding Documents, or to reject a Bid that is in any way incomplete or irregular. 10.3 It is the intent of the Owner to award a Contract to the most-qualified and lowest- The Trust for Public Land - Story Mill Ecological Restoration Project INSTRUCTIONS TO BIDDERS RESPEC, Inc. 4 responsible Bidder. The Bidder and/or his superintendent on the job shall be present and will be notified of the time and place. 12 INSPECTION AND MEASUREMENT A pre-bid walkthrough of the project will be held at 10 a.m. on June 20, 2014 at the project site. Page i INTRODUCTION This Agreement between Owner and Contractor for Construction Contract (Stipulated Price) (“Agreement”) has been prepared for use with the Suggested Instructions to Bidders for Construction Contracts (“Instructions to Bidders”) (EJCDC® C‐200, 2013 Edition); the Suggested Bid Form for Construction Contracts (“Bid Form”) (EJCDC® C 410, 2013 Edition); and the Standard General Conditions of the Construction Contract (“General Conditions”) (EJCDC® C‐700, 2013 Edition). Their provisions are interrelated, and a change in one may necessitate a change in the others. See also the Guide to the Preparation of Supplementary Conditions (EJCDC® C‐800, 2013 Edition), and the Commentary on the 2013 EJCDC Construction Documents (EJCDC® C‐001, 2013 Edition). In construction contracting, as a general matter the “agreement” is the legal instrument executed (signed) by the project owner and the construction contractor, binding the parties to the terms of the contract. See CSI Project Delivery Practice Guide (2011), Section 11.1.2, p. 210, and CSI Construction Specification Practice Guide (2011), Section 5.1, p. 75. This EJCDC Agreement form serves that basic function, by identifying the parties and Contract Documents, and establishing the Contract Price and Contract Times. This Agreement form is specifically intended for stipulated price (fixed price) contracts—that is, contracts in which Owner and Contractor identify specific lump sums and unit prices as Contractor’s compensation for performing the Work. For construction contracts in which the Contract Price is primarily based on costs incurred during construction, users should select EJCDC® C‐525, Agreement between Owner and Contractor for Construction Contract (Cost‐Plus). This Agreement form is drafted to be flexible enough to be used on projects that are competitively bid, and for public and private contracts that are negotiated or awarded through a proposal process or otherwise. On competitively bid projects, the following documentary information would typically be made available to bidders: • Bidding Requirements, which include the Advertisement or invitation to bid, the Instructions to Bidders, and the Bid Form that is suggested or prescribed, all of which provide information and guidance for all Bidders, and Bid Form supplements (if any) such as Bid Bond and Qualifications Statement. • Contract Documents, which include the Agreement, performance and payment bonds, the General Conditions, the Supplementary Conditions, the Drawings, and the Specifications. • Documents referred to in the Supplementary Conditions or elsewhere as being of interest to bidders for reference purposes, but which are not Contract Documents. Together, the Bidding Requirements and the Contract Documents are referred to as the Bidding Documents. (The terms “Bidding Documents,” “Bidding Requirements,” and "Contract Documents" are defined in Article 1 of the General Conditions.) The Bidding Requirements are not Contract Documents because much of their substance pertains to the relationships prior to the award of the Contract and has little effect or impact thereafter. Many contracts are awarded without even going through a bidding process, and thus have no Bidding Requirements, illustrating that the bidding items are typically superfluous to the formation of a binding and comprehensive construction contract. In some cases, however, a bid or proposal will contain numerous line items and their prices; in such case the actual bid or proposal document may be attached as an exhibit to the Agreement to avoid extensive rekeying. Page ii Suggested provisions are accompanied by “Notes to User” and bracketed notes and prompts to assist in preparing the Agreement. The provisions have been coordinated with the other forms produced by EJCDC. Much of the language should be usable on most projects, but modifications and additional provisions will often be necessary. When modifying the suggested language or writing additional provisions, the user must check the other documents thoroughly for conflicts and coordination of terms, and make appropriate revisions in all affected documents. All parties involved in construction projects benefit significantly from a standardized approach in the location of subject matter throughout the documents. Experience confirms the danger of addressing the same subject matter in more than one location; doing so frequently leads to confusion and unanticipated legal consequences. When preparing documents for a construction project, careful attention should be given to the guidance provided in EJCDC® N‐122/AIA® A521, Uniform Location of Subject Matter (2012 Edition), available at no charge from the EJCDC website, www.ejcdc.org, and from the websites of EJCDC’s sponsoring organizations. CSI MasterFormat™ (50‐Division format) designates Document “00 52 XX” for various forms of the owner‐contractor agreement. If this format is used, the first page of the Agreement would be numbered 00 52 13‐1 (or other appropriate third pair of numbers, in accordance with MasterFormat™). Instructions and restrictions regarding the use of this document are set out in the License Agreement that accompanied the document at the time of purchase. To prepare the Agreement for inclusion in a Project Manual or for use in a specific contractual engagement, (1) remove the cover pages and this Introduction, (2) fill in Project‐specific information and make revisions to the Agreement, following the guidance in the Notes to Users and bracketed notes and prompts, and the advice of legal counsel, and (3) delete the Notes to Users and bracketed notes and prompts. The Trust for Public Land - Story Mill Ecological Restoration Project PART TWO - AGREEMENT RESPEC, Inc. 1 AGREEMENT BETWEEN OWNER AND CONTRACTOR FOR CONSTRUCTION CONTRACT (STIPULATED PRICE) THIS AGREEMENT is by and between (“Owner”) and (“Contractor”). Owner and Contractor hereby agree as follows: ARTICLE 1 – WORK 1.01 Contractor shall complete all Work as specified or indicated in the Contract Documents. The Work is generally described as follows: ARTICLE 2 – THE PROJECT 2.01 The Project, of which the Work under the Contract Documents is a part, is generally described as follows: __ecological restoration at the Story Mill Community Park._________________ ARTICLE 3 – ENGINEER 3.01 The Project has been designed by __RESPEC, Inc.___________________________. 3.02 The Owner has retained __RESPEC, Inc_____________________ (“Engineer”) to act as Owner’s representative, assume all duties and responsibilities, and have the rights and authority assigned to Engineer in the Contract Documents in connection with the completion of the Work in accordance with the Contract Documents. ARTICLE 4 – CONTRACT TIMES 4.01 Time of the Essence A. All time limits for Milestones, if any, Substantial Completion, and completion and readiness for final payment as stated in the Contract Documents are of the essence of the Contract. 4.02 Contract Times: Dates A. The Work will be substantially completed on or before _____, and completed and ready for final payment in accordance with Paragraph 15.06 of the General Conditions on or before _____. B. Parts of the Work shall be substantially completed on or before the following Milestone(s): 1. Construction of Phase 1 – November 15, 2014. 2. Willow cutting planting for Phase 1 – April 30, 2015. 3. Construction of Phase 2 – July 1 ‐ November 15, 2014. 4. Willow cutting planting for Phase 2 – April 30, 2016. Contractor and Owner recognize that time is of the essence as stated in Paragraph 4.01 above and that Owner will suffer financial and other losses if the Work is not completed and Milestones not achieved within the times specified in Paragraph 4.02 above, plus any extensions thereof allowed in accordance with the Contract. The parties also recognize the delays, expense, and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty): 1. Substantial Completion: Contractor shall pay Owner $_______ for each day that expires after the time (as duly adjusted pursuant to the Contract) specified in Paragraph 4.02.A above for Substantial Completion until the Work is substantially complete. 2. Completion of Remaining Work: After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the Contract Time (as duly adjusted pursuant to the Contract) for completion and readiness for final payment, Contractor shall pay Owner $_______ for each day that expires after such time until the Work is completed and ready for final payment. 3. Liquidated damages for failing to timely attain Substantial Completion and final completion are not additive and will not be imposed concurrently. 4. Milestones: Contractor shall pay Owner $_______ for each day that expires after the time (as duly adjusted pursuant to the Contract) specified above for achievement of Milestone 1, until Milestone 1 is achieved. 4.04 Special Damages A. In addition to the amount provided for liquidated damages, Contractor shall reimburse Owner (1) for any fines or penalties imposed on Owner as a direct result of the Contractor’s failure to attain Substantial Completion according to the Contract Times, and (2) for the actual costs reasonably incurred by Owner for engineering, construction observation, inspection, and administrative services needed after the time specified in Paragraph 4.02 for Substantial Completion (as duly adjusted pursuant to the Contract), until the Work is substantially complete. B. After Contractor achieves Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the Contract Times, Contractor shall reimburse Owner for the actual costs reasonably incurred by Owner for engineering, construction observation, inspection, and administrative services needed after the time specified in Paragraph 4.02 for Work to be completed and ready for final payment (as duly adjusted pursuant to the Contract), until the Work is completed and ready for final payment. ARTICLE 5 – CONTRACT PRICE 5.01 Owner shall pay Contractor for completion of the Work in accordance with the Contract Documents the amounts that follow, subject to adjustment under the Contract: A. For all Work other than Unit Price Work, a lump sum of: $__________. B. ARTICLE 6 – PAYMENT PROCEDURES 6.01 Submittal and Processing of Payments A. Contractor shall submit Applications for Payment in accordance with Section 01 2000 – Price and Payment Procedures. Applications for Payment will be processed by Engineer as provided in the General Conditions. 6.02 Progress Payments; Retainage A. Owner shall make progress payments on account of the Contract Price on the basis of Contractor’s Applications for Payment on or about the _____ day of each month during performance of the Work as provided in Paragraph 6.02.A.1 below, provided that such Applications for Payment have been submitted in a timely manner and otherwise meet the requirements of the Contract. All such payments will be measured by the Schedule of Values established as provided in the General Conditions (and in the case of Unit Price Work based on the number of units completed) or, in the event there is no Schedule of Values, as provided elsewhere in the Contract. 1. Prior to Substantial Completion, progress payments will be made in an amount equal to the percentage indicated below but, in each case, less the aggregate of payments The Trust for Public Land - Story Mill Ecological Restoration Project PART TWO - AGREEMENT RESPEC, Inc. 4 previously made and less such amounts as Owner may withhold, including but not limited to liquidated damages, in accordance with the Contract a. _____ percent of Work completed (with the balance being retainage). If the Work has been 50 percent completed as determined by Engineer, and if the character and progress of the Work have been satisfactory to Owner and Engineer, then as long as the character and progress of the Work remain satisfactory to Owner and Engineer, there will be no additional retainage; and b. _____ percent of cost of materials and equipment not incorporated in the Work (with the balance being retainage). B. Upon Substantial Completion, Owner shall pay an amount sufficient to increase total payments to Contractor to _____ percent of the Work completed, less such amounts set off by Owner pursuant to Paragraph 15.01.E of the General Conditions, and less _____ percent of Engineer’s estimate of the value of Work to be completed or corrected as shown on the punch list of items to be completed or corrected prior to final payment. 6.03 Final Payment A. Upon final completion and acceptance of the Work in accordance with Paragraph 15.06 of the General Conditions, Owner shall pay the remainder of the Contract Price as recommended by Engineer as provided in said Paragraph 15.06. ARTICLE 7 – INTEREST 7.01 All amounts not paid when due shall bear interest at the rate of _____ percent per annum. ARTICLE 8 – CONTRACTOR’S REPRESENTATIONS 8.01 In order to induce Owner to enter into this Contract, Contractor makes the following representations: A. Contractor has examined and carefully studied the Contract Documents, and any data and reference items identified in the Contract Documents. B. Contractor has visited the Site, conducted a thorough, alert visual examination of the Site and adjacent areas, and become familiar with and is satisfied as to the general, local, and Site conditions that may affect cost, progress, and performance of the Work. C. Contractor is familiar with and is satisfied as to all Laws and Regulations that may affect cost, progress, and performance of the Work. D. Contractor has been informed and carefully considered the current level of information on subsurface conditions found on the site. E. Contractor has considered the information known to Contractor itself; information commonly known to contractors doing business in the locality of the Site; information and observations obtained from visits to the Site; the Contract Documents; and the Site‐related reports and drawings identified in the Contract Documents, with respect to the effect of such information, observations, and documents on (1) the cost, progress, and performance of the Work; (2) the means, methods, techniques, sequences, and procedures of construction to be employed by Contractor; and (3) Contractor’s safety precautions and programs. Based on the information and observations referred to in the preceding paragraph, Contractor agrees that no further examinations, investigations, explorations, tests, studies, or data are necessary for the performance of the Work at the Contract Price, within the Contract Times, and in accordance with the other terms and conditions of the Contract. G. Contractor is aware of the general nature of work to be performed by Owner and others at the Site that relates to the Work as indicated in the Contract Documents. H. Contractor has given Engineer written notice of all conflicts, errors, ambiguities, or discrepancies that Contractor has discovered in the Contract Documents, and the written resolution thereof by Engineer is acceptable to Contractor. I. The Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions for performance and furnishing of the Work. J. Contractor’s entry into this Contract constitutes an incontrovertible representation by Contractor that without exception all prices in the Agreement are premised upon performing and furnishing the Work required by the Contract Documents. ARTICLE 9 – CONTRACT DOCUMENTS 9.01 Contents A. The Contract Documents consist of the following: 1. This Agreement (pages 1 to ___, inclusive). 2. Requirements and Specifications as described in the Project Manual. 3. Drawings (not attached but incorporated by reference) consisting of ___ sheets with each sheet bearing the following general title: ___ [or] the Drawings listed on the attached sheet index. 4. Addenda (numbers ___ to ___, inclusive). 5. Exhibits to this Agreement (enumerated as follows): a. Contractor’s Bid (pages ___ to ___, inclusive). 6. The following which may be delivered or issued on or after the Effective Date of the Contract and are not attached hereto: a. Notice to Proceed. b. Work Change Directives. c. Change Orders. d. Field Orders. B. The documents listed in Paragraph 9.01.A are attached to this Agreement (except as expressly noted otherwise above). C. There are no Contract Documents other than those listed above in this Article 9. D. The Contract Documents may only be amended, modified, or supplemented as provided in the Project Manual. The Trust for Public Land - Story Mill Ecological Restoration Project PART TWO - AGREEMENT RESPEC, Inc. 6 ARTICLE 10 – MISCELLANEOUS 10.01 Terms A. Terms used in this Agreement will have the meanings stated in the General Conditions and the Supplementary Conditions. 10.02 Assignment of Contract A. Unless expressly agreed to elsewhere in the Contract, no assignment by a party hereto of any rights under or interests in the Contract will be binding on another party hereto without the written consent of the party sought to be bound; and, specifically but without limitation, money that may become due and money that is due may not be assigned without such consent (except to the extent that the effect of this restriction may be limited by law), and unless specifically stated to the contrary in any written consent to an assignment, no assignment will release or discharge the assignor from any duty or responsibility under the Contract Documents. 10.03 Successors and Assigns A. Owner and Contractor each binds itself, its successors, assigns, and legal representatives to the other party hereto, its successors, assigns, and legal representatives in respect to all covenants, agreements, and obligations contained in the Contract Documents. 10.04 Severability A. Any provision or part of the Contract Documents held to be void or unenforceable under any Law or Regulation shall be deemed stricken, and all remaining provisions shall continue to be valid and binding upon Owner and Contractor, who agree that the Contract Documents shall be reformed to replace such stricken provision or part thereof with a valid and enforceable provision that comes as close as possible to expressing the intention of the stricken provision. 10.05 Contractor’s Certifications A. Contractor certifies that it has not engaged in corrupt, fraudulent, collusive, or coercive practices in competing for or in executing the Contract. For the purposes of this Paragraph 10.05: 1. “corrupt practice” means the offering, giving, receiving, or soliciting of any thing of value likely to influence the action of a public official in the bidding process or in the Contract execution; 2. “fraudulent practice” means an intentional misrepresentation of facts made (a) to influence the bidding process or the execution of the Contract to the detriment of Owner, (b) to establish Bid or Contract prices at artificial non‐competitive levels, or (c) to deprive Owner of the benefits of free and open competition; 3. “collusive practice” means a scheme or arrangement between two or more Bidders, with or without the knowledge of Owner, a purpose of which is to establish Bid prices at artificial, non‐competitive levels; and 4. “coercive practice” means harming or threatening to harm, directly or indirectly, persons or their property to influence their participation in the bidding process or affect the execution of the Contract. The Story Mill Ecological Restoration Project consists of selective debris removal, earthwork and grading, channel and streambank stabilization, planting/seeding, and temporary/permanent erosion control. 1.2 CONTRACT DESCRIPTION A. Contract Type: A single prime contract for the Project above. 1.3 CONTRACTOR USE OF SITE AND PREMISES A. Construction Operations: Coordinate use of site, staging areas, access to site and to areas of work with Owner's Designated Representative. Follow proper construction procedures to eliminate disruption to neighbors and neighbor’s properties, including wind-blown debris. Contractor shall provide daily housekeeping and site clean-up. B. Arrange use of site and premises to allow: 1. Traffic flow on all adjacent streets and trails. 2. All onsite material storage shall be coordinated with the Owner's Representative. Confine storage of materials to designated staging areas. C. Provide access to and from site as required by law and by Owner: 1. Do not obstruct roadways, sidewalks, or other public ways without permit. D. Utility Outages and Shutdown: 1. Prevent accidental disruption of utility services to other facilities. E. Preservation of Natural Features: 1. Prevent damage to natural surroundings through the use of construction fencing to designate work, travel, and staging areas. Restore damaged areas, repairing or replacing damaged trees and plants that are not to be removed from site. 2. As necessary, provide temporary barriers to protect existing trees and plants and root zones. The Trust for Public Land - Story Mill Ecological Restoration Project SUMMARY RESPEC, Inc. 1 1000 / 2 3. Do not remove, injure, or destroy trees or other plants without prior approval. Consult with the Owner’s Designated Representative and remove agreed-on roots and branches that interfere with construction. 4. Carefully supervise excavating, grading, filling, and other construction operations near trees to prevent damage. F. Driveways and Entrances: Keep driveways and entrances serving premises clear and available to residences and emergency vehicles at all times. Do not use these areas for parking or storage of materials. 1. Schedule deliveries to minimize use of driveways and entrances. G. Hauling Restrictions: Comply with all legal load restrictions in the hauling of materials. H. Adhere to all permit requirements. Coordinate with Owner’s Representative on any and all requests for modifications to permits. 1.4 WORK SCHEDULE A. START PHASE 1 – Upon issuance of Notice to Proceed – actual construction to begin September 1, 2014. B. SUBSTANTIAL COMPLETION OF PHASE 1 – Required by November 15, 2014. C. PHASE 1 PLANTING OF WILLOW CUTTINGS – April 2015. D. START PHASE 2 – July 1, 2015. E. SUBSTANTIAL COMPLETION OF PHASE 2 – Required by November 15, 2015. F. PHASE 2 PLANTING OF WILLOW CUTTINGS – April 2016. 1.5 SPECIAL CONSTRUCTION REQUIREMENTS 1. Work will be performed when groundwater and surface water levels are lowest in mid- to late-summer (August 1 – November 15). 2. The Contractor will be responsible for all construction surveying, staking, and layout of the project. 3. The Contractor should be aware that work will occur in the vicinity of various utility conduits, mains, poles, and other structures. The Contractor will take sole responsibility for damage to any utilities encountered. Special note is made that Northwestern Energy (NWE) will be moving their gas pipeline. The location is undetermined at this time. Construction coordination with NEW should be anticipated as part of this project. 4. The existing bridge located on the Triangle Parcel will need to be evaluated for load capacity and refurbished, as necessary, prior to use by construction equipment for site access and hauling. The Trust for Public Land - Story Mill Ecological Restoration Project SUMMARY RESPEC, Inc. 1 1000 / 3 5. Saturated conditions may be encountered during excavation (muck). Use of rubber mats may be required to work effectively in these areas. 6. Construction access through existing wetland areas will require temporary crossings to be constructed. Refer to design drawings for details. 7. Removal of debris from the East Gallatin River will be conducted under supervision of the Designer. Debris is largely concrete and old machinery and will be required to be hauled to an approved landfill site, such as the Gallatin County landfill near Logan, MT. 8. The pond on the South Parcel is supported by groundwater. Reconfiguration and filling of the pond to new design elevation will require dewatering. A dewatering permit will be obtained by the contractor. It is anticipated that construction of the Bozeman slough will likely need to occur prior to reconfiguration of the pond. PART 2 PRODUCTS - NOT USED PART 3 EXECUTION - NOT USED END OF SECTION 01 1000 The Trust for Public Land - Story Mill Ecological Restoration Project PRICE AND PAYMENT PROCEDURES RESPEC, Inc. 01 2000 / 4 SECTION 01 2000 - PRICE AND PAYMENT PROCEDURES PART 1 GENERAL 1.1 SECTION INCLUDES A. Procedures for preparation and submittal of applications for progress payments. B. Documentation of changes in Contract Sum and Contract Time. C. Change procedures. D. Procedures for preparation and submittal of application for final payment. 1.2 RELATED REQUIREMENTS 1.3 SCHEDULE OF VALUES A. Prior to the first application for payment, the Contractor shall submit to the Designer a schedule of values allocated to the various portions of the work, subject to the Designer’s approval. This schedule shall be used only as a basis for the Contractor’s application for payment. B. Format: The Contractor shall submit a signed written estimate of the dollar value of work which will be completed, together with such data or schedules as may be required, at the end of that month to the Designer as an application for payment. At a minimum, identify each line item in the payment application with the parcel name (i.e., North Parcel, South Parcel, Triangle Parcel) and description of the work, including reference to the Specification section number and title, as applicable. Identify each of the following as separate line items: 1. Costs for Temporary Facilities and Controls. 1.4 APPLICATIONS FOR PROGRESS PAYMENTS A. Payment Period: Submit at intervals stipulated in the Agreement. B. Execute certification by signature of authorized officer. C. Use data from approved Schedule of Values. Provide dollar value in each column for each line item for portion of work performed and for stored products. D. List each authorized Change Order as a separate line item, listing Change Order number and dollar amount as for an original item of Work. E. Submit three copies of each Application for Payment. F. Include the following with the application: 1. Transmittal letter as specified for Submittals in Section 01 3000. 2. Construction progress schedule, revised and current as specified in Section 01 3000. G. When Designer requires substantiating information, submit data justifying dollar amounts in question. The Trust for Public Land - Story Mill Ecological Restoration Project PRICE AND PAYMENT PROCEDURES RESPEC, Inc. 01 2000 / 5 H. Submit Applications monthly or in a similar time frame that is in alignment with the progress of the work. It is preferred that contractors submit requests for progress payments, and not a single final application for payment when the project is complete. 1.5 MODIFICATION PROCEDURES A. For minor changes not involving an adjustment to the Contract Sum or Contract Time, Designer will issue instructions directly to Contractor. B. For other required changes, Designer will issue a document signed by Owner instructing Contractor to proceed with the change, for subsequent inclusion in a Change Order. 1. The document will describe the required changes and will designate method of determining any change in Contract Sum or Contract Time. 2. Promptly execute the change. C. For changes for which advance pricing is desired, Designer will issue a document that includes a detailed description of a proposed change with supplementary or revised drawings and specifications, a change in Contract Time for executing the change. Contractor shall prepare and submit a fixed price quotation within 10 days. D. Contractor may propose a change by submitting a request for change to Designer, describing the proposed change and its full effect on the Work, with a statement describing the reason for the change, and the effect on the Contract Sum and Contract Time with full documentation and a statement describing the effect on Work by separate or other contractors. Document any requested substitutions in accordance with Section 01 6000. E. Computation of Change in Contract Amount: As specified in the Agreement and Conditions of the Contract. 1. For change requested by Designer for work falling under a fixed price contract, the amount will be based on Contractor's price quotation. 2. For change requested by Contractor, the amount will be based on the Contractor's request for a Change Order as approved by Designer. 3. For change ordered by Designer without a quotation from Contractor, the amount will be determined by Designer based on the Contractor's substantiation of costs as specified for Time and Material work. F. Substantiation of Costs: Provide full information required for evaluation. 1. On request, provide following data: a. Quantities of products, labor, and equipment. b. Taxes, insurance, and bonds. c. Overhead and profit. d. Justification for any change in Contract Time. e. Credit for deletions from Contract, similarly documented. 2. Support each claim for additional costs with additional information: a. Origin and date of claim. b. Dates and times work was performed, and by whom. Invoices and receipts for products, equipment, and subcontracts, similarly documented. 3. For Time and Material work, submit itemized account and supporting data after completion of change, within time limits indicated in the Conditions of the Contract. G. Execution of Change Orders: Designer will issue Change Orders for signatures of parties as provided in the Conditions of the Contract. H. After execution of Change Order, promptly revise Schedule of Values and Application for Payment forms to record each authorized Change Order as a separate line item and adjust the Contract Sum. I. Promptly revise progress schedules to reflect any change in Contract Time, revise sub- schedules to adjust times for other items of work affected by the change, and resubmit. J. Promptly enter changes in Project Record Documents. 1.6 Miscellaneous Force Account A. This section covers work, not included in the contract, performed at the direction of the Designer, and shall include unforeseen work for which there is no price included in this contract. B. For any work item that requires labor for installation and handling, the Designer and Contractor shall negotiate the actual cost of such work prior to execution of the work. C. For materials accepted by the Designer and incorporated into the work, the Contractor shall receive payment for the actual cost of such materials delivered on site for the work, including transportation charges paid by the Contractor (exclusive of machinery rentals as hereinafter set forth). D. Heavy equipment needed for unforeseen work shall be of the types which are already required on the jobsite. The Contractor shall furnish the Engineer with an equipment list at the Pre-Construction Meeting in accordance with Section J, Subpart 1.13C. The Contractor will be reimbursed for hourly rates associated with equipment in an amount equal to the hourly rates agreed to, and included in the equipment list. E. For any special machinery and/or equipment (other than small tools) including fuel and lubricants, plus transportation costs, the use of which has been authorized by the Designer, the rates will be agreed upon ahead of time. F. The Contractor’s Representative and the Designer shall compare records daily of the cost of work as ordered on a force account basis. No additional work shall be performed until the Contractor and Engineer have agreed upon the previous day’s costs. G. Application for payment under work performed under the force account will include date, daily hours, total hours, rate, and extension for each classification of laborers and foremen; machinery and equipment dates, rates and total hours; quantities of materials, prices and extensions; and transportation of materials. 1.7 APPLICATION FOR FINAL PAYMENT A. B. Application for Final Payment will not be considered until the following have been accomplished: 1. All closeout procedures specified in Section 01 7000. 2. Within 5 days after date of the Agreement, submit preliminary schedule defining planned operations through completion of Work. B. If preliminary schedule requires revision after review, submit revised schedule within 3 days. C. Submit updated schedule, if revised from previously submitted schedule, at each weekly meeting. 3.4 SUBMITTALS FOR REVIEW A. For new Products to be supplied by and installed by the Contractor, make the following types of submittals to Designer for distribution and action: 1. Requests for interpretation. 2. Requests for substitution. 3. Applications for payment and change order requests. 4. Progress schedules. 5. Closeout submittals. Submit to Designer for review for the limited purpose of checking for conformance with information given and the design concept expressed in the contract documents. C. After review, provide copies and distribute in accordance with SUBMITTAL PROCEDURES article below and for record documents purposes described in Section 01 7000 – EXECUTION AND CLOSEOUT REQUIREMENTS. 3.5 SUBMITTALS FOR INFORMATION A. For new products to be installed, submit them to Designer for information: 1. Design data. 2. Certificates. 3. Test reports. 4. Inspection reports. 5. Manufacturer's instructions. B. Manufacturer's field reports. Submit for Designer's knowledge as contract administrator or for Owner. No action will be taken. 3.6 SUBMITTALS FOR PROJECT CLOSEOUT A. For new products to be installed, submit them at project closeout: 1. Project record documents. 2. Operation and maintenance data. 3. Warranties. B. Submit for Owner's benefit during and after project completion. 3.7 NUMBER OF COPIES OF SUBMITTALS A. Documents for Review: 1. Small size sheets, not larger than 8-1/2 x 11 inches: Submit the number of copies that Contractor requires, plus two copies that will be retained by Designer. B. Documents for Information: Submit one copy. C. Samples: Submit 1 per product to Designer. 3.8 SUBMITTAL PROCEDURES A. Transmit each submittal with form approved by Designer. B. Sequentially number the transmittal form. Revise submittals with original number and a sequential alphabetic suffix. C. Identify Project by Project Name, Parcel Name (i.e., North, South, or Triangle parcel), Contractor, Subcontractor or supplier; pertinent drawing and detail number, and specification section number, as appropriate on each copy. D. Apply Contractor's stamp, signed or initialed certifying that review, approval, verification of Products required, field dimensions, adjacent construction Work, and coordination of information is in accordance with the requirements of the Work and Contract Documents. E. Deliver submittals to Designer at business address. F. Schedule submittals to expedite the Project, and coordinate submission of related items. G. For each submittal for review, allow 7 days excluding delivery time to and from the Contractor. Identify variations from Contract Documents and Product or system limitations that may be detrimental to successful performance of the completed Work. I. Any deviation from Contract requirements shall be noted on submittal. Any request for substitution or deviation from Contract requirements shall follow requirements of the General Conditions of the Contract. J. Provide space for Contractor and Designer review stamps. Instruct parties to promptly report any inability to comply with requirements. M. Approved Equals: 1. For each item proposed as an “approved equal,” submit supporting data, including: a. Drawings and samples as appropriate. b. Comparison of the characteristics of the proposed item with that specified. c. Changes required in other elements of the work because of the substitution. d. Name, address, and telephone number of vendor. e. Manufacturer’s literature regarding installation, operation, and maintenance, including schematics for electrical and hydraulic systems, lubrication requirements, and parts lists. Describe availability of maintenance service, and state source of replacement materials. 2. A request for approval constitutes a representation that Contractor: a. Has investigated the proposed item and determined that it is equal or superior in all respects to that specified. b. Will provide the same warranties for the proposed item as for the item specified. c. Has determined that the proposed item is compatible with interfacing items. d. Will coordinate the installation of an approved item and make all changes required in other elements of the work because of the substitution. e. Waives all claims for additional expenses that may be incurred as a result of the substitution. END OF SECTION 01 3000 The Trust for Public Land - Story Mill Ecological Restoration Project SAFETY REQUIREMENTS RESPEC, Inc. 01 3523 / 1 SECTION 01 3523 - SAFETY REQUIREMENTS PART 1 GENERAL 1.1 SUMMARY This section includes establishing an effective accident prevention program and providing a safe environment for all personnel and visitors. 1.2 SUBMITTALS Accident Prevention Plan: After contract award and before the Pre-Construction conference, submit for review, an Accident Prevention Plan. The Owner or Owner’s Designated Representative will review the proposed Plan. If the plan requires any revisions or corrections, the Contractor shall resubmit the Plan within 10 days. No progress payments will be made until the Plan is accepted. 1.3 QUALITY ASSURANCE Comply with contract clauses entitled "Accident Prevention" and "Permits and Responsibilities". In case of conflicts between Federal, State, and local safety and health requirements, the most stringent shall apply. Equipment or tools not meeting OSHA requirements will not be allowed on the project site. Failure to comply with the requirements of this section and related sections may result in suspension of work. A. Qualifications of Employees: 1. All employees must be physically qualified and able to perform their assigned duties in a safe manner. 2. Do not allow employees to perform work whose ability or alertness is impaired because of prescription or illegal drug use, fatigue, illness, intoxication, or other conditions that may expose themselves or others to injury. 3. Operators of vehicles, hoisting equipment, and hazardous plant equipment shall be able to understand signs, signals, and operating instructions, and be fully capable of operating such equipment. Provide operating instructions for all equipment. Newly hired operators shall be individually tested by an experienced operator or supervisor to determine if they are capable of safely operating equipment. 1.4 ACCIDENT REPORTING A. Reportable Accidents: A project reportable accident is defined as death, occupational disease, traumatic injury to employees or the public, fires, and property damage by accident in excess of $100. Notify Owner or Owner’s Designative Representative immediately in the event of a reportable accident. The Trust for Public Land - Story Mill Ecological Restoration Project SAFETY REQUIREMENTS RESPEC, Inc. 01 3523 / 2 PART 2 PRODUCTS 2.1 ACCIDENT PREVENTION PLAN A. The Plan shall be written to comply with OSHA and project requirements (a generic plan is not acceptable) including but not limited to the following: 1. Name of responsible supervisor to carry out the program. 2. Weekly and monthly safety meetings. 3. First aid procedures. 4. Outline of each phase of the work, the hazards associated with each major phase, and the methods proposed to provide for property protection and safety of the public and Contractor's employees. Identify the work included under each phase. 5. Training, both initial and continuing. 6. Planning for possible emergency situations, such as floods, fires, cave-ins, slides, explosions, power outages, and wind storms. Such planning shall take into consideration the nature of construction, site conditions, and degree of exposure of persons and property. 2.2 FIRST AID FACILITIES Provide adequate facilities for the number of employees and the hazards associated with the types of ongoing construction work at the site. 2.3 PERSONNEL PROTECTIVE EQUIPMENT Meet requirements of applicable ANSI standards. PART 3 EXECUTION 3.1 EMERGENCY INSTRUCTIONS Post telephone numbers and reporting instructions for ambulance, physician, hospital, fire department, and police in conspicuous locations at the work site. 3.2 FIRE AND LIFE SAFETY A. Comply with the requirements of NFPA 241 (Standard for Safeguarding Construction, Alteration, and Demolition Operations). B. Store hazardous materials in accordance with manufacturer’s and OSHA recommendations. Maintain readily available, on site, MSDS for each chemical. 1. Immediately report all spills of hazardous materials to the Owner or Owner’s Designated Representative. 2. Maintain a spill emergency response kit. The Trust for Public Land - Story Mill Ecological Restoration Project SAFETY REQUIREMENTS RESPEC, Inc. 01 3523 / 3 3.3 PROTECTIVE EQUIPMENT A. Inspect personal protective equipment daily and maintain in a serviceable condition. Clean, sanitize, and repair personal items, as appropriate, before issuing them to another individual. B. Inspect and maintain other protective equipment and devices before use and on a periodic basis to ensure safe operation. 3.4 SAFETY MEETINGS A. At a minimum, conduct weekly 15-minute "tailgate" safety meetings. These meetings shall be conducted by a foreman or supervisor and attended by all construction personnel at the worksite. Topics need to coincide with work scheduled for the following week. Document and submit meeting minutes to the Owner within one day after the meeting. B. Conduct monthly safety meetings for all levels of supervision. Meetings shall be attended by all contractors and subcontractors performing work on the site. Notify the Contracting Officer of meeting dates and times. These meetings shall be used to review the effectiveness of the Contractor's safety effort, to resolve current health and safety problems, to provide a forum for planning safe construction activities, and for updating the Accident Prevention Plan. The Owner’s Designated Representative will attend the meeting and enter the results of the meetings into the daily log. 3.5 HARD HATS AND PROTECTIVE EQUIPMENT AREAS A. A hard hat area shall be designated by the Contractor. The hard hat area shall be posted by the Contractor in a manner satisfactory to the Owner’s Designated Representative. B. It is the Contractor's responsibility to require all those working on or visiting the site to wear hard hats and other necessary personal protective equipment at all times. At a minimum, provide 3 hard hats for use by visitors. 3.6 TRAINING A. First Aid: Provide adequate training to an adequate number of personnel to ensure prompt and efficient first aid. B. Hazardous Material: Train and instruct each employee exposed to hazardous material in safe and approved methods of handling and storage. Hazardous materials are defined as explosive, flammable, poisonous, corrosive, oxidizing, irritating, or otherwise harmful substances that could cause death or injury. Agency may not release, revoke, alter, or enlarge on requirements of Contract Documents. 2. Agency may not approve or accept any portion of the Work. 3. Agency may not assume any duties of Contractor. 4. Agency has no authority to stop the Work. B. Contractor Responsibilities: 1. Cooperate with testing agency in any way requested or required. 2. Notify the Owner's Designated Representative 48 hours prior to expected time for operations requiring testing/inspection services. 3.3 MANUFACTURERS' FIELD SERVICES A. When specified by product manufacturers, require material or product suppliers or manufacturers to provide qualified staff personnel to observe site conditions, conditions of surfaces and installation, quality of workmanship, as applicable, and to initiate instructions when necessary. B. Report observations and site decisions or instructions given to applicators or installers that are supplemental or contrary to manufacturers' written instructions. 3.4 DEFECT ASSESSMENT A. Replace Work or portions of the Work not conforming to specified requirements. B. If, in the opinion of Architect, it is not practical to remove and replace the Work, Architect will direct an appropriate remedy or adjust payment. Provide barriers to prevent unauthorized entry to construction areas, to prevent access to areas that could be hazardous to workers or the public, to allow for owner's use of site and to protect existing facilities and adjacent properties from damage from construction operations and demolition. B. Provide barricades required by governing authorities for public rights-of-way and for public access to existing building. C. Protect non-owned vehicular traffic, stored materials, site, and structures from damage. D. Coordinate location of barriers with Owner or Owner’s Designated Representative. 1.5 FENCING A. Remove temporary utilities, equipment, facilities, materials, prior to Substantial Completion inspection. B. Clean and repair damage caused by installation or use of temporary work. C. Proper care shall be taken when accessing the site. PREVENTION 01 5723 / 1 SECTION 01 5723 – TEMPORARY STORM WATER POLLUTION PREVENTION PART 1 GENERAL 1.1 SUMMARY The work of this section consists of implementing measures to control Temporary Storm Water Pollution during construction activities through compliance with the NPDES/MPDES permit program. 1.2 DEFINITIONS A. Environmental Pollution and Damage: The presence of chemical, physical, or biological elements or agents which adversely affect human health or welfare; unfavorably alter ecological balances; or degrade the utility of the environment for aesthetic, cultural, or historical purposes. B. Storm Water Pollution Prevention Plan (SWPPP): Developed and implemented pollution prevention plan (including stormwater management measures, if needed) to protect the environment from pollutants on construction projects. The SWPPP shall be prepared by the Designer (Engineer); however, the Stormwater Discharge Permit (318 Permit) shall be held under the name of the Contractor. 1.3 SUBMITTALS After contract award and before the pre-construction conference, prepare and submit: A. Inspection Schedule: Submit schedule for inspection and monitoring of all pollution prevention measures. B. Erosion Control Products: Submit manufacturer’s product information and installation recommendations for silt fence, sediment wattles, erosion control blanket, straw bales, and any other materials proposed for use on this project. 1.4 QUALITY ASSURANCE The Contractor shall prepare and submit a plan to the Owner or Owner’s Designated Representative for review and concurrence. A. Orientation Meeting: The Contractor shall be responsible for arranging and conducting a Pollution Prevention meeting/briefing to inform all parties scheduled to be on-site during the project of the measures to be implemented for proper pollution prevention and control (may be included as part of the Pre-Construction Meeting). 1. Installation of storm water Best Management Practices (BMPs) and all other forms of pollution prevention controls shall not begin until after this meeting has occurred. B. Pollution Prevention Manager: The Contractor shall designate a Pollution Prevention Manager who will be responsible for the implementation, inspection, maintenance, and any amendments to the approved storm water pollution prevention plan (SWPPP). The Pollution Prevention Manager shall be thoroughly familiar with the SWPPP and BMPs and shall ensure that emergency procedures and the plan are updated as needed and available for inspection. 2. When changes in the approved plan are required, the Pollution Prevention Manager shall prepare and certify an amendment and submit to the Owner or Owner’s Designated Representative for review and concurrence. PART 2 PRODUCTS – NOT USED PART 3 EXECUTION 3.1 ENVIRONMENTAL PROTECTION A. Protection of Natural Resources: Comply with applicable regulations and these specifications. Preserve the natural resources within the project boundaries and outside the limits of work performed under this Contract in their existing condition or restore to an equivalent or improved condition as approved by the Designated Owner’s Representative. B. Construction Zone: Arrange construction activities to minimize pollution (i.e., erosion, trash, etc.) to the maximum practical extent. 1. Clearing, excavation, and grading shall be limited to those areas of the project site necessary for construction. Minimize the area exposed and unprotected. 2. Clearly mark and delineate the limits of work activities. 3. Equipment shall not be allowed to operate outside the limits of work or to disturb existing vegetation. 4. Excavation and grading shall be completed during the dry season to the maximum extent possible 5. Material should be stored away from locations where water is present to the greatest extent practicable. 3.2 STORM WATER POLLUTION PREVENTION PLAN (SWPPP) A. Review and Acceptance: The Contractor and the Owner (or Owner’s Designated Representative) will jointly review the SWPPP. The final Plan will be the document enforced on the project. 1. The accepted Plan will describe and ensure implementation of the practices which will be used to reduce the pollutants in storm water discharges. 2. The Contractor shall maintain a current copy of the Plan and all associated records and forms at the jobsite throughout the duration of the project. 3. The Plan shall be available at all times for public inspection and for the inspection and use of the Owner. The Trust for Public Land - Story Mill Ecological Restoration Project TEMPORARY STORMWATER POLLUTION RESPEC, Inc. PREVENTION 01 5723 / 3 B. Implementation: Implement the Plan as required throughout the construction period and maintain all erosion control elements in proper working order. 1. Do not perform clearing and grubbing or earthwork until the Plan has been implemented. 3.3 SITE INSPECTIONS AND SWPPP REVISIONS A. Inspections: The Contractor and the Owner (or Designated Representative) will perform a weekly inspection of the site. 1. The inspection shall include disturbed areas that have not been completely stabilized, areas used for storage of materials, locations where vehicles enter or exit the site, and all other erosion and sediment controls that are included in the SWPPP. 2. Inspections shall be documented. 3. The inspection forms shall be retained onsite in the SWPPP notebook throughout the construction period. B. SWPPP Revisions: It may be necessary to revise the SWPPP during construction to make necessary improvements, revisions, or to respond to unforeseen conditions noted during construction or site inspections. 1. The SWPPP shall specify the mechanism whereby revisions may be proposed by the Contractor or the Owner. 2. The Contractor and the Owner’s representative will jointly review each revision to the SWPPP before changes are incorporated and implemented. The Contractor will then provide a revised copy of the SWPPP to the Owner’s Representative. 3. Accepted modifications will be implemented within 7 calendar days following the date of the inspection when deficiencies or necessary corrections are first noted. 3.4 EROSION CONTROL MEASURES A. Erosion control measures shall consist of any and all BMPs for storm water discharges, including but not limited to silt fencing, sediment wattles, straw bales, temporary soil retention blankets, excelsior drainage filters, sediment traps and berms, and vehicle track-outs. B. Berms and/or sediment wattles shall be used to form sediment traps and to control run- on and run-off into other areas, including creeks, streams, marshes, access roads, well areas, and the staging areas. C. Erosion control measures shall be used to contain only direct precipitation in the construction zone. The contained water shall be allowed to percolate into the ground or drain slowly through the drainage filter sediment traps. D. Reduce runoff velocity as well as direct surface runoff around and away from all fuel containment, storage, and borrow areas. E. Divert surface runoff around and away from cut and fill slopes. F. Place drainage filters around all catch basins to create sediment traps to control run-off from the construction area. Excess water used for dust control shall be contained within the project limits areas by the erosion control measures. H. The Contractor shall prevent the deposition of materials onto paved areas. The Contractor shall inspect the paved areas for deposited materials weekly and remove the materials immediately. I. Furnish, install, maintain, and operate necessary control measures and other equipment necessary to prevent erosion as described in the approved SWPPP. J. Before the work begins, sufficient equipment shall be available on the site to assure that the operation and adequacy of the erosion control system can be maintained. 3.5 MAINTENANCE OF TEMPORARY FACILITIES A. Ensure erosion and sediment control structures remain effective throughout excavation and grading operations. Relocate structures as necessary. B. Inspect control structures after each significant rainfall. Promptly repair breaches which occur. C. The Contractor shall remove entrapped sediment from behind excelsior drainage filter after each storm. 3.6 REPORTING A. Comply with requirements specified in the permit and SWPPP. B. If a discharge occurs or if the project receives a written notice or order from any regulatory agency, the Contractor will immediately notify the Designer and will file a written report within 7 days of the discharge event, notice, or order. Corrective measures shall be implemented immediately following the discharge, notice, or order. The report shall contain the following items at a minimum: 1. The date, time, location, nature of operation, and type of discharge, including the cause or nature of the notice or order. 2. BMPs deployed before the discharge event, or prior to receiving the notice or order. 3. The date of deployment and type of BMPs deployed after the discharge event, or after receiving the notice or order, including additional BMPs installed or planned to reduce or prevent re-occurrence. 4. An implementation and maintenance schedule for any affected BMPs. 3.7 SEDIMENT DISPOSAL A. Sediment excavated from temporary sediment control structures shall be disposed on the site in upland areas with general fill, or with topsoil. Sediment shall be allowed to dry out as required before reuse. B. Contractor shall place sediment removed from traps and other structures where it will not enter a storm drain, wetland or watercourse and where it will not immediately reenter the basin. Space Requirements: Verify space requirements and dimensions of items shown diagrammatically on Drawings. 3.3 CONSTRUCTION LAYOUT A. Verification: Before proceeding to lay out the Work, verify layout information shown on Drawings, in relation to the existing benchmarks. If discrepancies are discovered, notify Designer promptly. B. General: Engage a land surveyor or professional engineer to lay out the Work using accepted surveying practices. 1. Establish benchmarks and control points to set lines and levels of construction and elsewhere as needed to locate each element of Project. 2. Establish dimensions within tolerances indicated. Do not scale Drawings to obtain required dimensions. 3. Inform installers of lines and levels to which they must comply. It is required that the Contractor shall maintain site in a clean and orderly condition at all times. B. Collect and remove waste materials, debris, and trash/rubbish from site daily and dispose off-site; do not burn or bury. 3.6 PROTECTION OF INSTALLED WORK A. Protect installed work from damage by construction operations. B. Prohibit traffic or storage upon roofed surfaces. If traffic or activity is necessary, obtain recommendations for protection from waterproofing or roofing material manufacturer. 3.7 FINAL CLEANING A. Clean debris from roofs, gutters, downspouts, and drainage systems. B. Clean site; sweep paved areas, rake clean landscaped surfaces. C. Make submittals that are required by governing or other authorities. Remove all stumps, roots, and debris a minimum of 12 inches below proposed ground surface, only in areas where bank stabilization treatments are to be constructed, or as directed by the Designer. In all other areas leave stumps cut nearly flush with the ground in order to protect streambank and floodplain from fluvial erosion. Fill stump and root holes with suitable material in accordance with placement and compaction requirements of Section 31 2300: Excavation and Fill. 3.3 REFUSE DISPOSAL A. The Contractor may dispose of the refuse generated from clearing and grubbing at an available waste site, such as a salvage site or landfill, approved by the Designer. The Contractor shall dispose of these materials in such a manner that meets all requirements of State, Gallatin County, and municipal regulations regarding health safety and public welfare. The Contractor shall obtain necessary permits from the MT DEQ for material disposal. PART 4 MEASUREMENT AND PAYMENT 4.1 CLEARING AND GRUBBING A. Work consists of topsoil stripping and stockpiling. 1.2 RELATED DOCUMENTS A. PART 2 PRODUCTS (Not Used) PART 3 EXECUTION 3.1 TOPSOIL STRIPPING AND STOCKPILING A. Upland and wetland topsoil should be kept in separate piles. B. Prior to stripping topsoil/coversoil, the Contractor shall have completed clearing and grubbing operations. Strip sod, organics, and topsoil to its entire depth (minimum of 10 inches or as directed by Engineer) from the areas to be graded or surfaced, prior to general excavation, or from areas to be used as subsoil stockpile areas. C. Stripping of upland topsoil is prohibited when the soil is excessively dry, wet, or in a frozen state. D. Take necessary and practical precautions to prevent mixture of topsoil with subsoil, clay lumps, brush, objectionable weed growth, litter, stone and other foreign material that interfere with planting and seeding operations. E. Protect and stockpile stripped topsoil in areas designated for topsoil only so that they do not become mixed up with stockpiles of subsoil, in the staging areas as approved by the Engineer. Stockpiles should be constructed to minimize wind and water erosion. F. Topsoil stockpiles should not exceed 4 feet in depth. 3.2 GROUND SURFACE PREPARATION A. Before excavating or placing embankment materials, complete all clearing and grubbing, strip all topsoil, and scarify ground surface to provide ample bond between old and new soil materials. 3.3 DISPOSAL A. Woody debris with a main piece larger than or equal to 6” in diameter may be cut into manageable pieces, or trim smaller branches for disposal. The Contractor may dispose of man-made refuse at an available landfill, approved by the Designer. Consider all excavation under this section as ‘unclassified’, regardless of the nature of the material encountered. 1.4 PROJECT CONDITIONS A. Maintain fills, slopes, and trenches within the limits of the bank stabilization areas, floodplains, and wetland restoration areas as shown on the Drawings, until final acceptance. Repair areas damaged as a result of floods, storms or construction activities. Take all necessary precautions to prevent the entrance of soils and other materials into the East Gallatin River and Bozeman Creek. Refer to Section 01 5723: Temporary Storm Water Pollution Prevention, for project requirements. 1.5 PROTECTION A. Protect adjacent properties from damage. Repair damage to adjacent properties due to operations by the Contractor at the Contractor’s expense and to the satisfaction of the Engineer. B. Prevent damage or interruptions of service to any utility. Any damage to existing structures, utilities, etc., resulting from operations under the Contract, is solely the Contractor’s responsibility. 1.6 DISPOSITION OF UTILITIES A. Observe all rules and regulations governing the respective utilities in executing all work under this section. Notify all utilities existing in the work area to verify locations prior to beginning work; contact Montana ‘OneCall’ at 811 or 800-424-555 at least 72 hours in advance of any excavations. B. Protect or relocate any active utilities not shown on the Drawings in accordance with written instruction from the Engineer. C. Remove, plug, or cap any inactive and abandoned utilities encountered in earthwork operations as directed by the Engineer. Document, in writing, the location of abandoned utilities. The Trust for Public Land - Story Mill Ecological Restoration Project EXCAVATION AND FILL RESPEC, Inc. 31 2300 / 2 1.7 PERMITS A. It is the Contractor’s responsibility to adhere to the conditions of all permits obtained for the project, including permits issued by the U.S. Army Corps of Engineers (404 Permit and 401 Certification), 310 permit, floodplain permit, 318 turbidity permit, City of Bozeman wetland review board recommendations. These permits will be provided to the Contractor by the Engineer. Post the permits in a visible location at the project site in a weatherproof enclosure. Maintain permit at site until project completion. 1.8 RELATED DOCUMENTS A. Gravels shall have a maximum diameter (Dmax) of 2 inches. PART 3 EXECUTION 3.1 EXCAVATION A. Conduct excavation activities such that segregation and stockpiling of materials can be accomplished in accordance with each material’s suitability for reuse. B. Maintain excavations in good condition during construction so as not to impair the attainment of final grades and slopes shown on the Drawings. Take all necessary precautions to prevent movement of cut slopes in all excavated areas. C. Place excavated material in its final position insofar as feasible, but in a manner that does not interfere with satisfactory progress of the work. B. Cuttings to be utilized for live planting should be harvested from stands in the Bozeman area that are healthy stands free of damage from insects or disease. C. Cuttings will be collected during the dormant season to ensure the highest success rate. No more than 2/3 of the total branches on any willow shrub (i.e., clump) may be harvested for use as live stakes unless authorized by the property owner. Hand pruners or rotary saws may be utilized for willow cutting harvests. Willow cuttings are The Trust for Public Land - Story Mill Ecological Restoration Project CUTTINGS RESPEC, Inc. 32 9228 / 2 cut with sharp tools that leave a clean (not ragged) cut. D. The cuttings will be ½ to 1 inch in diameter, depending upon the species. Willow cuttings over 7 years of age should not be used as they have less adventitious rooting material in their stems. E. Cutting length will be determined by the planting location and depth to the mid- summer water table. At least 6 to 8 inches of the cuttings are in the mid-summer water table, and no more than one-third of the total length of the cuttings are above ground. F. Cuttings will require removal of all branches, twigs and the terminal buds. PART 3 EXECUTION 3.1 PRODUCT HANDLING A. General: Carefully pack dormant live cuttings (with all growing ends aligned in one direction) to prevent desiccation, breaking, or damage to bark and branches. Provide adequate ventilation. Protect from sun, drying wind, freezing, and rodents. Do not drop cuttings from vehicles. Legibly label cuttings with correct botanical name, common name, and date collected. All cuttings should be placed in water that allows for the entire cutting to be in contact with the water surface. B. Transport: Transport cuttings in covered, unheated vehicles, moistened and covered with moisture-retaining medium. C. Storage: 1. If cuttings cannot be delivered to the construction site within 24 hours, place in water so that the entire length of the cutting is completely in contact with the water surface or off-site in specially prepared facilities specifically constructed to store dormant live plant materials. Maintain facilities at a constantly cool temperature (34 deg F to 50 deg F) and with adequate humidity levels. 2. Keep cuttings in water or moist soils and covered with moisture-retaining medium throughout the time in storage. Periodically water to maintain moisture levels. While at the construction site, ensure that plants are not left in sun to dry out; keep moist and in shaded area. 3.1 PLANTING OF CUTTINGS A. Soaking of willow cuttings in flowing water for 5 to 7 days is recommended prior to planting in the spring to stimulate growth, break dormancy and to flush anti-rooting hormones from the cuttings. Soaking is not recommended for fall plantings because dormancy through the winter is the desired condition. Willow cuttings can be installed using waterjet stingers (see NRCS Technical Note No. 39), tractor-mounted soil augers, planting bars, excavator mounted dibble bars, or by pushing the cuttings into moist soil by hand. The planting depth and location will determine the planting methods. The key to success is to have good contact between the cuttings and the soil with no air pockets (voids) around the cuttings. One advantage of using a waterjet stinger is that it uses water to create a planting hole which saturates it and soil material settles around the stem in a manner conducive to promoting root growth. For all other planting methods that do not use water, each hole will require packing soil around the cuttings to prevent air pockets and filling the hole with water and adding soil to make a mud slurry to remove air. PART 4 MEASUREMENT AND PAYMENT 4.1 LIVE CUTTINGS A. Measurement will be made based on area planted (Acre). Payment shall be made at in the contract unit price for “Willow Cuttings”. END OF SECTION 32 9228 The Trust for Public Land - Story Mill Ecological Restoration Project CHANNEL CLEANING RESPEC, Inc. 35 0150.71 / 1 SECTION 35 0150.71 - CHANNEL CLEANING PART 1 GENERAL 1.1 DESCRIPTION A. Work consists of selective cleaning and removal of debris from the East Gallatin River channel and banks at locations designated on the Drawings. Designer to provide instruction regarding specific locations for removal of trash and debris. 1.2 DEFINITIONS A. Solid Waste: Debris, sludge, or other discharged material (except hazardous waste) including solid, liquid, semisolid, or contained gaseous materials resulting from domestic, industrial, commercial, mining, or agricultural operations. B. Debris: Non-hazardous solid waste which exceeds 2.5 inch (60 mm) particle size that is: a manufactured object; plant or animal matter; or natural geologic material (e.g. cobbles and boulders). A mixture of debris and other material such as soil or sludge is also subject to regulation as debris if the mixture is comprised primarily of debris by volume, based on visual inspection. C. Disposal: Removal off-site of demolition and construction waste and subsequent sale, recycling, reuse, or deposit in landfill or incinerator acceptable to authorities having jurisdiction. D. Environmental Pollution and Damage: The presence of chemical, physical, or biological elements or agents which adversely affect human health or welfare; unfavorably alter ecological balances; or degrade the utility of the environment for aesthetic, cultural, or historical purposes. E. Hazardous Materials: Any material that is regulated as a hazardous material in accordance with 49 CFR 173, requires a Material Safety Data Sheet (MSDS) in accordance with 29 CFR 1910.1200, or which during end use, treatment, handling, storage, transportation or disposal meets or has components which meet or have the potential to meet the definition of a Hazardous Waste in accordance with 40 CFR 261. F. Recycle: Recovery of demolition or solid waste for subsequent processing in preparation for reuse. G. Salvage: Recovery of demolition or solid waste and subsequent sale or reuse in another facility. 1.3 SUBMITTALS A. Waste Management Plan: After award of the contract and prior to commencement of work, the Contractor shall submit a draft Waste Management Plan (Plan) to the Designer for approval. Revise and resubmit Plan as required by the Engineer. Approval of the Contractor’s Plan will not relieve the Contractor of responsibility for compliance with applicable environmental regulations. Recycling and Processing Facility Records: If used, indicate receipt and acceptance of recyclable waste by recycling and processing facilities licensed to accept them. Include manifests, weight tickets, receipts, and invoices. C. Landfill and Incinerator Disposal Records: Indicate receipt and acceptance of waste by landfills and incinerator facilities licensed to accept them. Include manifests, weight tickets, receipts, and invoices. PART 2 PRODUCTS (Not Used) PART 3 EXECUTION 3.1 DEBRIS REMOVAL A. Contractor shall remove deleterious materials (i.e., concrete, rubbish, etc.) that are present along the channel bed and banks at locations specified on the Drawings. Removal of these materials shall occur at the direction of the Designer. The Designer will also provide specific input regarding the extent of debris removal, including the depth and distance into the stream bed and banks that debris removal will occur. The goal of this effort is to remove unsightly and non-functional material while, at the same time, not causing adverse impacts to the channel bed and banks that could decrease stability. 3.2 WASTE MANAGEMENT PLAN IMPLEMENTATION A. General: Implement waste management plan as approved by the Engineer. Provide handling, containers, storage, signage, transportation, and other items as required to implement waste management plan during the entire duration of the Contract. B. The Contractor shall establish contacts with local recycling and reuse companies to set up the lines of responsibility. Contractor shall be responsible for coordinating with these companies in terms of identifying materials, pickup schedules, and standard quality for recycled materials. (Optional) C. Site Access and Temporary Controls: Conduct waste management operations to ensure minimum interference with roads, streets, walks, walkways, and other adjacent occupied and used facilities. D. Materials handling procedures: Materials to be recycled shall be protected from contamination and shall be handled, stored, and transported in a manner that meets the requirements set by the designated facilities for acceptance. 3.3 DEBRIS DISPOSAL A. General: Except for items or materials to be salvaged, recycled, or otherwise reused, remove debris from project site and legally dispose of them in a landfill or incinerator acceptable to authorities having jurisdiction. Except as otherwise specified, do not allow waste materials that are to be disposed of to accumulate on-site more than 5 days. 2. Remove and transport debris in a manner that will prevent spillage on adjacent surfaces and areas. B. Burning: Do not burn waste materials. C. Disposal: Transport waste materials off of property and legally dispose of them. PART 4 MEASUREMENT AND PAYMENT 4.1 DEBRIS REMOVAL A. Measurement will not be made. Payment will be made according to the contract lump sum price for “Site Preparation”. Work consists of installation and placement of bank stabilization materials, including geotextile fabric and fill materials, and live cuttings/stakes as shown on the Drawings. Work includes purchase, identifying, harvesting, storage, and delivery of plant materials to the construction site for planting purposes. 1.2 DEFINITIONS A. Geotextile: A geotextile is any fabric composed of polymeric or natural fibers formed into non-woven or woven fabric. 1.3 SUBMITTALS A. Samples: Submit to the Engineer for approval samples of any coir fabric materials. 1.4 RELATED DOCUMENTS A. The Drawings and General Provisions of the Contract, including Division 1 Specification sections, apply to the work of this section. PART 2 PRODUCTS 2.1 COIR FABRIC A. Woven Coir Fabric: For use as the outer fabric layer in FES lifts. Woven Coir Fabric Geotextile shall be a high-strength, woven, coir fabric made from 100% coconut fiber. Fabric roll widths shall be 3 meters, comprised of a biodegradable, continuously woven mat. The following are minimum roll properties: Property Test Method Criteria Thickness: ASTM D1777 0.30 in. Non-woven Coir Fabric: For use as the inner fabric layer in FES lifts, or as a soil retention blanket on graded slopes or other floodplain areas, as shown on the Drawings. Non-woven Coir Fabric Geotextile shall be a non-woven, composition coir blanket made from 100% coconut fiber, enclosed in a netting sewn from organic thread on 1.5-inch centers. Fabric roll widths shall be 2 meters. Non-woven Coir Fabric Geotextile shall meet the following minimum specifications: Property Test Method Criteria Thickness: ASTM D1777 0.25 in. Tensile Strength (dry): ASTM D4595 200 x 100 lb./in. Mass Per Unit Area: ASTM D3776 10 oz./sq. yd. Roll Width: approx. 2 meters Non-woven Coir Fabric Geotextile shall be North American Green C125BN or an approved equal by the Engineer. 2.2 EROSION CONTROL BLANKET A. Biodegradable Erosion Control Blanket – Straw/Fiber Matrix: For use as an erosion control blanket on regraded floodplain surfaces and adjacent slopes. The blanket shall be constructed of a 100% agricultural straw fiber matrix. The straw fiber shall be evenly distributed over the entire area of the mat. The straw material shall be contained within 100% biodegradable natural organic fiber netting woven into an approximate 0.50 inch x 1 inch mesh. Fabric roll widths shall be 2 meters. The following are minimum roll properties: Property Test Method Criteria Thickness: ASTM D6525 0.24 in. Tensile Strength (dry): ASTM D6818 193 x 187 lb./ft. Mass Per Unit Area: ASTM D6475 10 oz./sq. yd. Roll Width: 2 meters Biodegradable Erosion Control Blanket shall be North American Green S75BN, or an approved equal by the Designer. B. WOODEN STAKES A. Wooden stakes to be used for installation of Woven Coir Fabric, Non-woven Coir Fabric, and Biodegradable Erosion Control blankets shall be a minimum of 18-inches in length, with a wider head at the top of the stake that allows for securing the fabric to the ground surface. B. Wooden stakes shall be North American Green EcoSTAKEs, or an equal product approved by the Contracting Officer. The Trust for Public Land - Story Mill Ecological Restoration Project WATERWAY BANK PROTECTION RESPEC, Inc. 35 4200 / 3 PART 3 EXECUTION 3.1 FABRIC ENCAPSULATED SOIL (FES) LIFTS A. Excavate and/or place soil fill material behind FES lift locations, as necessary, to line and grade shown and in accordance with the Drawings. Construct FES lifts as shown on the Drawings using native fill material, woven- and non-woven coir fabric, wooden stakes, dormant cuttings and seed in accordance with the Specifications. Native fill material shall be placed in lifts with a maximum thickness of 6-inches within the 12 inch lift and then compacted to a maximum Standard Proctor Dry Density (SPDD) of 75% per ASTM D698 test methods. In no case shall the fill material within the FES lifts be compacted to greater than 75% density in order to promote vegetation growth. The moisture content, as determined by ASTM D2216, shall be less than + 2% of the optimum moisture content as determined by ASTM D698. Areas to be covered by the coir fabrics shall be graded to a lightly-scarified condition, free from protruding rocks, sticks and other debris that may prevent a smooth application or damage the fabric. Care shall be taken to remove objects that could interfere with application or damage fabric materials. Furnish and install plants (dormant cuttings) and seed in accordance with planting schedules, seed mixes, and planting notes provided on the Drawings. FES lifts shall be shaped to the slope angles shown on the Drawings with smooth transitions between varying slopes. The Contractor shall handle the fabric and soil materials in a manner that does not damage the fabric or deposit soil material in the stream channel. Fabric shall be installed evenly, smoothly, and taut under the supervision of, and to the satisfaction of, the Designer. Drawings provide general notes and details for securing the coir fabric materials as well as folding and joining ends of the coir fabric. No foot traffic or equipment shall be allowed on the completed FES lifts. Damaged fabric materials shall either be replaced or patched as directed by the Contracting Officer. Patches shall overlap the affected area by a minimum of 2 feet. Repairs and fabric replacements shall be performed at no additional cost to the project. After insertion, the tops of wooden stakes shall protrude a maximum of 2-inches above the fabric surface. B. FES Lift Construction Training Session: If requested, the Designer is available to conduct a FES lift construction training session. The training session would be arranged by the Contractor and shall include a representative of the Designer, the Contractor, the Contractor’s on-site The Trust for Public Land - Story Mill Ecological Restoration Project WATERWAY BANK PROTECTION RESPEC, Inc. 35 4200 / 4 construction supervisor, and the laborers who will be installing the FES lifts during project construction. The Contractor would provide all materials, machinery, tools, and labor needed to conduct a complete demonstration. During the training session the Designer, or their designated representative, would review the requirements stated on the Drawings and in the Specifications for FES lift construction, and would lead a demonstration of FES lift construction. 3.2 REGRADED FLOODPLAIN SURFACES A. Install fabric per manufacturer’s specifications and per requirements stated on the Drawings. PART 4 MEASUREMENT AND PAYMENT 4.1 WATERWAY BANK PROTECTION A. Measurement will not be made. Payment will be made according to the contract lump sum price for “Channel Reconstruction”.
