WHEREAS:
I.
'rhe City Manager and tIle City Engineer having heretofore on the 21st day of
June,
1935,
submitted to the Commission of the City of Bozeman,
a Report showing
sidewalks and cu.rbs in bad condl tion which should be repaired or replaced;
locations where no sidewalks have been constructed,
and new sidewalks should be
constructed;
locations where driveways adjacent to paved streets should be con-
structed or reconstructed;
all of which is set forth in Schedl11e attached to said
Report,
which Schedule shows the name of
the owner.
a descrintion of the property,
and the charac ter of the worle to be done,
and which Schedule is hereto attached and
made a part hereof;
that said Report and ::Jchedule "A" have been submi t ted to the
Comm~ssion pursuant to the provisions of Ordinance No.
561,
entitled:

a part of this Resolution No. 292, be, and the s~~e are hereby, ordered to be
constructed or reconstructed before August 1st, 1935;

I That the City Manager, pursuant to the provisions of Ordinance No. 561, give
written notice to tl1e several property owners, or agents of such property owners, as
provided by Section 6, of said Ordinance No. 561; that if any owner or agent of any
owner of any SllCh lot or parcel of land shall fail or neglect for a period of thirty
days after the date of the service of such notice to Cffilse such sidewalks or curbs
or other concrete work to be constructed, the City shall construct or cause such
sidewalks or curbs, or concrete work, to be constructed, and shall assess the cost
thereof, including engineering costs and the costs en1xmerated in Section 5246,
Political Code, R.C.M., 1921, against the property in front of which the same is
constructed.
VI.
That to defray the cost of construction of said sidewall{s and curbs, and any
other concrete work by the City, as herein provided, the assessment tllerefor shall
be spread over a term of five years, payment to be made in equal annual installments;
that the Resolution therefor shall be passed and adopted as provided by said
I Ordinance No. 561, and said, Section 5244, as amended by said Chapter 12, herein
referred to.
Passed and adopted by the Commission of the City of Bozeman at a regular
session thereof held on the 12th day of July, 1935.

hereby certify that the foregoing Resolution No. 292 of the City of Bozeman, was
pUIJlished by ti tIe in the Bozeman Daily Chronicle, a daily newspaper of general
circulation, printed and published in said City, in the issue of July 14t11, and
that due proof of said publication was made and filed in my office.
