HomeMy WebLinkAboutResolution No. 4311, Amendmending Resolution 4282, HRDC Owner Occupied Home Rehab Program Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Anna Rosenberry, Finance Director Chris Kukulski, City Manager SUBJECT: RESOLUTION NO. 4311 - AMENDING RESOLUTION NO. 4282, ADDING APPROPRIATIONS FOR HUMAN RESOURCE DEVELOPMENT COUNCIL’S OWNER OCCUPIED HOME REHABILITATION PROGRAM IN THE FISCAL YEAR ENDING JUNE 30, 2011. MEETING DATE: April 4, 2011 AGENDA ITEM TYPE: Consent RECOMMENDATION: Recommend Commission Approve Resolution No. 4311. BACKGROUND: On March 21, 2011, the Commission took public comment on providing a financial contribution from the Community Housing Fund to the Human Resource Development Council’s (HRDC) Owner Occupied Home Rehabilitation Program. They directed staff to prepare the necessary budget amendment to contribute $50,000 of Community Housing Fund – Workforce Housing dollars to the program. Currently HRDC offers the program outside the City Limits, with a local match provided by USDA-Rural Development. USDA-Rural Development money cannot be spent on this program inside the City Limits. The purpose of the City’s contribution would be to expand the program into the City of Bozeman. The City’s $50,000 would provide the local match for $500,000 or more in Federal Housing and Urban Development (HUD) program dollars in order to rehabilitate existing housing stock for qualifying city residents. Attached are the details of the program, as submitted by the HRDC. The Resolution’s Section 3 requires HRDC to report to the City Clerk to show that the City funds have been utilized as intended, once all the projects have completed. This report will include: (1) a list of properties rehabilitated, (2) the amounts of Federal dollars, City dollars, and 5 any other funding sources used for each property, and (3) program costs for each property. The HRDC is agreeable to this requirement. UNRESOLVED ISSUES: None ALTERNATIVES: 1. Do not provide these matching funds, or provide a different amount of matching funds, (not recommended.) 2. Provide matching funds from a different, unidentified source, (not recommended.) 3. Seek Federal HUD dollars on our own, without cooperation, coordination, or administration by HRDC, (not recommended.) FISCAL EFFECTS: This budget amendment will result in $50,000 of Community Housing funds being paid to HRDC. The resulting balance of mill-levy related Community Housing funds, after payment of our FY11 budget commitments and this amended appropriation, will be approximately $248,000. ALTERNATIVES: As suggested by the City Commission. The Resolution amends the budget to include appropriations of $50,000 from the Community Housing Fund for the Owner Occupied Home Rehabilitation Program. WHEREAS, the City Commission did, on the 21st day of June, 2010, adopted the City Manager’s Budget Recommendations for Fiscal Year 2010-2011 (Fiscal Year 2011) as the Preliminary Budget; and WHEREAS, the City Commission did, on the 13th day of September, 2010, after due and proper legal notice, conduct a public hearing on the proposed municipal budget; and WHEREAS, the City Commission did, on the 13th day of September, 2010, adopt Resolution No. 4282 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, APPROPRIATING FUNDS FOR VARIOUS BUDGET UNITS, AND FURTHER ESTIMATING REVENUE NECESSARY TO OPERATE AND MAINTAIN SERVICES OF MUNICIPAL GOVERNMENT FOR THE FISCAL YEAR ENDING JUNE 30, 2011.; and WHEREAS, the City Commission did, on the 21st day of March, 2011, consider and take public comment on providing a financial contribution from the Community Housing Fund to the Human Resource Development Council’s (HRDC) Owner Occupied Home Rehabilitation Program; specifically, expanding the program into the City of Bozeman to access $500,000 or more in Federal Housing and Urban Development (HUD) program dollars in order to rehabilitate existing housing stock for qualifying city residents; and WHEREAS, a local match of $50,000 provided by the City to HRDC would be combined with the Federal dollars and would result in the rehabilitation of approximately 20 homes in the city limits; and Page 2 of 3 WHEREAS, eligible participants in the program are real property owners who occupy their home, are in good standing on their mortgage, and earn less than 80% of Area Median Income (AMI) based on family size; and WHEREAS, sufficient money is available in the Community Housing Fund to be appropriated; and WHEREAS, the City Commission did, on the 4TH day of April, 2011, after due and proper legal notice, conduct a public hearing on the proposed budget amendment. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, to wit: Section 1 The City Commission of the City of Bozeman, Montana, does hereby authorize, in addition to appropriations authorized previously, the following expenditures: Budget Unit ADDITIONAL APPROPRIATION Community Housing Fund - 120 $50,000 From property tax revenues allocated to Workforce Housing. Section 2 These appropriations totaling $50,000 will be granted to the HRDC, to be matched with Federal Housing and Urban Development (HUD) program dollars for the purpose of the Owner Occupied Home Rehabilitation Program in the City of Bozeman. Section 3 Upon full expenditure of City funds and completion of the projects involved, HRDC will provide a report to the City Clerk to show that the City funds have been utilized as intended. This report will include: (1) a list of properties rehabilitated, (2) the amounts of Federal dollars, City dollars, and any Page 3 of 3 other funding sources used for each property, and (3) program costs for each property. Section 4 That should it be found by any court of competent jurisdiction that any section, clause, portion, sentence, word, or phrase of this resolution is deemed to be contrary to any existing law or regulations, that in this instance, it is the intent of the City Commission of the City of Bozeman, Montana, that all other portions, sections, words, clauses, phrases, or paragraphs of this document shall remain in full force and effect.
