Section 5.
Approximate Cost.
'I'hat the
approximate est:tmate of cost of the
aforesaid improvements
including all items mentioned in Section 4,
is $12,635.00.

Section 6.
Assessment of Cost.

is 554,426.5 square feet,
and an approximate estimate of
the
cost of said improvement to be specially taxed and assessed 8t':ainst the

provided:
that from the
total
cost of the construction of all the improvements herein contemplated as flnally
determined upon completion thereof,
there shall be deducted such part of said total
cost as shall be represented by any contribution thereto of labor,
service,
and/or
money by Public Works Administration,

or any other
federal or
state agency or administratlon by whatsoever name called,
and assessment

Payment in Bonds or Proceeds of Sale Thereof.

each square foot of the area within said district to be assessed and taxed

Section 9.
Payment in Installments
I
Th,-'lt such assessments and taxes shall be payable in eleven (11)
installments,
extendinG over a period of ten (10)
years with not to exceed six (6)
percent annual
interest on deferred payments cormrrencing with the year 1935;
provided,
th':t t payment in
full of such total assessment and any accrued interest thereon may be made at an~r time
after such total assessment is determined and levied in the manner by law provided.
Section 10.
Payment Assured.
That the prompt and full payment of said Special Improvempnt District No.
296
bonds and the interest thereon as herein proposed to be issued,
has been assured and
provided for by the
creation of a Special Improvement District Revolving Fund established
by the levy of a tnx of one half (~)
mill levy on each dollar of the
taxable valuation
of all taxable property within the corporate limits of the City of Bozeman,

was ~)assed and adopted.
Said Hesolution declares it to be the intention of the
Commission of the City of Bozeman to create a special improvement d-',.strict to be

known and designated as
"Special Improvement District No.
296" for the purpose of
cons truc ting and ins tallinr; sui table drainage devices and s true tures and paving
Story Street from Church Avenue to Tracy Avenue.
1'11e t\oundaries of said proposed district are as follows:
Beginning at a point in the east line of Tracy Avenue 150 feet
north of the north line of Story Street,
thence oasterly along
a line parallel
to and 150 feet distant from the said north line
of Story Street to a point in the west line of Church Avenue,
thence southerly along the said ,vest line of Church Avenue
to a
point 150 feet south of the south line of' Story Street,
thence
westerly along a line parallel to and 150 feet distant from the
said south line to a point in the enst line of Irr8cy Avenue,
thence northerly along said east line
of 'l'rRc;., Avenue to the
point of beginning.
By Daid Resolution the City Commission also declares its
intention to
assess the entj.re cost of the construction and installation of the aforesaid drainage
devices and paving and appurtenances :i.ncludin[~ engineering,
inspection,
and all
1.ncidentals expenses,
agains t the land wi thin the boundaries of said S!Jecial Improve-
ment District No.
296 as proposed upon the area basis,
each square foot of such land
to be assessed and taxed for the proportlonate share of such entire cost exclusive

'I Not:ice is hereby given that protests l~TUSt be filed in writing within 15 days
of Ute date hereof.
Notice is further hereby given that Friday, the 20th day of September, 1935,
a t the hour of 7: 30 P. M. is tl18 time. and the Connnission Chamber in the City Hall,
City of BozemaTl, T,l[ontana, is the place when and where the said Ci ty COTInnission will
hear and pass UDQn all protests legally made and filed against the creation of said
proposed district and the extent, character, and/or purpose thereof.
