MEMORANDUM OF UNDERSTANDING
Between the City of Bozeman Public Works Department and Sweet Pea
Festival of the Arts for the Management of the City of Bozeman's Mobile
Water Station �� h
Th\s Memorandum of Understanding is entered into on this J day of
) , 2014, between the City of Bozeman Public Works Department with
principal offices located at 20 East Olive Street Bozeman, Montana 59715 and Sweet Pea
Festival of the Arts with principal offices located at 424 East Main St. 203B Bozeman, Montana
59715 and is effective upon signing and receipt of the financial consideration set forth herein.
The City of Bozeman Public Works Department and Sweet Pea Festival of the Arts find as
follows:
WHEREAS, the Mobile Water Station is owned and operated by the City of Bozeman Public
Works through the Water and Sewer Department on behalf of the City of Bozeman;
And
WHEREAS, the Mobile Water Station is available pursuant to the terms set forth herein for use
by Sweet Pea Festival of the Arts;
And
WHEREAS, the City of Bozeman Public Works Department purchased the Mobile Water Station
with support in the amount of $2,500.00 provided by Sweet Pea Festival of the Arts;
And
WHEREAS the City of Bozeman Public Works Department and Sweet Pea Festival of the Arts
share a vested interest in the reasonable use and management of the Mobile Water Station.
NOW THEREFORE, based on the above findings, the City of Bozeman Public Works
Department and Sweet Pea Festival of the Arts mutually agree as follows:
1. Sweet Pea Festival of the Arts shall have use of the Mobile Water Station pursuant to
the findings and terms set forth herein and for the life of the equipment.
2. Sweet Pea Festival of the Arts shall have use of the Mobile Water Station for Sweet Pea
Festival and Bite of Bozeman.
3. The Mobile Water Station shall display the Sweet Pea Festival of the Arts logo and
name.
4. The City of Bozeman Public Works Department will coordinate with Sweet Pea Festival
of the Arts to make operational a water connection at Lindley Park for the Mobile Water
Station.
5. The City of Bozeman Public Works Department will make available a City of Bozeman
employee to transport, set-up and break-down the Mobile Water Station for Sweet Pea
Festival of the Arts and Bite of Bozeman.
6. Sweet Pea Festival of the Arts shall provide reasonable supervision and oversight of the
Mobile Water Station for the duration of Sweet Pea Festival and Bite of Bozeman.
7. Sweet Pea shall timely communicate to a City of Bozeman employee any damage to or
malfunctioning of the Mobile Water Station.
8. The City of Bozeman Public Works Department and Sweet Pea Festival of the Arts
agree the findings and terms of this Memorandum will remain in effect for the life of the
equipment or until modified, extended or terminated by both parties in writing.
