I WHEHEAS, the Commission of the City of Bozeman, did on the 2nd day of August,
1935, duly and regularly pass Conm1ission Resolution No. 293 entitled:
"A HESOLUTION OF THE CONIMISSION OF 'rHE CITY OF ROZEUAH, STATE OF
MONTANA, DECLARING IT TO BE THE INTENTION OP SAID COMJ'iIISSION TO

and thereafter, after due and legal proceedings had, the-"Commission of. the 01 ty of
Bozeman, did on the 6th day of September, 1935, duly pass Commission Resolution
No. 305 entitled:

I which Commission Resolutions Nos. 293 and 305 passed as aforesaid, are hereby referred
to and made a part of this Resolution for further particulars in respect to the boun-
daries of said district, the character of the improvements to be constructed therein,
the estimated cost of said improvements, and the method of assessing the cost

against the property within said district; and
WHEREAS, said improvements as contemplated in said Conwission Resolutions Nos.
293 and 305 have been constructed and completed in accordance with the terms and
conditions of Commission Resol~tions Nos. 293 and 305, and the total cost of said
illiprovements so constructed is the sum of Six Thousand Eight Hundred Seventeen
Dollars and Ninety Four Cents ($6817.94);
N01N. THEREFOHE. pursuant to the provisions of Sections 5225 to 5277 and 5485,
R. C. j',I., 1921, and amendments thereto,
BE IT RESOLVED AND IT IS J[E:REBY ORDERED BY THE COM:MISSION OF 'l'Im CITY OF
BOZEl/IAN, STATE OF T/I0N'IANA:
Section 1. That to defray the cost and expense of constructing and making the
improvements in said Special Improvement District No. 295, there be, and tllere is
I hereby levied and assessed, a tax amounting to the SU11l of Six Thousand Eii7)lt
Hur1dred Seventeen Dollars and Ninety Four Cents ($6817.94) upon all the propert:r in
said Special I'::.provement District No. 295; that a particular description of each lot
and parcel of land wi th the name of the ovmer and the sum assessed again;:;t hinl - or
it for such improvements and the a-:"ount of each partial payment to be made and the
day when the same s}~all be delinquent 1s set forth in detail in the assessment list

that the several

land be,
and the same are hereby,

against said described lots and parcels of land to defray the
cost and expanse of
constructing and making the said improvements within said District;
that the

so assessed be collected from the respective owners of said lots and
parcels of land described in said assessment list Schedule

that the payment of said sums
shall be made
in ten installments and the pay-
ment of said installments
shall extend over a period of nine years;
that the
paynlent of the respective annual installments shall be made on or before
the 30th
day of November,
of each year,
until payment
of all the installments

the interest
trlereon shall be made;
that said sums
shall be paid and the collection
thereof shall be made in the manner and in accordance with the law governint; the
collection of special improvement taxes;
that failrtre to pay such assess:nents
when the same shall become due and payable shall make such persons' and said lots
and parcels of land liable to the penalties provided by law relative to delinquent
taxes,

and stating that a Resolution levying a special
assessment of taxes to defray the cost and expense of constructing and making the
improvements in said Special Irnprovement District No.

of the Clerk of the COliunission subject to inspection for a period of five
