TEE PURPOSE OF CONs'rRUCTING STREET CUR23S AND OILED MACADAM P A VEI,1ENT ON BEALL STREET FROM TRACY A VENUE TO WILLi:;ON A VENUE. WHEHEAS: At a regula.r session of the Connnission of the City of Bozeman, State of -7i ~ ~ ~. ~ Montana, held on the th day of . t, 1936, the said Commission duly passed Commission Resolution No. 335 declaring it to be the intention of said Commission to create a I special improvement district to be known and designated as Special Improvement District No. 303, of said City for the purpose of constructing street curbs and oiled macadam pavement on Beall Street from Tracy Avenue to Willson Avenue, and to specially assess the entire cost and expense of making said improvements ar:ainst the property wi thin said district under and by virtue of the provision of the Laws of the State of Montana, in such case made and provided, and said Commission Resolution No. 335 is h<~reby referred to and made a. part hereof for further particulars in respect to the boundaries of sa.:td Special Improvement District No. 303, the estimated cost of said improvement and the method of assessing the same against the property of said district; and, V'IHEHEAS: Notice of the passage of said Commission Resolution No. 335 was duly pub~ 1 i shed, as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in the City of Bozeman, Montana, and by sending a copy of such notice by registered mail to each person, firm or corporation h8.ving property with~ in the proposed district, at his or its last known address, upon the same day that such '.-, notice was first published as aforesaid; and due proof' having been made of the publication and service of sard notice; and lHH Coupon Bonds, as authorized by the laws of the State of Montana, which bonds shall be in the denomination of one hundred ($100.00) dollars each, and fractions thereof where necessary, to be issued and chargeable against a fund to be known as "Special Improve- ment District No. 303 Fund," said bonds to be redeemable at the option of the City of Bozeman, Montana, whenever funds are available for that purpose from said Snecial I Improvement District No. 303 1~lund; aaid bonds shall draw simple interest at the rate of six (6) per cent per annum, which shall be chargeable as a part of the cost of said improvement and shall run from the date of the registration of said bonds until said bonds are paid. To pay said bonds, and the interest thereon, representing the cost of said improvement, a special assessment shall be levied against all the lands within said Special Improvement District No. 303 as in said Resolution of Intention No. 335 defined, each lot or parcel of land within said district to be B.'csessed for the por- tion of the whole cost in the proportion that the area of each said lot or parcel of land bears to the area. of the entire district, exclusive of streets, avenue~, alleys or purlic places; provided, that each square foot of the land within said district embraced within any corner lot or tract (and for the purpose of assessment in this district a corner lot is defined as being any tract of land, excepting streets, avenues or alleys, located within a distrance of twenty five (25) feet of either side line of Beall Street within the district) shall be so assessed that each square foot of tn.8 land embraced with any such corner lot or tract, as so defined, shall bear double the amount of the cost of such improvement that a square foot of any inside lot, or tract, or parcel, I shall bear. Section 4 Said assessment and taxes shall be payable in twenty-oen (21) annual installments, with six (6) per cent annual interest on deferred payments, commencing with the year 1936; but this provision shall not be construed to prevent full payment at any time. Section 5 That the City Engineer bo, and is hereby, directed to prepare plans and specifi- cations for the doin; of said work and the making of said improvements. Section 6 That the Clerk of the C1 ty C.>ommission of theCi ty of Bozeman be, and is hereby directed to publish a notice inviting proposals for the furnishing of material and the doing of the work and the making of said improvements in said Special Improvement District No. 303, .which notice shall refer to the plans and specifications on file, by publishing such notice in two (2) issues of Bozeman Daily Chronicle, a daily news- paper printed and published in the City of Bozeman, not less than ten (10) days before I the time such bids will be opened, which shall be at a meeting of the City Corrnnission to be held on Friday, the 18th day of September 1936, at 7:30 o'clock P.M. of said day.
