Y'/Tonroe, e tal, request1.ng that a S-oecial Improvement District be created in said Ci ty for th_e purpose of constructing street Cl1.rbs and oiled macadam I pavement on West Beall Street from Tracy Avenue to Willson Avenue, and WHEREAS: The Commissj.on of the City has considered the aforesaid peti tion and recogr:izes the need for this improvement and is of the opinion that the improvement i:D the value of the propert:-l in the proposed district vdll at least balance the cost and that it is in the ;Jublic interest thc.t this petition l)e (9~anted; N OVI , therefore, BE 1'1' RESOLVED BY 'l'HE COM.MISSION OF 'rEE CI'l'Y 01" 130ZJIMAN: Section 1. 'rhat it j.s hereby declared to be th_e intention of the Commission of the City of Bozeman, State of Montana, to create a Special Improvement District to be known and designated as Special Improvement District No. 303 of said City, for the purpose of makins the irnprovements within said Special Improvement District hereinafter described. Section 2. That the boundaries of said Special Improvement District No. 303 to be created are as follows: The North 150 feet of Block A of Tracy's Third Addition to Bozeman; and Lots 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 1'7, and 18 of rHoel: 3 of Beall's Third Addition to Bozeman together wit~ West Beall Street from the west line of Tracy AvemJ_e to the East line of Willson Avenue. The north 25 feet of Lots 15 and 16 of Block A Tracy's Third Addition I and all of Lots 12 and 13 of Block 3, Beall's Third, are to be con- siderec as corner lots and assessed at double their actual area. Section 3: That it is hereby declared to be the opinion of sa:td Commission of the C:U::y of Bozeman, State of Montana, that all of the land wi thI.n said proposed Special Improvement D:tstriet as definecl in Section 2 of this Resolutlon, will be specially benefitted by the grading, paving and installation of curbs and all of said improvements, and should bear all the cost of said improvements ir~ accordance wi tb the laws of the State of Montana in such case made and provided. Section 4: That the character of the improvement to be made within said Special Improvement District No. 303 is the grading; -----..-..-- <1 r-<,..... -It) Section 7: That the entire cos t and e;"pense of maJdng the special improvements herein set forth in said Special Improvement District No. 303 shall be paid by Special Improvement District Coupon Bonds, as authorized by the Laws of the State of Montana, which bonds shall be in the denomination of One Hundred Dol1~;1's (:;? 100.00 ) each, or fractions thereof where necessary, to be issued and chargeable against a fund to be I known as "3':,ecial Improvement District No. 303 Fund" said bonds to be redeemable at , the option of the City of Bozeman, Montana, whenever funds are available for that Durpose from said Special Improvement District No. 303 Fund. Said bonds shall draw sliple interest at the rate of six per cent per anum, which interest shall be chargeable as a part of the cost of said improvement, and sahlI run from the date of tile registra- tion of said bonds until said bonds are paid. Section 8: To pay said bonds, and interest thereon, representing the cost of said improvement, a special assessment shall be levied against all of the lands within said proposed Special Improvement District No. 303 as hereinbefore defined, each lot or par- cel of land wi th4.n said Dis trict to be assesse.:J for tha t portion of the whole cost in the proportion that the area of said lot, or parcel of land, bears to the area of the ent:tre district, exclusive of streets, avenues, alleys or public places, provided, that ...--.-- __u_.__._. .. 17fj - NOTICE IN H.E COMMISSION RESOLUTION NO. 335 lJOrrICE 19. .HEREBY GIVEN That at the regular meeting of the Comll1ission of the City of Bozeman held Friday, July 24th, 1936, Commission Resolution No. 335 was passed and adopted. Said Resolution declares it to be the intention of the Commlssion of the City of Bozeman to create a Special I:mprovement District to be known and designated as Special Improvement District No. 303, for the purpose of installing concrete curbs and oiled macadar:1 pavement I on Vvest Beall Street wi thin the boundaries of said proposed district as shown by said Resolution on file in the office of the Clerk of the Commission and described as follows, to-wi t: '1111e North 150 feet of Block A of Tracy' s rrhird Addl fun to Bozeman; and Lots 7, 8 9, 10, 11, 12, 13, 14, 15, 16, 17, and 13 of Elock , 3 of Beall's Third Addition to Bozeman together with West Beall Street from the west line of Tracy Avenue to the East line of Willson Avenue. The north 25 feet of Lots 15 and 16 of Block A, 'l\racy's 'l'hird Addi ti on and all of Lots 12 and 13 of Block 3, Beall's Third, are to be considered as corner lots and assessed at double their actual area. By the said Resolution, The Corrnnj_ssion also declares its intention to assess the entire cost of the conC) truction of said i-"ilprOvements including enE";:1.neering, inspectIon, and all other incidental expenses against the land and i:":lprovemonts w:Lthin the boundaries of said proposed Special :lmprovement District No. 303 upon the a rea bas:i.s, each square foot of the land wi thin the boundaries of tb_e said proposed Special Improvement District No. 303 (exclusive of streets, allyes, and other public places) to be assessed and taxed for its proportionate share of such entire cost, but with the arr:a of the corner lots with the proposed district doubled, as authorized by law.
