HomeMy WebLinkAboutResolution 367 SID No. 307 .-.--..--.--.. . :2H-7 COMMISSION RESOLUTION NO. 367 A RESOLUTION OF TIm CITY COMMISSION OF' THE CITY OF BOZEMAN, MONTANA, CRENrIlW A SPECIAL IMPROVEMENT DISTRICrr TO BE KNOWN AS SPECIAL IM- PROVEMENT DISTRICT NUMBER # 307 OF THE CITY OF BOZEMAN, FOR THE PURPOSE OF CONSTRUCTING CONCRETE CURBS AIID PLANT MIX OIL MACADAM PAVEMENT, OR PENOLITHIC PAVEMENT ON A CRUSHED GRAVEL BASE, ON WEST ALDERSON STREET BET'NEEN THE WEST LINE OF THIRD AVENUE, SOUrl'I-I, AND TIm EAST LINE OF FIFTH AVENUE, SOUTH, IN SAID CITY. I WHEREAS: At a regular session of the Commission of the City of Bozeman, State of Montana, held on the 7th day of May, 1937, the said Commission duly passed Com- mission Resolution No. 361 declaring it to be the intention of said Conunission to create a special improvement district to be known and designated as Special Improvement Dis- tirct No. 307, of said City for the purpose of constructing concrete curbs and plant mix oil macadam pavement or penolithic pavement on a crushed gravel base, on West Alderson Street between the west line of Third Avenue, Soutb, and the east line of Fifth Avenue, South, and to specially assess the entire cost and expense of making said improvements against the property within said district under and by virute of the provision of the Laws of the State of Montana, in such case made and provided, and said Commission Resolution No. 361 is hereby referred to and. made a part hereof for ~~HH THE CONSTRUCTING OF CONCRETE CURBS AND PLANT MIX OIL MACADAM PAVE- MEN T, OR PENOLI'IHIC PAVEMENT ON A CRUSHED GRAVEL BASE, ON WEST ALDERSON STREET BETWEEN THE VffiST LINE OF THIRD AVENUE, SOUTH, AND THE EAST LINE OF FIFrrn AVErITJE, SOUTH, IN SAID CITY OF BOZEMAN, MON 'I'ANA. Section 3 That the entire cost and expense of making the special improvements herein referred to in said Special Improvement District No. 307 shall be paid by Special Improvement District Coupon Bonds, as authorized by the laws of the State of Montana, which bonds I shall be in the denomination of one hundred ($100.00) dollars each, and fractions thereof where necessary, to be issued and chargeable against a fund to be }~nown as tlSpecial Improvement District No. 307 Fund II , said bonds to be redeemable Gt the option of the City of Bozeman, Montana, wherever funds are available for that purpose from said Special Improvement District No. 307 Fund; said bonds shall draw simple interest at the rate of six (6) per cent perannum, which shall be chafgeable as a part of the cost of said improvement and shall run from the date of the registration of said bonds until said bonds are paid. To pay sa:i_d bonds, and the interest thereon, representing the cost of said improvement, a special assessrlent shall be levied ag3inst all of the lands within said Special Improvement District No. 307 as in said Resolution of In~' tention No. 361 defined, each lot or parcel of land within said district to be assessed for the portion of the whole cost in the proportion that the area of each said lot or parcel of land bears to the area of the entire district, exclusive of streets, avenues, alleys or public places; provided, th8t each square foot of the land within said. dis- trict embraced within any corner lot or tract (and for the purpose of assessment in I this district a corner lnt is defIned as being any tract of land, exceyting streets, avenues or alleys, loc8ted within a distance of thirty (30) feet of either side line of said West Alderson Street, within the district) shall be so assessed that each square foot of the land embraced with any such corner lot or tract, as so defined, shall bear double the amount of the cost of such :i..rrprovement that a square foot of any inside lot, or tract, or parcel shall bear. Section 4 Said assessment and taxes shall be payable in twenty-one ...--...-....-. ~)8q f~ . directed to publish a notice inviting proposals for the furnishing of material and the doing of the work and the making of said imporvements in said Special Improvement District No. 307, whihc notice shall refer to the plans and specifications on file, by publishing such notice in two (2) issues of Bozeman Daily Chronicle, a daily news- I paper printed and published in the City of Bozeman, not less than ten (10) days before the time such bids will be opened, which shall be at a meeting or the City Commission to be held on Friday, the l6tli day of July, 1937, at 7:30 o'clock P. M. of said day. Passed and adopted by the Commission of theCity of Bozemqn at a regular session thereof held on the 4tJ:.l day of June, 1937.
