PROVEMENT DISTRICTS OF TIm CITY OF BOZEMAN, COUNTY OF GALLATIN, S'l'ATE OF MONT ANA, FOR THE MAINTENANCE OE<' P ARKINGS TO DEFARY THE COST OF MAIN'rAINING 'rEE PARKINGS WITHIN SAID SPECIAL IMPROVElVIENT DISTRICTS 0]1' THE CITY OF BOZEnAN FOR 'l'BE YEAR 1938. I WHEREAS, the City Council and the Commission of The City of Bozeman have hereto.. fore duly and regularly passed council and Commission Resolutions creating Special Im- provement Districts within The City of Bozeman, defining the boundaries thereof and providing for the maintenance of parkings therein, and for the assessment of the cost of maintaining the parkinc;s as set forth in Resolutions hereinafter referred to; and w::.'1'EREAS, the parkings within the boundaries of said Special Improvement Districts have been cared for and maintained during the year 1938 as contemplated in said Reso- lutions, in accordnace with terms and conditions thereof; and WHER: AS, said Special Improvement Districts for the maintenance of parkings and the Resolutions creating the same, the total frontage or the area, of the property within said districts to be assessed, the total cost of said maintenance within said districts and the amount chargeable to the property therein is hereinafter set forth. NOW, THEREFOR::::, pursuant to the provisions of Section 5242, Political Code, R.C.M. 1935, and said Council and Commission Resolutions, creating said Special Improvement Districts, and providing for the y,'aintenance thereof; BE IT RESOLVED AND IT IS HEHEBY ORDER~D BY TIm COMMISSION OF THE CITY OF BO ZE~fJ AJ'.j , STATE OF MONTANA: I Section 1. That for the year 1938 The City of Bozeman has defrayed the cost ($4545.10) or maintenance of parkings in the several Special Improvemen.t Districts, pur-suant to Resolutions creating the same, and th at the entire cost thereof, the total mnnber of linear feet, or area, 444 Maintenance of Parking District No. 57, created by COl..mcil Resoln tion No. 529, Cleveland Street from VVillson Avenue to Seventh Avenue, a total frontage of 3182 linear feet, the sum of $3:33.33 at an approximate rate per front foot of $0.08871. Maintenance of Parking District No. 52, created by Council Resolution :No. 472, Bab- cocl{ Street from Fifth Avenue to Eighth Avenue, a total area of 174600 square feet, the sum of $120.89, at an approximate rate per square foot of $0.0006924. Maintenance of Parking District No. 68, created by Council Resolution No. 539, Willson Avenue from College Street to Cleveland Street, a total frontaGe of 1260 linear I feet, the SlJm of ~~175.35, at an approximate rate per front foot of $0.139.16. Maintenance of Parking District No. 72, creat~d by Council Resolution No. 564, Co11ei~e Street from Grand Avenue to Seventh Avenue, a total area of 515294.7 square feet, $ ~ the sum of ~. 305.03, at an approximate rate per square :Toot of :;?0.0005920. Mai ntenance of Parking District 'No. 86, created by Council Resolution No. 620, south side Story Street from Sixth Avenue to Eighth Avenue and both sides Sixth Avenue from Story Street to College Street, a total frontage of 2426.2 linear feet, the sum of $238.88, at an approximate rate per front foot of $0.09846. Maintenance of Parking District No. 90, created by Council Resolution No. 636, east side Seventh Avenue from Story Street to College Street, a total frontage of 934.2 linear feet, the sum of $91.05, at an approximate rate per front foot of $.097463. Maintenance of Parking District No. 107, created by Council Resolution No. 658, East Story Street,from Tracy Avenue to Bozenlan Creek, a total frontage of 1259.8 linear feet, the sum of $155.73, at an approximate rate per front foot of $0.123615. Miintenance of Parking District No. 114, created by Council Resolution No. 722, west side Grand Avenue from College Street to Arthur Streot, a total fr::ntage of 930 linear feet, the sum of:~107.36, at an approximate rate per front foot of ;j~0.115441. Maintenance of Parking District No. 189, created by Council Resolution No. 1004, east side Grand Avenue from College Street to Arthur Street, a total frontage of 930 linear feet, sue SUla of $107.36, at an approximate rate per front foot of $0.115441. Maintenance of Parking District No. 301, created by Commission Resolution No. 331, Sixtll and Seventh Avenues between Harrison and Cleveland Streets, and on the south side of Harrison Street between Sixth and Seventh Avenues, a total frontage of 1456 linear feet, the SLIm of $143.23, at an approximate rate per front foot of $0.0984. Section 2. That, to defray the cas t of maintenance of par1dngs wi thin said Special Improvement Districts for the year 1938, there be, and there is hereby levied and assessed a tax upon all the property in front of and bordering on said Special Improvement Dis- tricts as set forth in Schedu~ One to Twenty-two inclusive, hereto a:,tached and made a part hereof; tha t a psrticular des cription of each lot and parcel of land with the name of the owner and the sum assessed against him or it, is set 4,15 when same sha.1l become due and payable shall malte such person and such lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 3. rrhat the regular session of the Co:mmis s ion of the City of Bozeman to be held on the 26th day of AUgiI3 t.. 1938, A. D... at the Commission Chamber, City Hall Building, be.. and the same is hereby designated as the time and place at which objections I to the final adoption of this Resolution will be heard by the Commission. Section 4. That the Clerk of the Commission be, and he is hereby ordered and dir- ected to pUblish in the Bozeman Daily Chronicle, a daily newspaper, printed and pub- lished in the said City of Bozeman, a notice signed by the Clerk of the COmTI1ission, and stating that a resolution levying a special assessment of taxes to defray the cost of Maintenance of Parkings in the said Special Improvement Districts for the year 1938, is on flle in the office of tbe Clerk of the Connni ssion, subject to inspection for a period of five days; thGt said notice shall state ahe time and place at which objection~ will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five days before the date set by the Commission fur hearing objections and the final adoption of this Resolution. Provisionally passed and adopted by the Commission of The City of Bozem"n at a regular session of said Commission on the 19th day of August, 1938.
