At a regular session of the Commission of '1'11.e City of Bozeman,
State of
Montana, held on the 15th day of July 1938,
the
said Comrrlission duly passed Conmlission

Hesolu..tion No.
408 declar ins it to be
the
intention of said Commission to create a
special improvement district to be ]{nown and desiz,nated as Special Improvement District
No. 323,
of said Ctty for the purpose of construct.1ng concrete
curbs,
penolithic pavement
on a four inch crtlshed rocl{ base and necessary c..rainage structures,
on 'l'hr.~d Avenue,
north,
between Mendewlall Street and Lamme Street,
and to specially assess
the enttre
cost and expense
of making said improvemnts against the
propert7l wi t:-in said district
under and by virtu.e of the provisions of the Laws of the State of Montana,
in such case
made and provided,
and said Comnission Resolution No. 408 is hereby referred
to and
made a part hereof for further particulars
in respect to the
boundaries of said
Special Improvement District No. 323,

t of said improvement and. the
method of assessing
the
same against tllli
property of said district;
and,
WHEREAS:
Notice of the passage of said Comm.ission Hesolution No.
408 was duly
published,
as required by law,
in the Bozeman
Daily Chronicle,
a dally newspaper of
general circulation printed and published in rrhe Ci ty of Bozeman, Montana,
and by
sending a copy of such notice by U.
S. Mail to each person,
firm or corporat:1on having
property witll:1n the proposed district,
at h1s OJ' its last
l':nown address, upon the
same

da:r that such not1ce was first :,lubli shed as aforesaid;
and due proof havinn: been made
of the publica t:i.on and servi ce of said notice;
and

'rhat the entire co~;,t and expense of mal{ing the
special improvements herein refer-
red to in said Special Improvement District No. 323 shall be paid by Special Improvement
District Cou:Jon Bonds, as :J.1J.thorized by the
laws of
the State of Montana which bonds
shall be in the denomination of 011e hundred dollars
(,:~100. 00)
each,
and frac ti ons
I
thereof where necessary,
to be issued and chargeable
against a fund to be known as
uSpecial Improvement District No.
323 Fund, It
said bonds to be redeemable at the option
of The City of Bozemar.., Montana,
whenever funds are available for that purpose from said
Special Improvement District No.
323 Fund;
said bonds shall draw simple
interest at a
rate not to exceed six percent (6%)
per annUJ11,
which shall be chargeable as a part of the
cost of said improvement and shall run from the date of the registration of said bonds
until said bonds are paid~
To pay said bonds,
and the interest thereon,
representtng
the cost of said improvement,
a special assessment
shall be levied against all of the
l~nds witl1in said Special Improvement District No. 323 as in said Resolution of Inten-
tion No.
408 defined,
each lot or parcel of land within
scid district to be assessed for
the portion of the whole
cost in the proportion that the
area of each said lot or parcel
of land bears
to the area of the entire dis trict,
ex
clusive of streets,
avenues,
alleys,
or pUblic places;
provided,

(and for the purpose of assessment in this district
a corner lot is defined as being any tract of land,
excepting streets,
avenue s,

alleys,
located within a distance of thirty (30)
