WHEREAS:
At a regular session
of the Commission of The City of Bozeman,
State of
Montana, held on the 26th day of Au[~st,
1938,
the said COll~ission duly passed Commission
Hesolution No. 419 declarinG it to be the intention of said Commission to create a
special improvement district to be known and designated as SDGcial Improvement District
No. 326,

Section 3
That the entire cost and expense of m~aking the
special impl"ovement her",ln set forth
in said Special Improvement District No. 326 may be paid in cash as provided in Section
5250, R. C. Montana,
1935,
and/W by special
improvement district coupon bonds and/o~
warrants of the denomination of $100.00 each and in fractions thereof where necessary,
to be issued and chargeable against the fund to be known as uSpecial Improvement Dis-

trict No. 326 Fund";
said bonds or warrants to be redeemable at the option
of The City
of Boz eman,
L'Iontana, whenver funds are available for th2 t purpoGe from said
Special
Improvement District No. 326 Fund;
said bonds or warrants shall
draw simple interest
not exceeding six (6)
per cent per annum, which shall be chargeable as a part
of the
cost of said special improvements and shall run from the date of the registration of
said bonds or warrants until said bonds or warrants are paid;
and such interest from
the date of the pegistration of said bonds or warrants until the payment. of the first
installment shall be collected by the director of finance of said City of Bozeman at
the time of col~ cting said first installment;
that the entire
cost and expense of said
improvement within said district shall be defrayed by a special assessment against the
entire district,
each lot or parcel of land within said distrtct to be assessed
for its
proportionate share of such expense,
each lineal front foot of the
total frontage of such
lots or parcles of land within said Special Improvement District No. 326 to be assessed
for its proportionate share of such entire cost.
Section 4
That the City Engineer be,
and he is hereby,
directed to prepare plans and ppec-

ifications for the (;oing of said work and making of said i!:1provement.
Section 5
That the Clerk of the Commission be,
and he
is hereb",
dlrected to publish a not'ce
invi ting proposals for the furnishing of materials and the doin,~ of the work and the
making of said improvement in said Special Improvement District No. 326 referring to
plana and spectflcations on file,
by publishing same in two(2)
issues of Bozeman Daily
ChDon:tcle,
a daily newspaper printed and published in The City of Bozeman,
not Je ss than
ten
( 10)
days before the
time such bids will be opened,
which shall be
at a meetlng of
said City Commission to be held on Friday,
the 30th day of September,
1938,
at 7:30
0' clock P.M.
of said day.
Passed and adopted by the Commission of The City of Bo zeml1.n at a regular session
thereof held on the 16th day of September,
1938.
