WHEREAS, the City Council and the Commission of The City of Bozeman have heretofore I duly and reglJ.larly passed Council and Commission Resolutions creating Street Sprinkling Districts within The City of Bozeman and defining the boundaries thereof and providing for the assessment of the cost of sprinkling the same as set forth in Resolutions hereinafter referred to; and WJ{!"i;HEAS, the streets witllin the boundaries of said Street Sprinkling Districts have been sprinkled durinG the year 1938 as contemplated in said Resolutions, in accordance with terms and conditions thereof; and WHEREAS, the Street Sprinkling Districts and the Resolutions creating the same, the total frontaGe of the property within said district to be assessed, the total cost of said sprinkling withIn said distrIcts and the proportion thereof chargeable to the property therein is hereinafter set forth. NOW, THEHEFOHE, pursuant to the provIsions of SectIons 5272 to 5277, inclusi va, Political Code, R.C.M., 1935, and Ordinance No. 295, and said Council and Commission Resolutions creating said street Sprinkling Districts; BE 11' RESOLVED i'.KD I~l' IS Elm:S:BY ORDERED BY THE COMTIiISSION OF THE CITY OB' BOZEMAN, S'I'A11E OF 1.1ON'rANA: I Section 1. That for the year 1938, The City of Bozenmn has defrayed the cost (.$2,109.22) of sprtnkling streets in the several Street Sprinkling Districts pursuant to Resolutions creatine; the same, and that seventy-five per cent of the entire cost thereof, ($1,581.90) exclusive of the cost of sprinkling parIes and public places, the total number of linear feet of property to be assessed, and the rate per linear foot, ..---.. 472 being 75J~ of the entire amount, or at an apuroxlmate rate uor front foot of $0.0111. - ~ ~ Sprinlding District No. 134, created by Council Resolution No. 769, South Willson Avenue from 1st alley south to Cleveland Street, a total frontage of 5921.37 feet, the sum of $67.65, being 75'1; of the entire amount, or at an approximate rate per front foot of $0.0114. Sprinkling Distr:i.ct No. 135, created by Council Resolution No. 770, South Grand Avenue from 1st alley south to College Street, a total frontage of 4614.42 feet, the SLtm of $22.87~ being 75% of the entire amount, or at an approximate I rate per front foot of .?0.O04956. Sprinkling District No. 136, created by Council Resolution No. 771, Third Avenue from Main Street to Babcocl: Street and from 011 ve Street to Cleveland Street, and Fourth Avenue from Babcock Street to Olive Street, a total frontage of 6160.45 feet, the sum of $33.60, being 75% of the entire amount, or a t an approximate rate per front foot of $0.005454. Sprinkling District No. 137, created by Council Resolution No. 772. North Wallace Avenue from Main Street to Tamarack Street, and fTamarack Street from Wallace Avenue to N. P. Station, a total frontage of 6458.2 feet, the sum of $58.95 being 75% of tho entire amount, or at an approximate rate per front foot of ;;~,0.OO913. Sprinkling District No. 138, created by Council Resolution No. 773, North Tracy Avenue from 1st alley north ,to Short Street, a total frontage of 2819.5 feet, the sum of $14.93, being 75% of the entlre amount, or at an approximate rate per front foot of $0.005295. That to defray seventy-five ( 75) per cent of the cost of sprinkling streets within said street sprinkling districts for the year 1938 there be, and there 1s hereby levied and assessed a tax upon all the property in front of and bordering on said I street sprinkling districts as set forth in Schedules One to '1'hirty-eip;ht ( 38) inclu - sive, hereto attached and made a part thereof; that a particular description of each lot and parcel of land with the name of the owner Qrd the sum assessed against him or it, is set forth in assessments lists hereto attached, marked, nSchednles One to Thirty- eightlt, and made a part hereof; that the several sums set opposite the names of the owners, and the described lots and parcels of land, be, and the same are hereby levied and assessed upon and against said lots and parcels of land; that the several sums be collected from the respective ovmers of said lots and parcels of land described in the said assessment lists, Schedules One to T;~irty-eight, :lncluslve, as required by law; that said sums shall be paid and the collection thereof shall be made in the manner an in accordance with the law governing the collection of special improvelnent taxes; that failure to pay such assessments when same shall become dtle and payable shall make such person and such lots and parcels of land liable to the penalties provided by the law relative to delinquent taxes.
