~nIEREAS, The City Commission of the City of Bozeman heretofore
duly and regularly

passed Ordinance No.
428,
entitled:

"AN ORDINANCE DEFINING AND PROVIDING FOR THE PUNISHMEN'r
AND ABA'rEMENT OF
CERTAIN NUISANCES",
and
'IJlTEHEAS,
Section 5039.82, R.C.M.
1935,
provides the City or Town Council has power
to declare and determine what gegetntion within
the city or town shall be noxious weeds,
and to provide themanner in which they shall be exterminated,
and to require the owner or
owners of any pronerty within said city of town,
to exte~linate or remove noxious weeds
from their premises,
and the one-half' of any road or street
lying next to the
lands or
boulevard abutti.ng thereon,
and to provide,
in
the event the owners or owner of any of
said premises neGlect to exterminate or remove the noxious weeds therefrom,
for levying the
cost of such extermination or removal as
special assessment
against the property;
and
WliEREAS,
owners of premises in said City have neglected to exterminate
and remove
noxious weeds therefrom during the ye8.r 1938 and The City of Bozeman,
pursuant to Section
5039.82 R.C.M.
1935 and Ordinance No. 428, have exterminated and
removed noxious weeds
from premises of said owners and the total cost of the extermlnat:ton and removal thereof
ls chargeable
to the prop~;rty as hereinafter set forth,
pursuant to provisions of said

and said Ordinance
No. 428:
BE IT RESOLVED AND IT IS HEREBY

Section 3. That the regular session of the Connnission of The City of Bozeman to
be held on the 23rd day of September, 1938 at the Connnission Room, City Hall Buildj.ng,
be and the Slli~e is hereby designated as the time and place at which objections to the
final adoption of this Resolution will be heard by the Commission.
Section 4. 'rhat the Clerk of the Cor:unission be, and he is hereby ordered and directed
to publish in the Bozeman Daily Chronicle, a daily newspaper, printed and published in I
the said Ci t;;' of Bozeman, a notice signed by the Clerk of the Commission, s tatinc that
a resol'ution lev'ying a special assessment of taxes to defray the cost of exterminating
and remov.lng noxious weeds from certain properties in 'rhe C1 t:l of Bozeman for the year
1938, is on file in the office of the Clerk of the Commission, subject to inspection for
a per:lod of five da.ys; that said notice shall state the time and place at which objections
will be heard by the Cormnission to the final adoption of this Resolution, that it shall
be p-ublished at least five days before the date set by the Com.rnission for hear:tng of
objectlons, and the final adoption of this Hesolution.
Passed by tho Commiss:ion of The City of Bozeman at a regular session thereof held
on the 16th day of September, 1938.

Bozeman held on the 16th day of September, 1938, Commission Hesolution No. 425 was duly
passed and adopted; that said Connnission Resolution No. 425 levies and assesses a special
assessment of taxes upon certain properties in 'rhe C:1.t:t of Bozeman for the year 1938
to defray the cost of exterminatinG and removing noxious weeds for the year 1938. I
'rl1.at, said Commission Eesolution No. 425 is now on file in the office of the Clerk
of tIle Commission of said City of Bozeman subject to inspection of all persons in-
terested for a period of five (5) days, by any person interested; that Friday, the 23rd
day of Septenmer, 1938, at 7:30 o'clock P.M. of said day at a regular session of the

has been
designated a3 the time and place when and where said Commission will hear and pass
upon any and all objections that may be made to the final passage and adoption of
said CODMission Resolution No. 425 and the levying of said assessment;
