Lots 21-25, Bozeman Gateway PUD,Phase 2-APPEAL
Dear Ms. Ulmen,
Mitchell Development Group, LLC respectfully requests the withdrawal of the Appeal to
the City Commission of the decision by the Planning Department that the Kohl's
Department Site Application Plan was inadequate. The Planning Department and
Mitchell Development Group, LLC have reached an agreement as to the re-submittal of
the Kohl's Department Site Application Plan as well as some minor modifications to the
Bozeman Gateway PUD.
As discussed during our meetings with the City Manager, Chris Kukulski, and the
Planning Department, we are requesting a refund of the Appeal fee since no costs were
incurred to the City to publish notices for the Appeal and very limited staff time was
spent on the Appeal.
