The Commission of the City of Bozeman met in the Community Room, Gallatin County
Courthouse, 311 West Main Street, on Monday, May 29, 2007 at 6:00 pm. Present were Mayor
Jeff Krauss, Cr. Sean Becker, Cr. Kaaren Jacobson, Cr. Steve Kirchhoff, Cr. Jeff Rupp, City
Manager Chris Kukulski, Finance Director Anna Rosenberry, Fire Chief Chuck Winn, Deputy
Police Chief Mark Lachapelle, Planning Director Andy Epple, Assistant City Attorney Tim
Cooper, and City Clerk Brit Fontenot.

Mayor Krauss stated that this portion of the meeting will be closed pursuant to MCA section 2-3-
203 (3) to discuss a personnel matter. The individual has not waived their right to privacy. It has
been determined that the demands of individual privacy clearly outweigh the merits of public
disclosure.

Mayor Krauss stated that the Commission voted 4 - 0 to find the charges proven and to accept
discipline recommended.
0:28:38 [17:44:45] D. Public Service Announcement - U.S. Mayors’ Climate Protection
Agreement Task Force (Baker)
City Clerk Brit Fontenot informed the Commission and the public that the Clerk's office was taking
applications for the U.S. Mayors’ Climate Protection Agreement Task Force. He also alerted the
citizenry about the Citizen's Survey whereby randomly selected citizens have been selected to
receive their survey. He stressed the importance of returning the completed survey to the City.

Those voting Aye being Crs. Becker, Rupp, Jacobson and Mayor Krauss.

Those absent being Cr. Kirchhoff.
The motion carried 4 - 0.

Mayor Krauss called for public comment. This was the time for individuals to comment on matters
falling within the purview of the Bozeman City Commission. There was also an opportunity in
conjunction with each agenda item for comments pertaining to that item.

0:32:48 [18:06:34] 1. Resolution No. 4024, Learning Circle Montessori Elementary School,
Inc. and the issuance of a revenue note to finance the costs of acquiring a building to be used
as a private elementary school (Horatio Potter, Board President, Learning Circle Montessori
Elementary School)

Mayor Krauss noted that Cr. Kirchhoff arrived at approximately 6:30 pm.
0:41:38 [18:14:58] Motion and Vote to approve Resolution No. 4024, Learning Circle
Montessori Elementary School, Inc.
It was moved by Cr. Rupp, seconded by Cr. Kirchhoff, to approve Resolution No. 4024,
Learning Circle Montessori Elementary School, Inc. and the issuance of a revenue note to
finance the costs of acquiring a building to be used as a private elementary school.
Those voting Aye being Crs. Rupp, Kirchhoff, Jacobson, Becker and Mayor Krauss.
Those voting No being none.
The motion carried 5 - 0.

her report.

Mayor Krauss called for public comment.

1:00:07 [18:28:29] Cr. Jacobson stated that a mail ballot would increase voter turnout, however she
expressed concern with the 20-day time frame between when ballots are received by the voters and
Election Day. If voters receive ballots too early they may cast their vote before they have the
opportunity to see or hear candidates express their views on the issues. She suggested it could be
reduced to 15 days.
1:01:49 [18:29:07] Mayor Krauss suggested that the City should pay for return postage on the
ballots.
1:04:02 [18:29:45] Cr. Becker supports efforts to introduce mail ballots in any way possible.
1:05:55 [18:30:03] Cr. Rupp stated that he prefers the traditional method of voting, that of voters
physically going to the polls. He stated that it is a tradition that works and he does not see why it
should be changed.
1:06:54 [18:30:47] Motion and Vote to direct staff to prepare a resolution notifying the
Gallatin County Election Administrator of the City’s desire to conduct the 2007 municipal
elections by mail ballot
It was moved by Cr. Kirchhoff, seconded by Cr. Jacobson to direct staff to prepare a
resolution notifying the Gallatin County Election Administrator of the City’s desire to
conduct the 2007 municipal primary election (if held) and the 2007 municipal general election
by mail ballot in accordance with 13-19- 202 Montana Code Annotated.

Assistant Director of Planning Chris Saunders presented the staff report.
1:25:08 [18:35:01] Mayor Krauss requested that the representatives of the Planning Board
introduce themselves. Present were Eric Henyon, Edward Sypzinski, Brian Caldwell, Caren
Roberty, William Quinn and Randy Carpenter.

A lengthy discussion between the Commission, Planning Board, representatives of Clarion and
Associates and City staff ensued in which direction was provided to the consultants and staff.

4:20:53 [21:46:14] Mayor Krauss - Suspension of the Rules
Mayor Krauss suspended the rules of procedure for 15 minutes in order that the meeting could
continue.

Cr. Kirchhoff mentioned the SOPRIS Foundation Conference and suggested his participation.

Mayor Krauss suggested to Cr. Jacobson that perhaps she should investigate new responsibilities of
a mayor beginning in 2008 and brought upon by the Charter.
