RECOMMENDATION: The City Commission finally adopts Ordinance No. 1732 on second reading.
BACKGROUND: The Commission granted initial approval of the zone map amendment on April 2,
2007. The ordinance was provisionally adopted with first reading on November 19, 2007.
UNRESOLVED ISSUES: None identified at this time.
FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will likely include increased
property tax revenues, along with additional costs for municipal services when the property is
developed.
ALTERNATIVES: As suggested by the City Commission.

ORDINANCE NO. 1732
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, AMENDING THE BOZEMAN’S OFFICIAL CITY
ZONING MAP’S ZONING DISTRICT DESIGNATIONS BY CHANGING
THE ZONING DESIGNATION FROM “R-1” (RESIDENTIAL SINGLE-
HOUSEHOLD, LOW DENSITY DISTRICT) TO “R-2” (RESIDENTIAL
TWO-HOUSEHOLD, MEDIUM DENSITY DISTRICT) AND “R-3”
(RESIDENTIAL MEDIUM DENSITY DISTRICT) ON ~ 15 ACRES
SITUATED IN A PORTION OF SECTION 24, T2S, R5E, PMM, CITY OF
BOZEMAN, GALLATIN COUNTY, MONTANA, AND LOCATED
SOUTHEAST OF SOUTH 11TH AVENUE AND OPPORTUNITY WAY.
WHEREAS, the zone map amendment to establish an amended zoning designation from
“R-1” (Residential Single-Household, Low Density District) to “R-2” (Residential Two-Household,
Medium Density District) and “R-3” (Residential Medium Density District) on ~ 15 acres has been
properly submitted, reviewed and advertised; and
WHEREAS, the City of Bozeman Zoning Commission held a public hearing on March 6
and 20, 2007, to receive and review all written and oral testimony on the request for a zone map
amendment; and
WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman City
Commission that the zone map amendment from “R-1” (Residential Single-Household, Low Density
District) to “R-2” (Residential Two-Household, Medium Density District) and “R-3” (Residential
Medium Density District) be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on April 2,
2007, to receive and review all written and oral testimony on the request for a zone map amendment;
and
WHEREAS, the City Commission has reviewed and considered the twelve zone change
criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment from

“R-1” (Residential Single-Household, Low Density District) to “R-2” (Residential Two-Household,
Medium Density District) and “R-3” (Residential Medium Density District), as recommended by the
Zoning Commission, to be in compliance with the twelve criteria; and
WHEREAS, at its meeting held on April 2, 2007, the City Commission found that the
proposed zone map amendment would be in compliance with the Bozeman 2020 Community Plan and
would be in the public interest.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of
Bozeman, Montana:
Section 1
That the zoning district designation of the following-described property is hereby amended
from “R-1” (Residential Single-Household, Low Density District) to “R-2” (Residential Two-
Household, Medium Density District):
Commencing at the northwest corner of Remainder Tract A, Allison Subdivision - Phase 2;
Thence along the north line of said Remainder Tract A, N89º05'00"E, a distance of 622.51 feet to
the True Point of Beginning;
Thence continuing along the north line of said Remainder Tract A, N89º05'00"E a distance of
556.18 feet;
Thence S00º31'09"W, a distance of 363.44 feet;
Thence S33º35'11"W, a distance of 420.69 feet;
Thence S35º38'16"W, a distance of 402.66 feet, to the centerline of future Arnold Street;
Thence along the centerline of future Arnold Street the following three courses;
Thence along a non-tangent curve to the right, having a radius of 255.00 feet and a
central angle of 2º30'31", and arc length of 11.16 feet (chord being N56º48'53"W, a
distance of 11.16 feet);
Thence N55º33'38"W, a distance of 107.28 feet;
Thence along a tangent curve to the left, having a radius of 245.00 feet and a central
angle of 5º45'57", an arc length of 24.66 feet (chord being N58 º 26’36”W, a distance of
24.65 feet) to the centerline of future Keeton Street;
Thence along the centerline of future Keeton Street the following three courses;
Thence N28º10'04"E, a distance of 16.35 feet;
Thence along a tangent curve to the left, having a radius of 150.00 feet and a central
angle of 27º38'55", an arc length of 72.38 feet;
Thence N00º31'09"E, a distance of 868.72 feet to the True Point of Beginning.

Said tract of land being 9.6649 acres, more or less.
That the zoning district designation of the following-described property is hereby amended
from “R-1” (Residential Single-Household, Low Density District) to “R-3” (Residential Medium
Density District):
Beginning at the northwest corner of Remainder Tract A, Allison Subdivision - Phase 2;
Thence along the north line of said Remainder Tract A, N89º05'00"E, a distance of 622.51 feet to
the centerline of future Keeton Street;
Thence along the centerline of future Keeton Street, S00º31'09"W, a distance of 339.61 feet to
the centerline of future O'Quinn Street;
Thence along the centerline of future O'Quinn Street, S89º05'00"W, a distance of 622.51 feet to
the westerly boundary of Remainder Tract A, Allison Subdivision - Phase 2;
Thence along the westerly boundary of said Remainder Tract A, N00º31'09"E, a distance of
339.61 feet, to the Point of Beginning.
Said tract of land being 4.8518 acres, more or less.
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading, at a
