WHEREAS, the C:lty Council and the Commission of The City of Bozsman have heretofore

Dis tric ts wi th1. n rrhe C1 ty of Bozeman and def....ininp; tlJ8 boundaries thereof andprovlding
for the assessJ'Y'ent of the cost of sprinklinrr the same as se t forth in Resolu tions here-
inaftor referred to; and
WHEREAS, the streets within the bOl.mdaries of said Street Sprinkling Districts have
been sprinkled durinR: the year 1942 as contemplated in said Resolutions, in accordance
with terms and conditions thereof; and
WHEREAS, the Street Sprinkling Districts and the ResollJtions creating the same, the
total frontage of the property within said district to be assessed, the total cost of said
sprinldinp: wi thin said die tric ts and the proportion thereof chargeable to the property
therein is hereinafter set forth.
NOW, THSREFORE, pursuant to the provisions of Sections 5272 to 5277, inclusive, Pol-
itical Code, R.C.M., 1935, and Ordinance No. 295 and said C01Jncil and Commission R",solutions
creatin~ said Street Sprinklinp; Districts;

STA~~ OF MONTANA:
Section 1. 'That for the year 1942, The City of Bozeman has waived the sprinkling
assessments on the fOllowinG districts: l~n, 132, 133, 134, 135, 1;36, 137, 130, 13\~, 140, 1-
141, 142, 143, 144, 160, 161, 163, 164, 192, 193, 194, 195, 196, 197, 198, 199, 204, 216,
217, 218, 210, 220, 232, 233, 234, 235, 236, 237, 238, and 256; that for the year 1942,
The City of Bozeman has defrayed the cost of (:ff1456.53) of sprinkling streets in the
several Strf)et SprinklinR: Districts pursuant to R~solutions creating the same, and that
seventy-five percent of the entire cost thereof ($1092.40) ex.clusive of the cost of
sprinklin0: parks and 1':molic places, the total number of linear feet of property to be
assessed, an~ the rate per linear foot, is as follows, to-wit:

Wallace Avenue to Fourth Avenue, a total frontage of 9363.4 feet, the S1)ill of ~\jl033.25,
being 75ib of the entire amOlmt, or at an approximate rate per front foot of :1~;0.11035.
Sprinkling District No. 130, created by Cmlnci1 Resolution No. 765, No asseSRment.
Snrinklin~ Dictrict No. 162, created by Council Resobltion Nn. 858, Babcock Street
from Bozeman Avenue to Fifth A~enue, and Fifth Avenue from Babcock Street to Main Street,
a total frontage of 4690.5 feet, the sum of $59.15, being 75')b of the entire amount or at
an approximate rate per front foot of $0.01261.
Section 2. That to defray seventy-five (75) per cent of the cost of sprinkling
streets, within said street sprinkling districts for the year 1942, there be, and there is
hereby levied and assessed a tax upon all the property in front of and bordering 01"1 said I
street spr~nk1inQ' districts AS flet forth in Schedules One and Two, hereto attached and made
a part hereof; that a particular description of each lot and parcel of land with the name
of the O1.mer and. the sum assessed against h:Lm or j,t, is set forth in assessments lists

parcels of land, be, and the same are hereby levied and assessed upon and against said
lots and p8rcels of land; that the several sums be collected from the respective owners

said sums shall be paid and the collection
thereof shall
be made in the manner and in accordance with the law governing
the collection of special
improvement taxes; that failure
to pay such assessments when same shall become due and
pa yable shall make s
uch person and such lots and parcels of land liable to the penalties
I provided by the law relative to
delin~uent taxes.

held on the 17th day of July, 1942,
at the Commission Chamber, Ci ty Hall Building, be,
and the same is hereby desipnated as
the time and place at which objectl.ons to
the final
adoption of this Resolution will be heard by thB Commission.
Sec tion 4. That the Clerk of the Commission
be, and he is hereby ordered and directed
to p1Jblish in the Bozeman :)8ily Chronicle a daily newspaper,
printed and published in the
said City of Bozeman, a notice signed
by the Clerl{ of the Commission, and stating that a
Resolution levying a special assessment of
taxes to defray seventy-five (75)
per cent of
the cost of sprinkling streets in
the said Street Sprinkling Uistricts for the year 1942,
is on file in the office of the
Clerk of the Commis sian,
subject to inspection for a
period of five days; that said notice
shall state the time and place at which objections
will be heard by the Commission to the final adoption of
this Resohltion; that it shall
be published at least five days before the date set by the Commission for hearing of
ob-
~pctions, and the final adoption of this RAsolution.
