HomeMy WebLinkAboutResolution 525 Grant Leaves of Absense 2~il Bozeman, Montana COMMIS~3ION RESOLUTION NO. 525 A RESO~UTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION AND POLICY OF THE CITY TO GRANT LEAVES OF ABSENCE AND ASSURE RE-EMPLOY1VfENT TO PERMANENT EMPLOYEES OF THE CITY WHO ARE INDUC- TED INTO TIm LAND AND NAVAL FORCES OF THE UNITED STATES DURING THE PRESENT WAR WITH GERMANY AND JAPAN I WHEREAS, From time to time employes of The City of Bozeman have been inducted into . ~ . the land .and naval forces of the Uni ted States during the preseT1t war and more of them are likely to be so inducted; and WHEREAS, Such employes have deemed it necessary upon such induction or impending induction to apply to the City Commission for leave of absence from such employrnAnt and for assurance of re-f>:mploym~:mt upon the termination of such service in the land and naval forces, as aforesaid, and more such applica tions are likely to be made; now, th erefore, BE IT RESOLVED EY THE COMNfISSION OF THE CI'I'Y OF BOZEMAN: Section 1. It is hereby declared to be the policy and intention of The Oi t~T of Bozeman to grant to its permanent officers and employes Buch leaves of absence as may be " necessary to enable them, or any of them, to be inducted into the land and naval forces of the United States, or any officially designated branch or service thereof, for the duration of the present war with Germany and Japan, without prejudice to, or risk of losing, their employment by the City by reason of such induction, and upon the termination of such service in the national defense during the presen t war; provided, such officer or employe shall give to the City Manager formal written notice of such induction, actual I or impending, and application for such leave of absence, as will enable a record thereof to be made in the appropriate City record or file. Section 2. The. t the rule sand reP:111a tions grantinlZ such leaves of absence and such . - - re-employment, shall be, to the extent that the same are applicable and suitable, those set forth and con ta:lned in Chapter 47 and Cahpter 150 of the Laws of the Twen ty-seven th Legislative Assembly of the State of Montana, 1941, and any amendments thereto. Sec tion 3. "Permanent Officer of Employe" as used in Section 1 of this Resolution shall be construed to mean and include an officer of employe whose appointment or employ- ment shall be for an indefinite period, or at the will of the City Manager or City Com- mission, who shall be holding and discharging the duties of such office or employment at the time of his induction into such land and naval forces, or either, and who shall have held and filled such position or emploj~ent continuously for a period of not less than one year a t the time of such induction.
