Whereas, the City Council of The City of Bozeman heretofore duly and regularly passed
Ordinance No. 502, entitled:
"AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW FROM THE SIDEWALKS IN THE CITY
OF BOZEt~AN AND REPEALING ORDINANCE NO. 385, ENTI TLED: tAN ORDINANCE PROVIDING
POR THE REMOVAL OF SNOW AND ICE, DIRT, FILTH AND OTHER OBSTRUCTION FROM SIDE-
WALKS ON MAIN STREET BET1NEEN WALLACE AVENlffi AND FOURTH AVENUE IN THE CITY OF
BOZEMAN''', and
Whereas, Section 5039.6 R. C. M., 1935, provides:
"The City of ToV\'I1 Council has power to regulate the use of sidewalks, and to require
the owners of the premises adjoining to keep same free from snow xx xxx xx; and to
provide for lev~ing the cost of removal as a special tax against the property xxx and,
Whereas, owners of premises in said C lty have neglected to remove the snow from the
sidewalks adjoining thereto during the year 1943-1944, and The City of Bozeman, purslJant
to Section 5039.6, and Ordinance No. 502 has removed the snow from the sidewalks adjoining
the premises of said owner:> and the total cost of the removal thereof is chargeable to the
property as hereinafter set forth, pursuant to provisions of said Section 5039.6 Political
Code, R.C.M., 1935 and said Ordinance No. 502;
NOW, TImREFORE, BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION
OF THE CITY OF BOZEMAN, STATE OF MONTANA:
Section 1. The t during the year 1943-1944, The Ci ty of Bozeman has removed snow I
from sidewalks adjoining premises in The City of Bozeman and defrayed the cost thereof as
set forth in Schedule "One" hereto attached and made a part hereof.
Section 2. That to defray the cost ($518.23) of removing said snow from sidewalks
adjoining said premises as set forth in said Schedule "One", heret~ attached and made a -I
part hereof, for the year 1943-1944, there be, and there is hereby levied and assessed
a special tax against said property as set forth in said Schedule "One", hereto attached
and made a part hereof; the t a particular description of each lot and parcel of land wi th
the name of the owner and the sum assessed against him or it is set forth in a ssesamen t
list hereto attached marked Schedule "One", and made a part hereof; that the several sums
set opposite the name of the owners and the description of the lots and parcels of lands
be, and the same are hereby lr>vied and assessed upon and a gainst said lots and parcels
of land; that the several sums be collected from the respective owners of said lots and
parcels of lands described in said assessment list, Schedule "One" as required by law;
that said sums shall be paid and the collection thereof shall be made in the amnner and in
accordance with the law governing the collection of special improvement taxes; that fail-
ure to pay such assessments when same shall become due and payable shall make such person I
and such lots and parcels of land liable to the penalties provided by the law relative
to delinouent taxes.
Section 3. Tha t the regular session of the Cornmis sion of The City of Bozeman to be
held on the 30th day of JunA, 1944, at the Commission Room, City Hall Building, be, and
the same is hereby designated as the ti~e and place at which objections to the final adop-
tion of this Resolution will be hegrd by the Commission.

Section 4. That the Clerk of the Commission be, and he is hereby directed and
ordered to publish in the Boz eman Daily Chr,)nicle, a daily newspaper printed and published
in said City of Bozeman, a notice signed by the Clerk of the Commission, and stating that
a resolution levying a special assessment of taxes to defray the cost of removal of snow
and ice from sidewalks adjoining certain premises in The City of Bozeman for the year 1943-
I 1944 is on file in the office of the Clerk of the Commission, subject to inspec ti,on for
a period of five (5) days; that said notice shall state the time and place at which ob-
jections will be heard by the Commission to the final adoption of this Resolution; that
it shall be published at least five days before the date set by the Commission for hearing
of objections and the final adoption of this Resolutfon.
Provisbnally passed and adopted by the Commisston of The 0ity of Bozeman at a regular
meeting of said Commissi on on the 23rd day of June, 1944.

HEARING, FINAL ADOPTION COMMISSION RESOLUTION NO. 543 LEVYING SPECIAL ASSESSMENT
TO DEFRAY THE COST OF REMOVAL OF SNOW FROM THE SIDEWALKS ADJOINING CERTAIN PREM-
ISES IN TlIE CITY OF BOZEMAN FOR THE YEAR 1943-1944.
NOTICE IS HEREBY GIVEN, That at a regular session of the Commission of The City of
Bozeman held on the 23rd day of June, 1944, Commission Resolution No. 543 was duly passed
and adopted; that said Commission Resolution No. 543 levies and assesses a special assess-
ment of taxes upon certain properties in The City of Bozeman for the year 1944 to defray
the cost of removal of snow for the year 1943-1944.
That said Commission Resolution No. 543 is now on file in the office of the Clerk of
the Commission of said City of Bozeman subject to inspection of all persons interested
for a period of five (5) days by any person interested; tha t Friday the 30th day of June,
1944, at 7:30 o'clock P.M., of said day at a regular session of the Commission of The
City of Bozeman, Commission Room, City Hall Building, has been designated as the time and
I place when and where said Commission will hear and pass upon any and all objections that
may be made to the final passage and adoption of said Commission Resolution No. 543,and

the levying of said assessment;/that said Resolution will be finally passed and adopted
at said regular session of said Commission, sub.1e c t to such correo tions and amendments
as may be made upon objections made and filed within five days limit as provided by law.
