WHEH.EAS, the City Council and the Conunission of The City of Bozeman have heretofore
I duly and regularly passed Council and Commission Resolutions creating Street Sprinkling Dis-
tricts within The City of Bozeman ana defining the bound!1rles thereof and providing for the
assessment of the cost of sprinkling the san:e as set forth in Resolutions hereinafter
referred to; and
WHEHEAS, the streets within the boundaries of said Street Sprinkling J.,Iistricts have
been sprinkled during the year 1944 as contemplated in said Resolutions,
in accordance
with terms and conditions thereof; and
WHEREAS, the Street Sprinkling Districts and the Resolutions creatirg the same,
the
total frontage of the property within said district to be assessed, the
total cost of said
sprinl{ling within said dis tricts and the proportion thereof chargeable to the property
tperein is hereinafter set forth.
NOW THEREFORE, pursuant to the provisions of Sections 5272 to 5277,
inclusive, Pol-
itical Code, R.C.l'v'l. , 1935, and Ordimmce
No. 295 and saId Council 8.nd Commission Resolu-
tions cree. ting said Street Sprinkling Districts;

I Section 1. .rhat for the year 1944,
The City of Bozeman has waived the sprinkling
assessments on the following districts: 130, 131,
132, 13)> 134, 135,
136, 137, 138, 139,
140, Itl1, 142, 143, 144,
160, 161, 162, 163, 104,
192, 193, 194, 195, 19~, 1 97, 198,
204, 199
216, 217, 218, 219, 220,
232, 23;), 234, 235, 236,
237, 238, and 250; that for the year
1944, The City of Bozeman has defrayed the cost ($1,661.46) of
sprinkling streets in the
several Street Sprinkling Districts pursuant to Resolutions creating the san~, and
tba t
seven ty-fi ve percent of the entire co~') t thereof ($1,246.10) exclusive
of the cost of
sprinkling parks and public places, the tot a.l number of linear feet of property to be as-
sessed, and the rate per llnear foot, is a s follows,
to -wit:
Sprinkling Distri ct NO.1, created by Council Resc,lution No. 424~, Maln Street from
Wa.llace Avenue to Fourth Avenue, a total frontage of 9363.4 feet, the sum of $1,133.60,
be1ng 75'jb of the entire amount, or at an approximate rate per front foot of ;$0.12107.
Spri~{ling District No. 162, created
by Council Resolution No. 858, BabcoCk Street
from Bozeman Avenue to Fifth Averme, and Fifth Avenue from Babcock Street to Main Street,
a total frontage of 4690.5 feet, the sum of -iP112.50, being 75Jb or the entire amount or at
an approximate rate per front foot of $0.023985.
Section 2. That to defray seventy-five (75)
percent of the cost of sprinkling streets
within said street sprinkling districts for the year 1944, th~e be,
and the re is hereby
I levied and assessed a tax upon all the property in fron of and bordering on said street
sprir1k1ing districts as set forth in Schedules One and Two, hereto attached and made a
part hereof; triR t a parti cular description of each lot and parcel
of land with the name
of the OM1er a~d the sum assessed against him or it,
is set forth in assessments lists
hereto actached, marked "Schedules One (1) to Two
( 2) incluai ve, and made a part hereof;
that the several sums set opposite the names of the owners, andthedescribed
lots and
parcels of land be, and the same are hereby levied and
assessed upon and against said lots

and parcels of land; that the several sums be collected from the respective
owners of said
lots and parcels of land described in the said assessment lists, Schedules One and Two
as
required by law; that said sums shall be paid and the collection
thereof" shall be made in
the manner and in accordance with the law governing the collection of special improvement
taxes; that failure to pay such assessments wl-~en same shall become due
and payable shall
make such person and such lots and parcels of land liable to t.he penal ti es pro vided by

the law relative to delinquent taxes.
Section 3. That the regular session of the Commis sion of rhe Ci ty of Bozeman to be
held on the 26th de:7 of Mey 1944, at the Commission Chamber, City Hall BuilGing,
be, and
the same is hereby designated as the time and place at W11ich objections to the final adop-
t ion of thi s Resolut ion will be heard' by the Cornmi ssion.
Section 4. That the Clerk of the Commission be, and he is hereby ordered
and directed
to publisfl in the Bozeman Daily Chronicle a dally newspaper, printed and published in the
saId City of Bozeman, a notice signed by the Clerk of theCommission, and
statIng th'1t a
Resolution levying a special assessment of taxes to defrqy seventy-five (75)
percent of
the cost of sprinkling streets in the said Street Sprinkling Districts for the
year 1944,
is on file in the office of the Clerk of the Commission, sub j ect to inspection for a
period of five days; that said notice shall state the time and place at which obj ections
will be heard by the Commission to the final adoption of this Resolution;
that it aMI be
published At least five days before the dGte set by the Commis~ion for hearing of objections,
and the fInal adoption 0 f this Resolution.
