WmmEAS, on the 26th day of May, 1944, the Commission of The City of Bozeman, pursuant to the provisions, of Ordinance No. 561, en ti tled: It AN ORDINANCE COVERING THE CONSTRUCTION AND INST\LLA'1'ION OF CONCRETE CURBS AND I SIDEWALKS IN THE CITY OF BOZEMAN, PROVIDING PENALTTFS FOR THE VIOLATION OF' THIS ORDINANCE AND REPEALING ORDINANCES NOS. 365, 374, 435, 447, 449 AND 451, AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES OF THE CITY OF BOZEMAN IN CONFLICT HEREWTTW' . , and the provisions of Section 5244, Political Code, H.C.M., 1935, provided for the construc- tion of sidewalks and curbs in The City-of BozemRn, during the year 1944, without the for- mation of a Special Improvement District. WHEREAS, proceedln~s were had for the construction and installation and/or repair of miscellaneous Siriewalks and Curbs in The City of Bozeman for the year 1944, and WHEREAS, Miscellaneous sidewalk and curbs were constructed and in8talled and/or re- paired bordering on varimJs properties in The City of Bozeman, pursuant to Ordinance No. 561, Section 5244, Political Code, R.C.M., 1935, which are hereby referred to and made a part of this Resolution, and WHEREAS, the said Miscellaneous Sidewalks and Curbs have been constructed and com- pleted and/or repaired in accordance with the terms and conditions of said proceedings, and the C1 ty H:ngineer has d11,ly certified to the Commission a schedule showing the sdiewalks and curbs which have been const~1cted and installed, and/or repaired, and the properties which are sub,1ect to assessment thereunder and the total cost of said constrl1ction and in- I stallation and/or repairing is the sum of Six Hundred Seventy-nine Dollars and Sixty-five C en ts , ($679.65), which schedule, marked "Schedule A", is hereto attached and made a part hereof. NOW, THE:REFORR, pursuant to the provisions of Ordinance No. 561, as aforesaid, and Section 5244, Poll tical Cc~de, R.C.M., lD35, as aforesaid, BE IT RESOLVED AND IT IS H:-mEBY ORDER~~D BY THE CmOnSSION OF THE CITY OF BOZEMAN, MON'rANA: See tion 1. That to defray the cost of constructing and inst lling and/or repairing ~~-' scellaneous Sidewalks and Curbs as set forth in "Schedule An, hereto a ttached and made a part hereof, there is hereby levied and assessed a tax amounting to the sum of Six Hundred Seventy-nine Dollars and Sixty-five Cents ($679.65). Section 2. Tha tapa rticu la r description of each 10 t and pa rce 1 of land wi th the name of the owner and the sum assessed against him or it for such construction and instal- lation and/or repair and the amou'nt of each payment to be made and the day when the same shall be come delinquent is set forth in the assessment li~t hereto attached marked "Schedule An and made a part hereof; that the several sums set opposite the name of the I owners and the description of the lots and parcels of land be, and the same are hereby respectively levied and assessed upon said lots and parcels of land to defray the cost and expense of constructIng and instRlling and/or repairinr-; said Sidewalks and Curbs; that the several sums so assessed be collected from the respective owners of sali lots and parcels of land described in said assessment list as reouired by law; tha t the pa ymen t of said S1.Jms shall be made in flve installments for all amo1Jnts in excess of Eleven Dollars and for all amounts less than Eleven Dollars to be made in one installment; that ___. __._..._n__._. __...._ all the payments of said installments shall be made on 0r before the 30th day of November of each year until payment of all installments together with the interest thereof, sha 11 be made; that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law ~overning the collection of Special Improvement taxes; that failure to pay such assessments when the same shall become due and payable shall make such I persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes; Section 3. That the reg111ar session of the Commission of The City of Bozeman to be held in the Commission Chamber in the City Hall of said City on the 6th day of October', 1944, at 7:30 o'clock P.M., be, and the same is hereby designated as the time and pIa ce at which objections to the final adoption of this Resolu tion will be heard by said COmrl:>siDn. Section 4. ThAt the Clerk of the Commis~ion of The City of Bozeman be, and he is hereby ordered and directnd to p1Jblish in the Bozeman D8ily Chronicle, a daily newspaper printed and published in the said Ci ty of Bozeman, a notice signed by the Clerk of the Commisf1ion and stating th8t a R",solution levying and assessing a special assessment of taxes to defray the cost and expense of constructing and installing and/or repairing Side- walks and Curbs in The City of Bozeman for the year 1944 is on file in the ~ffice of the Clerk of the Gommission sub,ject to the inspection for a period of five (5 ) days; that said notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five (5 ) days before the day set by the Commission for the hearing of ob,1ections and the final I adoption of this Resol11 tion. NOTICE IS HEREBY GIVEN, that at a reQ;111ar session of the Commission of The City of Bozeman held on Friday the 29th day of September, 1944, Commission Resolution No. 549 was I pr~visionBlly passed and adopted; th8t said Commission Resolution levies and assesses a special assessment of taxes upon certain lots and parcels of land in front, or on the side of which, Sidewalks and Curbs hRve been constructed and/or repaired pursuant to the provi- sions of Ordinance No. 561 and Section 5244, Political Code, R.C.M., 19;')5, to defray the cost and expense of constructing and installing and/or repairing said Sidewalks and Curbs. , That said Commission Rp,sollltiofi is now on file in the office of the Clerk of the Com'- mission, subiect to inspection for a period of five (5 ) days by any persons interested; Commis~n Resolution No. 549. 3'1 ') " .I~ th9t Friday the 6th day of October, 19 44 , at 7:30 o'clock P.M., of said day, a t the reglllar session of the said Commission of the City of BozemAn at the Commission Chamber in the City Hall Building of said City, has been desip;n8ted as the time and place when and where the said Commission will hear and pass upon any and all ob.1ections tha t ma y be made to the final passage and adoption of said Resolution No. 549 and the levying of sald assess- ment, and that said Resolution will be finally passed and adopted at said regular session.
