CERTAIN NUISANCES", and
WHEREAS, section 5039.82, R.C.M., 1935,
provides the Jity or Town Council has power
to declare and determine what vegetation within the City or Town shall be noxious weeds,
and to provide the manner in which they shall be exterminated, and to reauire the
owner
or owners of any property within said City or Town, to exterminate or remove noxious
~eeds from their premises, and the one-half of any road or street lying next to
the lands
or boulevard ebuttl~g thereon, and to provide, in
the event the owners or owner of any
of said premises neglect to exterminate or remove the noxious weeds therefrom,
for levying
the cost of such extermination or removal as special assessment against the property;
and

moval thereof is chargeable to the property as hereinafter set forth,

NOW, THEREFORE BE IT RT<:SOLVED AND IT IS ImREBY ORDERED BY 'liRE COM1\1L3SION

STATE OF MONTANA:
See tion 1. That during the year 1944, The City of
rio~ernDn has exterminated and re-
moved noxious weeds from properties in The City of Bozeman and defrayed the cost thereof
as set forth in Schedule ItAn hereto attached and made a part hereof.
See tion 2. That to defray the cost ($96.00)
of exterminating and removing said
noxious weeds from said prerdses as set forth in said Schedule, hereto attached and made
a part hereof, for the year 1944, there be, and
there is hereby levied and assessed a
special tax against said property as set forth in said Schedule,
hereto attached and made
a part hereof; that a pqrticular description of each lot and parcel of land with the name
of the owner and the sum assessed ao:ainst him or it is set forth in assessment list here-
to attached marked Schedule itA", and made a virt hereof;
tha t the several sums set oppo-
site the names of the owners and the description of the lots and parcels of lands be,
and the same are hereby levied and assessed upon and against said lots and parcels of
1 land; that the several sums be collected from the respective owners
of said lots and
parcels of lands described in said assessment list, Schedule "Aft,
as required by law;
the t said SlJmS shall be paid and the collection thereof shall be made in the
manner and
in accordance wi th the law governing the collec tion of special improvement taxes;
that
failure to pay s1Jch assessments when same shall become due and payable shall make such
person and such lots and parcels of land liable to the penalties provided by the law
re18tive to delin~uent taxes.

Section 3. That the regular session of the Commission of The City of Bozeman to be
held on the 29th day of September, 1944, at the Commission Room,
City Hall Building, be
and the same is hereby designated as the time and place at which objections to the final
adoption of this Resolution will be heArd by the Com..>n:ission.
Section 4. Tha t the Clerk of the Commis sion be and he is hereby ordered and
directed
to publish in the Bozeman Daily Chronicle, a daily newspaper,
printed and published in I

be heard by the Commis~ion to the final adoption of this Resolution; that it shall be
published at least five days before the date set by the Commission for hearing of objec-
tions, and the final adoption of this Resolution.

Notice is hereby Given, ThAt at a regular session of the Commission of The Cityat'
Bozeman held on the 22nd day of September, 1944, Commission Resolution
No. 548 was duly
passed and adopted; that said Commission Resolution No. 548 levies and assesses a special
assessment of taxes upon certain properties in The City of Bozeman for the year 1944 to
defray the cost of exterminatinp: and removing noxious weeds for the year 1944.
Tha t, said Commispion Resolution No. 548 is now on file in the office of theClerk
of the Commis sion of sa 1.d C1 ty of Boz eT'18n sub,iect to inspection
of all persons interested
for a period of five (5) days, by any p8rson interested; th8t Friday the 29th
day of
September, 1944, at 7:30 o'clock P.M., of said day at a repJlar session of
the Commission
of The City of Bozemnn, City Hall Buildlnr,r, has been designated as
the time and place
when and where said Co~mission, will hear and pass upon any and all obiections that may I
be made to the final passage and adoption of said Commipsion Resolution No. 548 and the
levying of said assessment; th8 t, sald ResollJtion will be finally passed and adopted at
said regular session of saidCommisdon sub.1ect to such corrections and amendments as
